I would like to have this letter put into Public Comments showing the violations that were communicated to
Timbercreek from Lori at CDH. I would also like to note that the City of Meridian never requested any of this
information from CDH as stated in the Agency Comments from Lori at CDH which were submitted on
9/27/24. I believe the city has failed to protect the public and uphold their duties to hold Timbercreek
accountable to his agreement and they should not grant him any modifications.

RE: Odor complaints
Mr. Murgoitio,
During the month of April 2023 Central District Health(CDH) and the Department of Environmental
Quality(DEQ) have received numerous odor complaints.The complaints generally indicate that there is a
foul odor that appears to be coming from the Timber Creek Recycling facility located at 7695 S. Locust
Grove Rd., Meridian, ID 83642 that is impacting the-neighbors surrounding the facility.
On April 13, 2023 an on-site investigation was conducted by CDH regarding the odors. During this
investigation it was determined that there were several windrows that had what appeared to be the
dairy waste bi-product exposed creating the odor which was not in compliance with the Operating Plan.
On April 18, 2023 CDH was notified that improper covering of the-material was a training issue that had
been resolved.
The-week of April 24, 2023 CDH and DEQ received numerous complaints over several days that week
stating that the odor was again unbearable,specifically in the late evening hours.
Over the weekend of May 5, 2023 CDH received numerous complaints both days that the odor is once
again unbearable in the evening time from 5:00 pm that lasted several hours.
Given the number of complaints CDH and DEQ are requesting that Timber Creek Recycling provide the
following information in accordance with your Operation Plan and Odor Management Plan.
1. Provide the daily log of materials, including quantities, received, specifically compost feedstock
from April 1, 2023 through the date of this letter
2. Provide a list of any new materials the site has received that is not included in the Operations
Plan
3. Provide the feedstock material ratios for each windrow created since April 1, 2023
4. Provide information on the Carbon:Nitrogen ratio, moisture level,%Oxygen and pH for the
compost rows. If the any levels have been out of balance, provide the steps taken to remedy the
issue
5. Provide the days and times.the windrows were created,turned or moved from April 1 through
the date of this letter

6. Provide the documented weather information including date,time,temperature,wind direction
and speed, precipitation, relative humidity and barometric pressure during the times the
windrows were created,turned or moved from April 1, 2023 through the date of this letter
7. Describe the process in handling the dairy bi-product waste from hauling to finished compost
8. Provide the complaint logs for any complaint received from the public since November 2022
9. Provide the completed weekly self-inspection and odor inspection form since November 2022
CDH and DEQ are of the opinion that the nature and history of the dairy waste-bi-product may be the
cause of the ongoing odor complaints.
If the odor issues cannot be resolved,DEQ and CDH may require that acceptance of the dairy waste be
disapproved at your facility.

RE: Response to requested information received
Mr. Murgoitio,
Thank you for providing the requested information from the letter dated May 8, 2023. Central District
Health (CDH) and The Department of Environmental Quality(DEQ) have reviewed the information
submitted and have the following comments.
Based on the information submitted the facility is not following the approved Operations Plan and Odor
Management Plan dated November 28, 2019 regarding receiving and handling of the cheese whey(WAS)
product which is a highly foul odor producing material. It appears that the odor complaints received
directly correlate to this material.
1. Feedstock Composition: The Operations Plan indicates a feedstock recipe that included 5%of the
WAS product. Based on the material received logs and the window information,the feedstock
contains approximately 50%of the WAS product which exceeds the approved percentage
significantly.
2. Material received and handled:The Odor Management Plan is not being followed in .regard to
the day, time of day and weather conditions the material is being received, mixed,windrowed or
turned.
3. Corrective action not taken immediately.The self-inspection logs indicate that TCR response to
complaints or findings that the WAS is not being handled or covered properly is not being
managed in a timely manner. Upon inspection, if the material is deemed to be not covered or
mixed properly it needs to be rectified immediately and not wait until the following business day.
4. Inaccurate statement. On your complaint log for the inspection conducted on April 13, 2023 you
indicated that Lori Badigian did not find the site was in violation. This statement is not accurate.
When we met out onsite, I advised that there is a very foul odor to the South and Southeast of
the property and it was determined that several windrows containing the WAS product was not
covered and had the WAS product exposed. TCR was directed to take corrective action at that
time.

It has been determined that the facility is in violation IDAPA 58.01.06 by not following the approved
Operations Plan and Odor Management Plan and is hereby directed to immediately adjust the facility
operations to follow the plan as approved. Specifically,the facility is in violation of IDAPA
58.01.06.12.03.c. Waste Types. Only solid waste types listed in the approved operating plan may be
accepted for disposal or processing, and IDAPA 58.01.06.12.03.i. Nuisance Control. III. Odor. The facility
shall be operated to control malodorous gasses.
This letter is to inform you that you must amend your current practices to be consistent with the
approved operations plan. You have 90 days to show that the site has amended operations to be aligned
with the approved Operating plans and that the site can manage the volume of materials approved in
the operations plan without complaint.

RE:Warning Letter
Mr. Murgoitio,
Central District Health(CDH)and The Department of Environmental Quality(DEQ)have received
numerous odor complaints from the Community reporting"a foul and horrific odor coming from the
Timber Creek Recycling facility"at the property located at 7695 S Locust grove Rd., Meridiam ID
83642.
Upon investigation,the odor complaints received from the community have been valid, and it has
been determined the cause of the odor issue is the WAS Industrial Waste received from the Sorento
plant. This material has been the basis for numerous ongoing validated complaints in the past and
seems to occur in the Spring,Summer and Fall months. CDH has been informed the WAS material
takes approximately three hours to process from delivery to finished cap. During the investigations
which have occurred during various stages or processing,CDH has determined the foul odor is
emitted from this product until it is windrowed and capped and odors may linger in the vicinity
depending on weather conditions. Based on the nature of the material, it does not appear this WAS
industrial waste can be received and processed without it producing odors that are impacting
neighboring properties.
On September 5,2024 CDH requested material received logs for the previous 90 days along with
any complaint information received by Timber Creek Recycling.This information was received on
September 6,2024 and found the following issues/violations:
• The WAS Industrial Waste received is falsely and inaccurately noted as Cheese Whey. In
addition,the record did not include a description identifying the makeup of Compostable
Wastes being received from Republic Services and Hardin Waste Services.
o Correct your documentation to accurately reflect the material received and
categorize the"Compostable Waste"received from Republic Services by
September 30,2024
• Quantities of the WAS(Cheese Whey)received exceeds the approved limit of 5%as
indicated in Section 2.4 Table 2 of the approved Operating Plan. Based on the logs received,
this waste is received 6 days per week, 2-3 loads per day averaging 35-68%of the total
volume received daily.
o Lessen the amount of WAS(Cheese Whey) material received to 5%or less of the
total daily volume by September 30,2024

• Section 2.0 of the Odor Control Plan indicates odor generating activities will be conducted
"when the wind speed is below 15 miles per hour(mph),when the air is saturated with
water(i.e.the difference between the ambient and dew point temperature is less than a 10-
degrees),and when the surface temperatures are warmer that atmospheric conditions to
promote vertical mixing(i.e. mid-morning to mid-afternoon). In addition,these activities will
be avoided in the late afternoon,and before weekends and holidays when neighbors are
more likely to be outside"
Based on the logs received,the WAS material is received 6 days per week Monday—
Saturday(with the exception of the last weekend of August)between 10:00 am—2:30 pm
which is in violation of the Odor Control Plan
o Limit the days and times the WAS material is received to meet the Odor Control Plan
in the Operating Agreement by September 30,2024
Due to the repetitive odor complaints received from the community,and CDH's inability resolve this
issue with Timber Creek Recycling, if these violations are not corrected by September 30,2024,or
if odor complaints continue to be submitted to CDH after this date,CDH will be referring this
matter to DEQ for further enforcement.
