Dear Ms. Vigil:
Thank you fOr reviewing our application for final plat of Cahella Creek Subdivision. The
following letter is in response to your staff report dated for the regillarschcduled public
hearing on October 17,2006.
Site Specific Conditions
1. All terms outlined in the recorded Development Agreement (instrument No.
1061410570) will be inet. ItemS.t.7 specifies the construction of a inini.n1um 10'
wide multi use pathway on the south side of tbeTen Mile Creek Drain. 'TIle
pathway wiU be consttuctedon the nOlth side of the Ten Mile Creek Drain from.
S. Bailey Way to S. Mesa Way and on the south side of the canal from S. Bailey
Way to Victory road based on the o1'ientation of the Ten Mile Creek through the
site.
2. TIle press\.1r~ irrigation system will be owned and maintained by the Nampa
Meridian Irrigation District and not the Cabella Creek Homeowners Association.
Approval and verification of such will be coordinated with the Nampa Ivleridian
Irrigation District and Meridian Public Works.
3. Assessments for irrigation of common areas will be paid by the developer prior
to signature of the final plat as a single-point connection to the potable. water
system will be needed as the irrigation water rights associated with Nampa
Meridian Irrigation District for the Ten f\1ile Creek Drain are not year round.
4. All fencingwillbeconstmcted to UDe requirements.
5. The street buffet will be constructed prior to request for occupancy for dwellings
within the proposed development.
6. The existing houses will connect to central services and pay all needed
assessments.
7; The improvement drawings & ESC/SWPPP have identified that the preferred
construction entrance is to be off of Victory Road and not Mesa Way.

8. Only one public access is proposed onto Victory Road for this development and
all existing driveways will be dosed as specified.
9; An off-peak sanitary sewcrlift station is. proposed with this development and will
be coordinated with the City of MeridiRn Public Works as requested.
10. Extensions of main line sewer and water will be coo:rdinated with Mel'idian
Public Works th:rough the plan review process.
11. Sewer m~ins will be consll-octed as approved with Meridian Public works within
E. Loggers Pass and E. Glacier Bay Way.
12. A 12" water main will be constructed from E. VictOlY Road through the
development to the northwesterly most point of O\lr frontage along $, Mesa Way
as approved by Meridian Public Works. . .
13. A "Cumulative Rise Test" will be completed to ensure that the 100-year flood
will pass through the bridge improvement with no cumulative effect ul:>-strcatrt.
14. A note has been added to the fitiaI plat referencing the flop plaiil map and those
lots that will need to me and elevation certificate. At the time the final plat is
submitted for signature, a second copy will reveal the flood plain oveday.
15. "City of Meridian" has been added to the situate as requested.
16. The Rest1ictive Covenants shown on the face of the plat has been removedas
the Hnal plat will be recorded pnot to the Covenants, Conditions and
Restrictions (CC&R's) being recorded such that the CC&R's can Inake refe.re~!:e
to dlC recoded plat of Cabella Creek Subdivision.
17. Existing bearings of record that differ frOin the actual field sutvey depicted on
the plat will be noted in parendlcsis,
18. A letter ftom the Binford's will be submitted indicating that efforts to reduce the
potcntiallights ftom cars have beel1 completed prior to requesting signatlire for
fInal plat
19, Pec:icstrian sidewalk easement will be dedicated for all sidewalks and pathways
that fall outside of ACHD right-of~\vay,
20. Existing domestic septic systems will be. removed per Meridian City Ordinance
and Idaho Central Dismct HaIth requirements. Existing domestic wells will be
removed per Meddian City OrwIial1ce and Idaho Department of Water
Reso.urces standards_
21. The plat notes have been revised as specified.
22. A revised landscape plan will be resubmitted pnor to requesting final plat
signature with the subject revisions completed. Also, the eight subject evergreen

23. The 13% open space calculation that \vas approved during the time of the
preliminary plat excluded areas with storm drain detention, wet ponds and the
Ten Mile Creek Dram. TIle percentage of open space is now 13% or greater
with the imptcivements drawings cOlnplete and will remain. at or above 13% once
constntcted.
24. This statement is agreed to.
