Location: south side of Fairview Avenue across from N. Jericho Road, approximately 1,300 feet west of
Locust Grove Road.
Touchstone Place Subdivision (continued from 8-22-06 agenda)
Applications: annexation and zoning, preliminary plat, and conditional use pennit for a multi-family
development.
Gross Residential Density: 10.83
Highlights of Proposed Development: The applicant is requesting annexation and zoning of 4.43 acres to
R-15, Preliminary Plat approval of two multi-family building lots with two common lots and Conditional
Use approval ofa 48 multi-family dwellings contained in six eight-plexes. Approximately 10.8% (0.4
acres) of the site is being set aside for open space.
Other: The DA shall incorporate the following:
. That the following shall be the only allowed uses on this property:
multifamily development and allowed accessory uses of the R-15 zone.
. That a maximum of 48 units will be constructed on this site.
. That a street buffer be installed along Fairview Avenue prior to
occupancy of any new dwelling units.
. That cross access to/from the proposed North Jericho Way be provided
to the parcel to the west, for future development along Fairview Avenue.
Elevations: Yes
Commission Recommendation: approval at their July 20,2006 hearing.
Key Commission Changes to Staff Recommendation: required six foot high solid fencing along perimeter
property lines.
Outstanding Issue(s) for City Council:
. Property boundary dispute - The applicant is proposing to not include any of the disputed
area within the boundaries of this development (see letter from Meuleman - Mollerup,
attorneys for the applicant, dated September 21, 2006). The applicant intends to officially
convey the disputed property to the property owner to the west (Howell property), if this
development is approved. Staff is concerned that a spite strip/enclave may exist in this part of
the city ifthe disputed property is riot conveyed (or accepted for conveyance) by the adjacent
property owner.
Notes: If the Council chooses to approve this {Jroiect. staff requests that the Council delete the fire
department's comment regarding the need for athird access point into this site (Condition 3.17 in Exhibit
B) and clarify in Condition 3.16 that the westerly driveway will need to be widened to 26' from 25' due
to building height. .
