On behalf of DRB Investment, LLC., please accept this letter of explanation for the request
for a reduction to the width of the buffer(and building setback) required in the C-G zoning
district along the northern portion of the west boundary of the site adjacent to residential
uses from the required 25'-0"to a 7'-0" landscape buffer adjacent to parking, and a 10'-0"
landscape buffer adjacent to the building with a 15'-0" building setback at the rear of the
building on Pad A, as allowed by UDC 11-3B-9C.2 for a one-story multi-tenant Shell and
Core Building (Pad A) and associated site work located at the Pine 43 West development
at E Fairview Ave., Meridian, Idaho. The project has recently obtained Conditional Use
Approval(H-2024-0038)for a drive through establishment within 300 feet of existing
residential uses. A letter of support and consent has been provided by the adjacent
residential landowner to the west.
The proposed project will take place on parcel: R7104250581 which is currently zoned (C-
G) General Retail and Service Commercial,which permits this type of use. The overall site
is 2.183 acres.The building size of Pad A is approximately 7,800 square feet and Pad B to
the south is approximately 10,100 square feet. For both Pad A and Pad B only the building
shell is planned for construction, the tenant improvement plans will be submitted at a
future date.The related site work will be newly constructed for the use of the retail/mixed
use buildings and ties into the existing site work.
The alignment of N Webb Ave to the east of the project site shifts abruptly to the west as it
intersects with E Fairview Avenue in order to align with the access point on the north side of
Fairview. As a result, the project parcel becomes quite narrow tapering from a width of

approximately 350 feet on the south boundary, to approximately 160 feet on the north
boundary.
In order to position the Pad A structure on the north side of the parcel, the building has
been positioned perpendicular to E Fairview Ave and the building depth has been reduced
as much as reasonably possible to accommodate a parking field located east of the
building. This configuration provides a screening of the parking field by positioning the
building between the residential to the west and the parking to the east. This additionally
screens the front entrances to the building from the adjacent residential.
Along the western property line, it is required to provide a 25'-0"wide landscape buffer
between the proposed Pad A retail mixed-use building and the multi-family residential
development west of the site. The landscape strip serves to buffer views of the building and
to create an aesthetic view from neighboring units. Due to the parking and radius
requirements, as well as pedestrian and vehicular circulation, we are proposing a building
setback 15'-0"width, 10'-0"of landscaped area as a buffer and a 5'-0"wide concrete
sidewalk abutting the building for access to tenant spaces. Additionally, a 6'-0"tall, closed
vinyl fence is proposed along the western boundary of the site to provide additional
screening for the residential units.
