Project: Blue Marlin Location: northwest comer of Eagle and Ustick Applications: DAmodification HigWights of Proposed Development: The applicant is proposing to modify the DA to not require conditional use approval of each lot within the subdivision. Instead they are proposing to add a concept plan to the DA and to place some use restrictions on the properties. Staff is supportive of the request; we find generally unproductive to require conditional use approval for uses that are otherwise principally permitted in the district. I'll let the applicant go through the proposed concept plan and modifications in his presentation. Other: It is important that the Council understand some background to this application that is not in the staff report. When the City entered into the DA, the applicant did not have a defmitive concept of how the property would develop. They now are able to provide that concept. Also, when the City entered into the DA, the Council was decision making body on conditional use applications. That authority has shifted to the Planning and Zoning Commission. Staff has been concerned that the Commission's decisions with regard to this property may not be consistent with the City Council. More specifically, I have heard general comments that the Council does not desire another mall similar to Crossroads-acknowledging that Cross Roads is an asset to the community but that Meridian needs a variety of shopping venues. The concept plan before you tonight is very similar to Crossroads-albeit with much better pedestrian connections across the site. I felt the need to get this concept before Council for your approval. There were two avenues available; the applicant could submit this DA modification, or I could appeal the Planning and Zoning Commission's decisions to the Council for your review. The applicant chose to submit the DA modification. This approach was supported by staff in that it also removes the unnecessary and timely CD approval process. Elevations: Yes--ofthe proposed seating areas. Staff Recommendation: approval Written Testimony: We do have a response from the applicant to our staff report. I have not had time to return the applicant's call regarding the proposed changes to the DA. We support some of the changes, but are opposed to others. Outstanding Issue(s) for City Council: i.
