Dear Planning Staff,
The owner of the property located at 4160 E. Lanark St. is proposing the new construction of an
approximately 19,904 sf industrial flex building in the first phase of the subdivision. The annex,zoning,
and preliminary plat(H-2021-0103)were approved on 06/21/2022. The preliminary plat was recently/DR
extended (TED-2024-0009). The final plat is currently in review(FP-2024-0015).The project has received
the following CZC/DR approvals:A-2023-0057 and A-2024-0074.
ACHD approved the Lanark extension construction drawings on 06/18/2024. The Lanark
extension is scheduled to be completed in mid-August. Please see the attached ACHD right of way
dedication.
The purpose of this request is to modify the language to allow for more flexibility in how the final
subdivision will layout. Please see attached phasing plan.
The applicant asks that the following modification be made to the original Development
Agreement, Instrument#2022-066859, recorded on July 27, 2022 (proposed changes in bold):

5. CONDITIONS GOVERNING DEVELOPMENT OF SUBJECT PROPERTY.
5.1. Owner/Developer"shall develop the "Property"in accordance with the following special conditions:
b.Prior to certificate of occupancy,the applicant shall subdivide the property in accord with UDC 11-6B.
