We are asking for a temporary access onto Eagle Road until River Valley Road is ready to
be installed by all neighboring properties. Both the Commercial and Residential sites will
access via this temporary roact Later we anticipate direct access to River Valley for the
Residential site and a shared access to the commercial site as shown in the site plans. We
are currently in negotiations with the neighboring properties for this access as well as
River Valley road.

previous voice maiJ left for you regarding the submittal for Regency at River Valley. Before I can deem
the application for Regency completeJ I need the followjng:
1) U DC 11-3B-BC2a req ui res internal la ndscape planters in parking lots to contai n a m in im urn of
50 sq uare feet~ with th e planting area not being less th an 5 feet in any dimension, measured
inside cu rbs. The su bm itted site plan and Ian dsca pe pia n depict su bstandard (abo ut 3- feet
wide) landscape planters in the parking areas~ Further, UDC 11-3B-8C2d requires each
j nterior planter that selVes a sing [e row of parking s paces to be randsca pe with at least 1 tree
and covered with shrubst lawn, or other groundcoveL
2) UDC 11-6C-3Bd states: uAII new streets shall be named as foHows: Streets having
predominantly north-south direction shall be named uAvenueu or HRoadu; streets having a
predominantly east-west direction shall be named UStreee or UWayn; meandering streets shan

UCourt/' and uPlaceH. The submitted site pran incorrectly labels most of the public streets and
proposed private streets.
3) I am a little confused on what fs happening in the round about area near the crubhouse (south
side of the plan). This is a pretty wide paved area. Is there going to be parking wjthin this area;
is there a drop-off area; how is it going to function? Please show striping and/or signage will be
provided in th is area.
The changes listed above should be reflected on a revised site plan and landscape plan. Once the

Commercial sites entitled for the proposed uses. We have built several projects similar to the one we

Bach Investments is p[eased to be working with the Regency at River Valley, LLC on the proposed
Apartment Commun[ty in Meridian city. We are excited for the opportunity this presents for us to work
with Merid ian City a nd together create a project that is a great ad dition to the growing city & Not
d issi m ilar to other projects there are a few variances necessary to create a site that is the greatest
add ition to Mend fans 9 rowi ng commu n ities.
For the Regency at River Valley we propose the following 3 variances:
1. Covered Parking:
We propose 1 covered parking unit per apartment unit. We have built and managed over 10
projects in the Western United States and have found that 1 covered park per apartment unit is
sufficient.
a) We don't feel this wouJd grant us any special privilege. Typicarly on apartment
communities with 4..20 units the parking prescribed is necessary. When projects are much
Jarger they necessitate a lesser parking requ irement.
b) The South Slough has an easement which encroaches onto our property which
prohibits placing structures within said easement. Through research we have determined this
easement cannot be removed and is necessary due to annual slough maintenance. Although
structu res are proh ibited open parking stalls wi II be provided in th is area.
c) Public Health I Safety r and Welfare wil r not be affected by granting this variance.
2. Temporary Access to Eagle Road:
We propose direct access be grated temporarily on to Eagle Road to be used by both our
commercial and residential sites. This access is to remai n available until River Valley Road is
constructed and our properties have access.
a) There are several properties along Eagle Road which enjoy direct access~ We are
asking that th is same privilege be exten ded unti I River Valley Road is constructed.
b) Because there are several properties that need to participate in the cost of
construction of River Valley Road we are unable to construct access at this time. We currently
are trying to negotiate with neigh boring property owners for th is con struction~ Currently we
can not wait indefinitely for all parties are ready to particj pate. This wou Id be the on Iy access to
the site for the time being.
c) Considering the other accesses businesses have onto Eagle Road we don't anticipate
the variance would be detrimental to Public Health, Safety, orWelfare.

3. The Meridian City Unified DeveJopment Code states ua minimum of eighty square feet of
private1 usable open space shall be provided for each unitU As stated previously we have built
several project of this size and have found that this usable space ends up being a site for
storage and creates a less aesthetic and beautiful site. We provide a pool area with a
barbeque grill area and tables and chairs for tenants who wish to cook on a barbeque. (typical
use for such usable spaces described in the Unified Development Code) This helps keep the
site aesthetically beautifu I and red uces the fire hazard. We propose this requi rement be
waived~
a) Th [5 variance wi II not 9 rant a ny special right or privilege. We are aware of other m u Iti-
family projects in Meridian where there are bolt-on deck areas with ress square footage than
required within the Unified Development Code.
b) We attempt to keep our sites aesthetically pleasing and because our site faces the
future River VaHey Road we are concerned about the overall appearance of our structures for
the benefit of the area. If we do not provide an area that wilr be used as storage on patios or
decks they will not be an eyesore for passersby and neighbors.
c) 0 ur projects featu re a clu bho use with an exercise room and bill iards table. In
add ition l we provide a pool area with a barbeque and gazebo areas for tenants. This is
generally open to aU tenants but can be reserved on a private basis for resident use. (An
additional use that is typical for such spaces described j n the Un itied Development Code) This
helps keep the fire hazard under control inasmuch as the barbeque we provide is fully fire
rated and constructed within manufacturers recommendations and tenants are not as mindful
of those concerns.

(ix) except as contemplated by -the Bank Indebtedness; not "guarantee or
become obligated for the debts of any other entity or hold out its credit as being available to
8 atisfy the obligations of others;
(x) ~not acquire the obligations or securities of its Member;
(xi) allocate any overhead for office space shared with the Member o~ any
other person on a fair and reasonable basis, consistent with industry or "common practice"
standards;
(xii) use separate stationety, invoices and checks;
(xiii) except as permitted by the Bank Indebtedness, not pledge its assets for the
benefit of any other entity or make any loans or advances to any entity;
(xiv) hold itself out as a separate entity;
(xv) correct any knovm. misunderstandings regarding its separate identity; and
(J....'V.i) maintain adequate capital in light of its contemplated business operations.
ARTICLE X
DISSOLUTION, AMEND:MENr, MERGER AND BANKRUPTCY ISSUES
The Company shall not dissolve or temllnate (i) while any ,rated securities issued in
connection with the Bank Indebtedness remain outstanding (unless the Oompany has discharged
all of its obligations under the Bank Indebtedness), (ii) while the Company has any Ifm1A1nl1"lf;
obligations under the Bank Indebtedness) unless the Manager has filed fur protection under the
banhUptcy laws ofilia United States or a third party has involuntar.ily placed the Manager under
the protection of the bankruptcy laws of the United States and such involuntary petifun is not
. dismissed within 60 days of its filing, or (ill) upon the death, bankruptcy, insolvency, dissolution,

liquidation, terminatio~ resignation, removal) or incapacity of a Member while the Company has
any obligations under the Bank: Indebtedness.
These Mtic1es of Organization may not be amended except by a written instnunent
