HomeMy WebLinkAbout04-422 Anti-Displacement RESOLUTION NO. 04- 1-;22- te,flv/J;f-~ BY: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MERIDIAN, SETTING FORTH CERTAIN FINDINGS AND PURPOSES; PROVIDING FOR THE ADOPTION OF A RESIDENTIAL ANTI-DISPLACEIVlENT AND RELOCATION ASSISTANCE PLAN (UNDER SECTION I04(d) OF THE I-lOUSING AND COMMUNITY DEVELOPMENT ACT OF 1974, AS AMENDED) FOR THE CITY OF MERIDIAN. WHEREAS, the Mayor and Council have the authority [pursuant to LC. S 50-302] to establish resolutions not inconsistent '.vith the laws of the state of Idaho as may be expedient, in ~lcldition to the special powers therein granted, to maintain the peace, good government and wel!~lre of the corporation and its trade, commerce and industry; and WHEREAS, the Mayor and Council have deemed it expedient and in the best interests of the City 01' Meridian to adopt a policy regarding residential anti-displacement and relocation assistance. BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF MERIDIAN, IDAHO: I. The City of Meridian will replace all occupied and vacant occupiable 100v-aml- moderate incollle dwel I ing un i ts demol i shed or converted to a use other than as low/moderate income housing in connection with an activity assisted with funds provided under the I-rousing and Community Development Act of 1974, as amended, as described in 24 CRF 570.606(b) through (g). 2. All replacement housing will be provided within three (3) years after the COlllmcncemcnt 0 f the demol i tion or conversion. Before entering into a contract comm i tti ng The Ci ty 0 f Meri eli an to prov ide funds for an acti vity that wi II di rectly result j n demo Ii tion or conversion, the City will make public by publication in a newspaper of general circulation and submit to the Idaho Department of Commerce the following information in writing: 1, A description orthe proposed assisted activity. 2. The location on a map and number ole dwelling units by size (number ol'bedrooms) that will be demolished or converted to a use other than as lo\v/modcrate incomc dwellings units as a direct result of the assisted activities. The location on a map and the number of dwelling units by size (number of bedrooms) that will be provided as replacement dwelling units. Consistent with the goals and objectives of activities assisted uncleI' the Act, the City will take the following steps to minimize the displacement of persons from their homes. I. Coordinate code enforcement with rehabilitation and housing assistance programs. 2. Evaluate housing coeles and rehabilitation standards in reinvestment areas to prevent placing undue financial burden on long-established owners or tenants of multi. family bu i lei i ngs. 3. Stage rehabilitation of apartment units to allow tenants to remain during and after rehabilitation by working 011 empty units or buildings first. 4. Adopt public policies to identify and mitigate displacement resulting from intensive public investment in neighborhoods. 6. Adopt policies that provide reasonable protection for tenants faced with conversion to a condominium or cooperative. 7. To the extent permitted by law, adopt tax assessment policies (such as deferred tax payment plans) to reduce impact of rapidly increasing assessments on lower income owner-ocCLllxlnts or tenants in revitalizing areas. 8. Establish counseling centers to provide homeowners and renters with information 011 the assistance availablc to help them remain in their neighborhood in the l~lce of revitalization pressures. 6. By passage of this Resolution, the City 01' Meridian hereby cenilies it has olTicially adopted and hereby publishes saicl Residential Anti-Displaccmcnt and RelOC~llion Assistance Plan. The City of Meridian shall include one or more of the above to implement the planning lor minimizing the direct and indirect displacement of persons from their homes as a result oran assisted activity. NOW, THEREFORE, BE IT RESOLVED BY THE MA VOR AND CITY COUNCIL as follows: ]. EFFECTIVE DATE.
