Vacation of a public utilities, drainage, and irrigation easement between Lots 26
& 27, Block 1, Lochsa Falls Subdivision NO.6
Staff has reviewed this submittal and offers the following comments:
APPLICANT'S REQUEST
The Applicant, Wayne Barber, Briggs Engineering, has requested the City's consent to vacate the platted
public utilities, drainage, and irrigation easement located on the property line between Lots 26 & 27, Block
1, Lochsa Falls Subdivision No.6. The Unified Development Code 11-5A-l, requires the City Council to
be the decision making body on vacations applied for in the City of Meridian.
A single family home was constructed on Lot 27 that encroaches into the subject platted easement, as well
as the required building setback for the residence.
Approval of an easement vacation is typically required prior to the lot line adjustment being approved by
the City Engineer and recorded. However, the property owners have already performed a boundary line
adjustment and filed a record of survey to relocate the side lot line to accommodate the side setback.
Dedication of a new, 10-foot wide public utilities, drainage, and irrigation easement, centered on the new
property line has also been completed.
Idaho Power, Intermountain Gas, Qwest Communications, and Cable One have all submitted notarized
consent for relinquishment of the easement. The Applicant has included said documents with their
application. The Meridian Public Works Department and the Nampa I Meridian Irrigation District have no
objection to the relinquishment ofthe easement.

Lochsa Falls Subdivision NO.6 is zoned R-4 and is located west of Linder Road in the SE~ of the NE~ of
Section 26, Township 4 North, Range 1 West, B.M.

West - Residential, zoned Rw4
OWNER OF RECORD
The owners of record of Lot 27, Block 1, Lochsa Falls Subdivision NO.6 are Joshua and Jacque Bingham.
The owner of record of Lot 26, Block 1, Lochsa Falls Subdivision NO.6 is Melissa Dennis.
