Development Agreement Modification
Written Narrative
L &G Murgoitio, LLC, is seeking the approval of the City of Meridian for a modification of the
recorded development agreement associated with the operation of Timber Creek Recycling at
7695 S. Locust Grove Road. The property was part of the Victory South annexation in 2014
(AZ-13-014). The applicant maintained the agricultural and other related uses.
A development agreement dated January 26, 2016, was entered into (Instrument No. 2016-
007075, records of Ada County, Idaho) for operation of the Timber Creek Recycling facility
located at the northwest corner of E. Columbia Road and S. Locust Grove Road in Meridian,
Idaho. A modification to the development agreement, dated June 11,2019, was recorded as
Instrument No. 2019-053058, records of Ada County, Idaho. This second development
agreement modification request is to further clarify the current and future permitted uses and
timelines, create guidelines to allow for the efficient continued use of the property, and ensure
the operation is meeting all State and Federal guidelines.
Since the beginning operation of the facility, the owner of the Timber Creek Recycling facility
has become an important partner in the reduction of waste materials going into the Ada County
Landfill. With the forecast that the solid waste facility will be filled by 2050, it is increasingly
important that facilities such as these are available to divert materials from the landfill to create
useful products.
A copy of the modified development agreement is attached for review. A summary of the
modifications to the 2019 MDA is as follows:
Section 4.8 —The operational timeline of the facility is addressed in Section 5 and 6.
Section 5.1 —The list of recycled materials is modified and replaced with language
prohibiting any materials not allowed by the Idaho Department of Environmental Quality
and Central District Health. The clear prohibition of biosolids has been added.
Section 5.22—The storage of materials on the property prior to processing will be
allowed and the storage may take place on the balance of the property.
Section 5.2.4—The composting is addressed in Section 6.3. Other recycling activities
relating to the operation of the Timber Creek recycling may be allowed in accordance
with applicable laws and regulations of governing agencies.
Section 6.6.3 —We request the elimination of the 56-truck load limit per day. It has been
difficult to keep an accounting of the number of vehicles. Monitoring the number of
trucks everyday has placed a large burden on operation of the facility.

Section 6.8.2- Development of Adjacent Property portion of the agreement has been
removed and replaced with Section 6.14 Termination of Composting. The new language
includes a 5-year timeline for the composting operation. The change is necessary to meet
the requirements of IDEQ,providing for a hard deadline.
Section 6.13 —Allows for equipment to be stored on the property,but operation of the
recycling equipment can only take place within the designated recycling area as defined
on the original site plan.
Section 6.15 - Termination of Recycling Activities has been added to the revised MDA.
Section 6.16—Tolling of Deadlines has been incorporated into the revised MDA.
Meetings have been held with the planning and legal staff in the preparation of the second
modification of the development agreement. The applicant has also been working with the
neighbors to address concerns and complaints about the operation of the recycling facility.
We respectfully request the Council consider these changes to the agreement to allow for the
continued use of this essential composting and recycling facility that is beneficial to the entire
community.
