V AC-06-015 Vacation of the 10- foot wide public utilities, drainage, and irrigation easement between Lots 3 & 4, Block 1, of Silverleaf SuhdiviRion No_ 1 STAFF REPORT Hearing Date: December 12, 2006 SUBJECT: Mayor & City Council Sonya Watters & Michael Cole (208) 884-5533 Silverleaf Subdivision No.1 Easement Vacation TO: FROM: Staff has reviewed this submittal and offers the following comments: APPLICANT'S REQUEST The Applicant, Dyver Development, Inc., has requested the City's consent to vacate the 10-foot wide platted public utilities, drainage, and irrigation easement located on the shared property line between Lots 3 & 4, Block 1, Silverleaf Subdivision No.1. The Unified Development Code 11-5A-l, requires the City Cowlcil to be the decision making body on vacations applied for in the City ofMcridian. A single family home was constructed on Lot 3 that encroaches into the platted easement. The applicant intends to perform a property boundary line adjustment and relocate the side lot line to accommodate the required side setback for the residence. Approval of the subject easement vacation is required prior to the property boundary line adjustment being approved by the Planning Director and recorded. At that time, the Applicant will also dedicate a 10-foot wide public utilities, drainage, and irrigation easement to be centered on the new property line. Idaho Power, Intermountain Gas, Qwest Communications, Settler's Irrigation District, and Cable One have all submitted notarized consent for relinquishment of the easement. The Applicant has included said documents with their application. The Meridian Public Works Department has no objection to the relinquishment of the easemenL LOCATION AND ZONING Silverleaf Subdivision is zoned R-4 and is located south of Chinden Boulevard and west ofTen Mile Road in Section 26, Township 4 North, Range 1 West, B.M. SURROUNDING USES North - Residential, zoned RUT (Ada County) South - Residential, zoned R-4 East - Residential, zoned R-4 West - Residential, zoned R.8 OWNER OF RECORD The owner of record of Lots 3 & 4, Block 1, Silverleaf Subdivision is Dyver Development.
