Watertower Lane, Suite 202 Meridian, Idaho 83642 Re: Miscellaneous Application — Development Agreement Modification Request Resolution Park Medical Office Building 1828 S Millennium Way Dear Sir or Madam: On behalf of Millennium Medical Group, LLC please find enclosed the Miscellaneous Application requesting Amendment to the Development Agreement for Resolution Subdivision, dated July 18, 2000, recorded July 20, 2000 as Instrument No. 10056508, records of Ada County Idaho. Millennium Medical Group, LLC owns Lot 3, Block 1 of Resolution Subdivision No. 1 and is in the process of submitting all necessary applications to obtain a building permit for a commercial/medical office building on this property. We currently have a CZC Application under review, and during that process it was brought to our attention that a CUP would be required due to the above referenced Development Agreement. This 1.2 acre parcel was part of a large 47 acre conceptual Conditional Use Permit proposal in 2000 which was processed as Resolution Plaza. The Development Agreement entered into by the developer of Resolution Plaza and the City of Meridian requires a separate Conditional Use Permit for each proposed project within the original subdivision. Millennium Medical Group is seeking to amend the Development Agreement to remove the obligation for Lot 3, Block 1 Resolution Subdivision to obtain Conditional Use Approval as required by the Development Agreement for Resolution Plaza. We are requesting standard Unified Code language be applied instead. In this case the commercial/medical office Use is consistent with the existing L -O Zone Use. The current City of Meridian regulations do not require conforming parcels to submit for Conditional Use Approval. Thus, it is the request of the Applicant to be held to the current City standards with regard to the proposed Uses on this parcel by amending the Development Agreement to deleting the CUP sections in their entirety. It is the belief of the Applicant that is will alleviate an already very heavy workload for City Staff and free up City funds for other uses since a Development Agreement Modification is far less time consuming than a CUP Application. x' The original Development Agreement was well-intentioned and provided the City a level of protection and:guidance at the time. However, the intent for the Millennium Medical Group parcel is now clearly defined and is compatible with the allowed use as dictated by zoning which would otherwise govern this property. The subject property is a flag lot with medical offices to the west, north and east. The south property line abuts a Mountain View High School field. Regarding the property along the east line, in 2004 an Amendment to the Development Agreement was granted to that property which removed the obligation (see PP -04-010) to submit Conditional Use Permit applications, so long as the uses and development would not otherwise be required to obtain CUP approval according to the City's Zoning and Development Ordinance. This request was for a six parcel development. Development was consistent with the Zone. Given these factors, we respectfully submit our request for Amendment and look forward to your comments.
