E;<; DEe 1 3 2006 TO: Mayor and City Council FROM: Justin Lucas, Associate City Planner SUBJECT: Final Plat Modification Application - Request to Modify the Approved Fencing for Reserve Subdivision (File No. MFP~06-005) Staff has reviewed this submittal and offers the following comments: City Of Meridian City ClerkOffice APPLICATION SUMMARY & LOCATION The applicant, David McKinnon, has applied for a final plat modification to amend the fencing requirements for the Reserve Subdivision. The modification request is to allow a six foot solid fence along the northern boundary (shared with the Meridian School District), in lieu of a six foot open vision or four foot solid fence, as required in the final plat (FP-06-019) conditions of approval (Site Specific Comment #3). Currently there is an existing six foot tall chain link fence, constructed by the School District, located approximately six feet north of the shared property boundary. The location of the School District fence, six feet north of the shared property boundary, prompted the applicant to contact the School District to discuss fencing options in this area. The applicant's main concern was the possibility of a six foot wide "no mans land" that would be created if another fence was placed by the applicant on the property line. After discussing the situation with the School District, both parties agreed that the construction of a six foot solid fence on the property line, and the removal of the existing chain link fence was the best solution. This solution reached by the property owners does not comply with the conditions of approval regarding fencing for the Reserve Subdivision. Reserve Subdivision is located at 5955 N. Locust Grove Road in T. 4N., R. IE., Section 30. The final plat for the Reserve Subdivision has not yet been recorded. OWNER OF RECORD The owner ofrecord for the subject property is Jake L. Centers of Meridian, Idaho. ST AFF ANALYSIS & RECOMMENDATION Fencing along the northern boundary of the Reserve Subdivision has been a topic of discussion ever since the preliminary plat for this project was approved. At the time of preliminary and final plat approval the applicant agreed to construct open vision fencing (or four foot solid fencing) on the northern boundary of this site as required by the Police Department. The Police Department remains consistent in their opinion and, due to safety concerns, is adamantly opposed to allowing solid fencing along the portion of the subject subdivision that shares a boundary with the school. The Police Department believes that closed vision fencing creates a safety concern in this location. The Unified Development Code (UDC) does not specifically address requirements for perimeter fencing adjacent to schools. Because the Police Department believes open vision fencing is more appropriate and because the UDC is silent on the issue, Staff recommends that the requested final plat modification be denied. For the reasons listed above, Staff recommends denial of the proposed final plat modification to amend the approved fencing for Reserve Subdivision (MFP-06-00S), as proposed by the applicant.
