McMillan Road owned by Daniel G. Gibson, Jr. (The approved Preliminary Plat and Conditional Use Pennit fOT Lochsa Falls consists of a Planned Development for 856 Single Family Dwellings, 171 Multiple Family Dwellings, Eleven (ll) Office Buildings, One (1) Commercial Building, One (1) City Park, One (1) Private Park. and One (1) Future Fire Station Lot on 354.28 A.creli in an R-4 Zone.) The 5ubject phase of the development includes Lots 22-30 Block 48 and is 22.52 acres. This phase was approved for one multi- family lot and five (5) offioe lots. We have reviewed this submittal and offer the following comments: APPLICATION SUMMARY The applicant, Daniel Gibson, Jr., has requested approval of an 18-month time extension to record the final plat and to commence the conditional use pennit for this phase of Lochsa Falls Subdivision. The approved Preliminary Plat and Conditional Use Penn it Qonsis1:$ of a. Planned Development for 856 Single Family Dwellings, 171 Multiple Family Dwellings, Eleven (11) Office Buildings, One (1) Commercial Building, One (1) City Park, One (1) Private Park, and One (1) Future Fire Station Lot. on 354.28 Acres in an R4 Zone. The subject phase of the development includes preliminary plat Lots 22.30 Block 48 and is 22.52 acres in size. It was approved for one multi-family lot and five (5) office lots. The preliminaJ)' plat (PP-02-009) and oonditional use pennit (CUP-02-012) for Lochsa Falls Subdivision were approved by the Meridian City CounlOil on December 17, 2002. Per UDC~ 11-6B-7B Phased development states: In the event that the development of the preliminary plat is made in successive phases in an orderly and reasonable manner, and confonns substantially to the approved preliminary plat, such segments, if submitted within successive intervals of eighteen (18) months, may be considered for finw approval without resubmission for preliminary plat approval. The most recent phase of Lochsa Falls, Fulfer Subdivision No.6 and No.7, received final plat (FP-OS-035 and FP-05~036) approval on June 28, 2005. The deadline for the next .final plat submission within Lochsa Falls is December 28,2006. The appHcllnt iWlte5 the reason for the delay is because the current market has an oversupply of multifamily development units and office lots. Therefore, they are unable to meet the time requirements specified in Unified Development Code (UDC) 1]-6B- 7 and 11-5B-6. The City of Meridian's Unified Development Code (UDC 11 ~6B-7C) allows the Director to authorize a single extension of time to record a fmal plat, not to exceed 18 months, when the applicant files a wrinen request for an extension prior to the expiration of the plat, which the applicant has done. As mentioned above, the applicant is requesting an IS-month time extension. Additional time extensions up to 18 months as detennined and approved by the City Council may be granted. With all extensions, the City may require compliance with the current provisions of the UDC as a condition for granting a time extension (UDC 11-6B- 7C and ll-SB-6F4), Staff believes that there are no TE-06-024 Lochsa.
