Project: Paramount Subdivision No.7 Location: Paramount Subdivision Applications: Variance and vacation Highlights of Proposed Development: The applicant is requesting approval to vacate 2 feet of the 5 foot drainage and irrigation easement that was platted with Paramount Subdivision No.7. The subject drainage and irrigation easements are located along the east boundary of Lot 16, Block 12, Paramount Subdivision No.7. A variance is also being requested from UDC 11-2A-6, which requires a 4-foot wide interior side setback in the R-8 zone, to allow for a 3-foot wide setback along the east boundary of the subject site. An architectural pop out also intrudes into the setback as allowed by code. The variance is not required for the pop out portion. Other: A house has already been built on this lot and encroaches within the side setback and drainage & irrigation easement. Elevations: Yes-Photos of fence and pop out structure Staff Recommendation: denial, staff was unable to make the findings for approval for the variance. If Council chooses to approve the variance, Public Works has provided conditions of approval to consider in approving the vacation application as well. Written Testimony: We have received written testimony and photos from the affected neighbors. Outstanding Issue(s) for City Council: the applicant has been working with the adjoining property owners to adjust the property line to eliminate the need for the variance. Staff is unsure on the current status of those negotiations. Notes:
