Highlights of Proposed Development: applicant seeks to remove the requirement for detailed conditional
use permit approval for development north ofTen Mile Creek. To support that request they are presenting
a concept of how that area will develop (gazebo, rose garden, and caretaker unit.)
Other: The Development Agreement approved as part of the annexation for this project required the
applicant to obtain detailed conditional use pennit/planned development approval for all future buildings
constructed on the site. Since the annexation of this property, the City development ordinance has
changed and no longer requires a conditional use permit/planned development for the construction of
more than one building on a lot. Because elevations ofthe church, school, and administrative office
building proposed south of the Ten Mile Creek were not submitted with the conceptual site plan, and
because Council specifically wanted to require that the applicant submit for conditional use permit
approval for these buildings at the time of development, a detailed conditional use permit will still be
required for development south of the Ten Mile Creek.
Elevations: No
Staff Recommendation: approve.
Outstanding Issue(s) for City Council: Number of access points to Ten Mile Road. There are 3 access
points proposed to this property, north of the Ten Mile Creek. The northern access is for a future City
well site, the middle access is for the church park area, and the third access is for the church bus parking
and maintenance area. If the City wants to reduce the access points, ACHD would prefer the City well lot
take access from the church parking lot. If the City needs a driveway of their own ACHD would prefer
that it not connect to the church parking lot. The southern driveway to serve the bus storage area is
proposed to be gated and not connect to the parking area. If that is the case ACHD would not object to
this driveway being constructed with the condition that it be gated and the gate located 50-feet behind the
future curb of Ten Mile Road. NOTE: ACHD has not officially approved any access to this property, as
they have not reviewed a development application for this site, only an annexation application. As part of
the DA, the City restricted access to this site, as shown on the concept plan (3 access points to Ten Mile
in this area). If the Council wants to further restrict the number of access points, the DA should be
modified accordingly.
Notes: If Council decides to approve this request. the motion should direct the Legal DelJartment to draft
an amendment to the Development Agreement as stated in the staff report and/or modified by Council.
