LOT 6 AND THE WEST HALF OF LOT 7 IN BLOCK 2 OF FA NOURSE'S FIRST ADDITION TO MERIDIAN, ACCORDING TO THE PLAT THEREOF, FILED IN BOOK 2 OF PLATS PAGE 53, RECORDS OF ADA COUNTY, IDAHO. 5. 124 E Pine Street does not meet MCCII-13-5B4 parking ordinance or MCCI2-13-12-4 landscaping ordinance. 6. 124 E Pine Street does not meet MCCll-13-5B4 parking ordinance due to lack of space behind building and new parking in front of structure would destroy buildings existing landscaping and appearance that City of Meridian is striving for in Old Town. 124 E Pine Street does not meet MCCI2-13-12-4Iandscaping ordinance due to lack of space on each side of structure to allow for 25' landscaping buffer. 7. The parking ordinance needs to be reduced by 2 parking spaces to comply with ordinance. The landscaping ordinance needs to be reduced by 21' on each side of structure to comply with ordinance. 8. The lot size of 124 E Pine Street will not allow for any more space fur additional parking and lot size also does not allow for additional buffer on either side of structure for landscaping. 9. There are no other circumstances that apply to property other than stated in statement 8 above. 10. The structure on 124 E Pine Street is positioned closer to rear of lot than most other structures in area, keeping property from complying with parking ordinance. The structure on 124 E Pine Street is positioned evenly between the sides of the lot which is the norm for structures in the immediate area and keeps property from complying with the landscaping ordinance. II. There are properties in the area that bave been converted to businesses or have been built that also do not comply with parking or landscaping ordinance. 12. Same as statement Number II above. 13. Granting the variance to the parking and landscaping ordinance to 124 E Pine Street would not allow for special treatment only impartial treatment on our behalf. 14. Granting the variance to the ordinances would convenience the applicant which now owns the property by allowing the conditional use permit so that new owner would not have to re-sell current property. Owner/applicant will profit by allowing variance so that they may open their retail store as soon as possible. Profit and convenience are not sole reason for request of varian.ce but a necessity as property physically cannot be changed in order to comply with ordinances. 15. Comprehensive plan allows for retail in "Old Town".
