", ...~ i,'c.-;. ,- -' - -J~'~ ::' '::::.'/ ,.':'- ,..,. ~~\. \ City of Meridian Planning and Zoning Commission 660 E Watertower, Suite 202 Meridian, 1083642 To members of the Commission: Re: Proposed Pammy Cakes Childcare, 672 E Baldwin, Meridian CUP 06..037 City of Meridian Unified Development Code; Master Declaration of Covenants, Conditions, Restrictions & Easements (CCR) for Bedford Place Subdivision As stated in the CCR, Section 5.1, lots shall be used only for residential purposes; Section 5.13 No lot shall be used at any time for commercial or business activity. The inception of a day care center violates the CCR sections. In addition, this business would not enhance the area due to Increased traffic and noise, illegal U-turns, and would jeopardize the safety of youngsters in the immediate ares. Rather, it will detract, which can cause, and probably will have an impact on property values as well as "opening the door" to other businesses not only in this subdivision, but others within the City of Meridian. The petitioners do not intend to occupy 672 E Baldwin as a primary or secondary residence and stated the same at the neighborhood meeting. They will continue to reside in a subdivision, zoned R..2, which does not allow for/or petitioning the P & Z Commission for this type of business. Based on the fact that there are 13 businesses of this type within a three4mile area from 672 E Baldwin, certainly does not create a need in this subdivision. Page 2 Planning and Zoning Commission November 26, 2006 At the neighborhood meeting, the petitioners stated that the hours of operation would be Monday through Friday, 7:00 a.m. through 5:15 p.m. and that the number of children attending would be 12, including grandchildren. However, according to City of Meridian Unified Development Code, Chapter 4, Section 114..3.9 it would allow hours from 6:00 a.m. to 11 :00 p.m. and increase the number of children attending, because the operators' children are excluded from the number allowed, allowing the petitioners to increase attendees without further hearings for an extension of services. As per the CCR, a Homeowners' Association was established for the purpose of providing self.govemment for the properties and to ensure the enhancement and preservation of property values. Granting of CUP 06-037, undermines the ability of the association to perform as intended and could lead to deterioration in many areas of this subdivision. I further object to having to defend my granted rights against outsiders who do not reside in this subdivision and appear to have no concern about the CCRs. Therefore, I ask you, the Commission to deny CUP.06.037, Pammy Cakes Childcare, without further consideration or appeal. Thank you. Sincerely, ~~~~ Adolph Kochevar
