Dear Planners, The Treasure Valley Athletic Center(TVAC) property (R5652600400) and business owner(Collin Hartman of The Hartman Group, LLC) is in the process of purchasing a portion of the property (R5652600300) to the north of TVAC (1250 E Piper Ct, Dutchman Motorsports, owned by Todd &Tracey Ebeling of TNT Holdings, LLC). The intent of the purchase is to expand TVAC with a new 14,700 SF Indoor Beach Volleyball and Weight Training Facility. This would be in addition to the existing 23,000 SF Indoor Volleyball & Basketball Facility. A purchase agreement and a Property Boundary Adjustment (PBA) are in the works to move the shared property line 75' north to transfer approximately 16,226 SF of property from TNT Holdings, LLC to The Hartman Group, LLC. This PBA and proposed TVAC expansion requires modification to the existing Development Agreement and Conditional Use Permit. MDA: Modification requested to the Medimont Subdivision Development Agreement, dated 27 August 1997, recorded in Ada County on 4 September 1997, is for a Light Industrial subdivision. Instrument#37072405. 1. Delete Exhibit B, article e. in its entirety: " , eneFeachngent of this strop." a. The reason behind this is that the properties to the west that were originally zoned R-40 and vacant at the time of filing are now occupied and zoned I-L (Light Industrial) and C-G (General Commercial). Providing a 20' landscape easement adjacent to residential on the west side is no longer applicable. 2. Add to Exhibit B, article p.: "Special Setback Requirements. As represented at public hearings, minimum side yard building setbacks shall be five (5) feet per story from the property line. The minimum rear yard setback shall be twenty (20) feet from the property line. Lots 3 and 4, Block 1, shall have a minimum rear yard setback of ten (10)feet. Lots 3 through 10, Block 2, shall have a minimum rear yard setback of forty (40) feet.
