Dear Ms. Canning:
On behalf of Franklin Centre, LLC, developers of the proposed Harks Canyon Creek
mixed use project on Franklin Road, I am requesting modification of the yet-to-be signed
Developmcnt Agreement.
The City Council approved the subject development project at their meeting on April 25,
2006. The staff analysis for the project stated that a development agreement (DA) will be
required as part of an annexation of this property. The DA incorporated several
provisions including the following statement:
· The Owner/Developer shall maintain Lot 19, Block 3 in a state free of
accumulation of junk:, noxious weeds, and shall fence the perimeter of Lot 5
Block 3 to limit public access to the waterway.
We certainly do not question the need to maintain Lot 19, Block 3 free of junk: and
weeds; however, we believe fencing the perimeter of Lot 5, Block 3 to limit public access
to the waterway is not in keeping with the design of the approved project or the plan for a
public pathway along the waterway, Ten Mile Creek. Building the fence as requested in
this DA provision would preclude or limit access to the public pathway. This pathway is
part of the public pathway system noted in the Meridian Comprehensive Plan.
Nampa Meridian Irrigation District has agreed to allow a public pathway along Ten Mile
Creek and we are working with them to determine lhe best location for the path. As
noted in the attached e-mail, the NMID will not require a fence between the development
and the Creek.
Through this Development Agreement Modification Request, we ask that the DA
provision be revised to read:
. The Owner/Developer shall maintain Lot 19, Block 3 in a state free of
accumulation of junk, noxious weeds, and shall install a temporary construction
fence along the south boundary of Lot 5, Block 3 to limit public access to Lot 19,
Block 3 and lhe Ten Mile Creek during construction.

Good Morning Jane:
I called John Anderson at Nampa Meridian Irrigation District yesterday, and left him a message as to the Meridian City
requirement that we place a fence between Ten Mile Creek and Harks Canyon Creek. John called me back as he was
leaving for vacation. He told me that there is an agreement with the City of Meridian that there will be fences along
canals and ditches. This agreement. according to John, does not include drainage ditches like the Ten Mile Creek.
Fences there are optional. He told me that they do want to see our plans, and that I need to take my plans in for Bill to
review. I will be doing that today, in between meetings, if he is available. I will keep you informed.

One of the things that John is concerned about is the brtdge across Ten Mile Creek. They do not want an arched path.
They want a culvert with a path across. That is easier for their maintenance.
