Re: Kilgore Heights - Salmon Point Development
My wife and I live on the east side of Kentucky Ridge Estates. Weare very concerned
about the potential impacts of the proposed Kilgore Heights subdivision on our property
and the surrounding neighborhood.
Possibly the greatest impact on the neighborhood will come from the poorly designed
entrance to Kilgore Heights. The location of this entrance is the subject of a hearing
before ACHD on November 15 and I ask that you table consideration of Kilgore Heights
to give area residents a chance to react to the results of the ACHD hearing. It is
unreasonable to have the ACHD hearing on Wednesday followed by a combined
Annexation and P&Z hearing on Thursday. This schedule is not in the best interest of the
community.
Hopefully, the ACHD hearing will result in an access road location for Kilgore Heights
that is fully compatible with future growth and the surrounding community.
Kilgore Heights has requested an R-8 zoning although they have applied for a density of
less than 3 residents per acre. Planning staff is recommending that Phase 1 be revised to
R-4 so that tracts are not subdivided in the future. Since lots of only 5000 sqft are
allowed in an R-8, all lots over 10,000 sqft could be allowed to subdivide. Phase 2
includes a number oflots that exceed 10,000 sqft and should also be zoned R-4. As an
alternate, a zoning ofR-6 may be acceptable to area residents and will prevent future
property divisions.
Our house is on the eastern side of Kentucky Ridge and is considered a view lot. We
understand that in the original construction of Kentucky Way houses on the east side of
Arcaro Avenue were limited to a single story with walkout basements. This was done to
preserve the view from the second story of houses on the west side of the street. We paid
a premium for our view and have paid taxes on our property accordingly. Although
Kilgore Heights has offered to restrict building heights for their lots in Phase 1 they have
not made a similar restriction for lots on the west side of phase 2. I request that, either a
restriction, binding by covenant, restricting houses to a single story or to no more than
28' above curb line (only 7 feet less than standard) be enacted for houses on the west side
of Ballybunion Avenue (Block 4).
The plans submitted by Salmon Point Development are incomplete and should not be
approved until the disposition of the sewage ponds is determined. In the applicants
narrative they clearly state that none of phase 2 can be constructed unless the sewage
ponds are removed. It would be very short sighted for the commission to approve these
plans without first giving consideration to the ultimate uses of the site.
