MERIDIAN PLANNING AND ZONING COMMISSION OCTOBER
17, 1994
The Special meeting of the Meridian Planning and Zoning Commission was called to
order by Chairman Jim Johnson at 5:30 P.M.:
MEMBERS PRESENT: Tim Hepper, Charlie Rountree:
MEMBERS ABSENT: Jim Shearer, Moe Alidjani:
OTHERS PRESENT: Will Berg, Wayne Crookston, Gary Smith, Shari Stiles:
ITEM #1: AMENDED FINDINGS OF FACT AND CONCLUSIONS OF LAW FOR A
CONDITIONAL USE PERMIT REQUEST BY D & B SUPPLY BY NEB-i COMPANY:
Johnson: You have all had an opportunity to read the findings of fact and conclusions
of law prepared by our City Attorney. I have a couple of typos that I will start with.
Page 4, a couple spelling errors, 6th or 7th line down after Tim Hepper "he staed", "he
stated" is what I think that should be. And then the next paragraph down, "propane
forklifts" I think it is supposed to be instead of "proposed forklifts". On Page 8 there is
another typo, it probably should be plural, "requirements", number 15 on page 8.
Other than that I didn't see any other typos. Did anybody else come up with
something?
Rountree: On page 12 there is a reference to design review (inaudible) I think in the
context it works (inaudible).
Crookston: It states in the this ordinance.
Johnson: That is why it is in quotes. It is verbatim from the ordinance that is why it is
in quotes. Okay, anything else? Do you have anything Tim?
Hepper: No
Johnson: Entertain a motion then.
Rountree: Mr. Chairman, I move the Meridian Planning and Zoning Commission
hereby adopts the findings of fact and conclusions.
Hepper: Second
Johnson: We have a motion and a second to approve the findings of fact and
conclusions of law as prepared by the City Attorney, this is a roll call vote.
ROLL CALL VOTE: Hepper - Yea, Rountree - Yea, Shearer - Absent, Alidjani - Yea
Johnson - Yea (tie breaker)
MOTION CARRIED: All Yea
Johnson: Is there any decision or recommendation we should pass onto the City
Council?
Rountree: Mr. Chairman, I move the Meridian Planning and Zoning Commission
hereby recommends to the City Council of the City of Meridian that they approve the
conditional use permit requested by the applicant for the property described in the
application with the conditions set forth in the findings of fact and conclusions of law.
That no conditional use permit should be granted until the property is annexed and
zone and a development agreement is entered into and all city requirements have been
met.
Hepper: Second
Johnson: Moved and seconded to pass the stated decision and recommendation onto
the City Council, all those in favor? Opposed?
MOTION CARRIED: All Yea
Johnson: These findings of fact are now official so we can make a copy available to
the applicant. So we can get those to you right away. Is there anything else that
anybody has?
Hepper: I move we adjourn.
Rountree: Second
Johnson: Moved and seconded we adjourn, all those in favor? Opposed?
MOTION CARRIED: All Yea
