Mike, how about this language: “Depict a 10-foot wide multi-use pathway along the south side of the Ten Mile Creek
within the easement for such with landscaping on either side of the pathway per the standards in UDC 11-3B-12C as set
forth in development agreement provision #5.1.34. Pathway construction may be deferred from the final plat
improvements but shall be completed prior to issuance of a certificate of occupancy for structures on adjoining Lots 22–
24, Block 3.”

We concur with the recommended site-specific conditions for the TM Creek No. 7 final plat, but request a
clarifying addition to Condition 5.a:
5. The landscape plan prepared by KM Engineering, dated 4/18/24 included in Exhibit C, shall be revised as follows:
a. Depict a 10-foot wide multi-use pathway along the south side of the Ten Mile Creek within the easement for such.
Pathway construction shall be completed prior to issuance of a certificate of occupancy for structures on adjoining Lots
22–24, Block 3.
PURPOSE
The two-page attachment shows how closely integrated the Tenmile Creek pathway grade and alignment is with the
adjoining site improvements.
- Page 1 depicts the TM Creek No. 7 vicinity, and the pathway improvements completed in prior phases.
- Page 2 is a closeup of the pathway adjacent to the (TM Creek No. 5) Phase Two apartments.
Pathway construction prior to development of the adjoining lots will certainly result in costly reconstruction and/or
repairs.
Thus, we respectfully request staff concurrence with the modification of Condition 5.a—and approval on the City

Council’s July 9 consent agenda.

Attached is the staff report for the final plat for TM Creek No. 7. This item is scheduled to be on the consent agenda at

the City Council work session on July 9. The meeting will be held at City Hall, 33 E. Broadway Avenue, beginning at 4:30
pm. Please call or e-mail with any questions.
If you are not in agreement with the provisions in the staff report, please submit a written response to the staff report to
the City Clerk’s office (comment@meridiancity.org) and me as soon as possible and the item will be placed on the
regular meeting agenda at a subsequent meeting for discussion.
