Broadway Avenue, Suite 102 Meridian, Idaho 83642 1 | Page FINAL PLAT TIME EXTENSION STAFF REPORT Project Number TED-2024-0019 Project Name Alden Ridge Subdivision Project Address 6870 N. Pollard Lane and the three (3) parcels to the north and east, directly east of SH 16 and directly south of the Phyllis Canal at the northern edge of the Meridian area of City impact. Project Description Administrative time extension for 2-years on the Preliminary Plat (H-2022-0059) in order to obtain the City Engineer’s signature on the final plat. DECISION The Director approved the applicant's request for a 2-year extension until December 13, 2026, to obtain the City Engineer’s signature on the final plat. II. STAFF ANALYSIS The existing preliminary plat (H-2022-0059) approved on December 13, 2022, will expire on December 13, 2024, unless a final plat is signed by the City Engineer, or a time extension is obtained prior to the expiration date. A 2-year time extension on the final plat is requested with this application. The Applicant’s narrative indicates the extension is necessary because the Fire Department requires Brighton Corporation to complete and pave W. Waverton Lane as part of their project before this project can begin construction. Additionally, the City has required Brighton Corporation to complete the lift station to the south before this project can commence. Furthermore, Veolia requires the dedication of a water/well site to secure a water commitment for the project, which also involves obtaining a right-of-way vacation from ACHD. This submission will be made shortly. With all-time extensions, the Director may require the preliminary plat to comply with the current provisions of the UDC. Because there are no updated UDC provisions that apply to the final plat, Staff does not recommend any new conditions of approval for the subject time extension. III. CONDITIONS OF APPROVAL A. Applicant shall meet all terms of the approved annexation, preliminary plat, alternative compliance, and development agreement (H-2022-0059, DA Inst. #2023-051343), approved for this site. 2 | Page B. The applicant shall obtain the City Engineer’s signature on the final plat by December 13, 2026 in accord with UDC 11-6B-7 in order for the final plat to remain valid; or another time extension may be requested. CITY COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Division on or before December 21, 2024, within fifteen (15) days after the written decision is issued, and include the information listed in UDC 11-5A-7B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. The property owner has the right to request a regulatory taking analysis under Idaho Code 67- 8003. Such request must be in writing, and must be filed with the City Clerk not more than twenty-eight (28) days after the final decision concerning the matter at issue. A request for a regulatory takings analysis will toll the time period within which a Petition for Judicial Review may be filed.
