Staff has reviewed this submittal and offers the following comments: APPLICANT'S REQUEST The Applicant, Brighton Development, Inc. has requested the City's consent to vacate the platted public utilities and irrigation easement located on the southerly lot line of the west half of Lot 13, Crestwood Subdivision #1. The Unified Development Code 11-5A-1, requires the City Council to be the decision making body on vacations applied for the City of Meridian. The subject utilities and irrigation easement was originally plated as part of Crestwood Subdivision #1 (recorded as an Ada County plat). Since that time this property has been re-platted as Quenzer Commons #10 (FP-06-020, approved by City Council on May 16, 2006). As part of the development of Quenzer Commons #10, the utilities and irrigation facilities have been relocated underground with the joint trench effort for that development. The joint trench effort and relocation of utilities has removed the need for the subject 20-foot wide easement that was plated with the Crestwood Subdivision #1. Idaho Power, Intermountain Gas, Qwest Communications, and Cable One have all submitted notarized consent for relinquishment of the easement. The Applicant has included said documents with their application. The Meridian Public Works and Planning Departments have no objection to the relinquishment of the subject easement. Note: It should be made clear that the subject easement was also shown on the fmal plat of Quenzer Commons #10. The easement to be vacated is the easement dedicated (created) with the Crestwood Plat. The easements dedicated on Lot 2, Block 31 and Lot 12, Block 13 on the Quenzer Commons #10 plat, which are in the same vicinity, are not being vacated with this application. LOCATION AND ZONING Quenzer Commons # 1 0 is zoned R -8 and is located south of U stick Road and west of Locust Grove Road in Section 31, Township 4 North, Range 1 East. SURROUNDING USES North - Residential, zoned RUT (Ada County) South - Residential, zoned R-8 East - Residential, zoned RUT (Ada County) West - Residential, zoned R-8 OWNER OF RECORD The owner of record of this parcel is Brighton Development Inc.
