BRS Project No. 06053.01 Pursuant to our meeting on 8-18-06 Cherry Lane Christian Church and BRS, Architects'(as their applicant) requests modification to the previously adopted- development agreement dated November 30, 2005, Instrument number AZ- 05023. This document was recorded on 12/15/05 by Ada County Recorder J. David Navarro. ~ It is the request of CLCe to revise the development agreement to allow development of its site on the north side of 10 mile creek to occur without the requirement a conditional use permit as originally identified in the development agreement. It is requested that future buildings north of the 10 mile creek will be submitted for review and approval to Planning and Zoning thru the certificate and zoning compliance application. That these proposed uses are accessory in nature to the primary buildings south of 10 mile creek, and are compliant with the required land use, and zoning functions originally identified in the development agreement. It should also be noted that this request is with the understanding that all buildings south of 10 mile creek will be submitted thru the standard application and C.U.P. approval process as identified in the current ordinance. Those proposed buildings are the proposed Church, School, and Administration Office building. This requested modification to the development agreement does not intend to revise the primary land use, or zoning initially approved. The heart of this request is to expedite the current improvements that are intended to be made to the park concerning its "existing house" being relocated and new stand alone garage that are to be used for a small offjce, and custodial/security functions. Later phases also on the north side of 10 mile creek would include a covered picnic building, adjacent basket ball court, restrooms, and maintenance building. Please see the attached site plan which identifies the proposed buildings, and their locatIon north and south of the 10 mile creek. ~ AUG, n. :L006 1::L 1 PM 8 KS ARCH I TECTS NO.5917 P. 4 City of Meridian P & Z CLCC Annexation March 24, 2005 Page 2 of 6 It was during our pre-application meeting concerning a pending CZC being reviewed by staff for the proposed relocation of the existing house, new garage, and asphalt parking for the park, that the modification amendment was identified by staff as a prudent course to pursue. It was also stated that for the phased nature of the smatler accessory use buildings located in the Pocket Park that this would simplify the submittal process for GLee. It was also discussed that the anticipated completion of the Park's multiple buildings and additional landscaping would be concluded in the next 5 to 6 years. The Cherry Lane Christian Church property is located on the northwest ,corner of the intersection of 10 Mile Road and Franklin Road. The 39.47 acre parcel was a former dairy and cultivated field. It is relatively flat, and is dissected by 10 Mile Creek. It is currently zoned C-N with the permitted primary use being the church function as well as other related uses which are designated as "accessory use" in the zoning ordinance. The Comprehensive Plan designates this parcel as Mixed Regional, and we believe that the proposed modification retains the original intent consistent with the land use policy of the Meridian Comprehensive Plan, Chapter VII C-1. The site is within the Meridian Urban Planning area, and we therefore think that this request is consistent with the long-range city goals. Ten mile Road is slated for a significant widening project by ACHD in 2007. The additional right of way needed for the revised ACHD design prompted the house relocation as it proposed the new public sidewalk to be 7 feet from the front door of the house. Franklin Road is still slated for its major widening by ACHD in 2010. Both roadways will ultimately serve the much anticipated 1-84 interchange and growing traffic demands. CLec is supportive of the new Ten Mile Road and 1-84 interchange, and we feel the relocated orientation of the house will provide a much needed presence of eyes and ears on the property for a security, and maintenance, as the church has already experienced vandalism on it current improvements. 2 , AUG. In the current phase 1 plan for its construction south of 10 mile creek it is the intention of GLeC to construct the Church building able to seat 1000 in the sanctuary, and also construct the stand alone gymnasium containing high school and middle school classrooms. The complete build-out of this site which was conceptually represented in the previously submitted master site plan is largely unchanged from our initial proposal. It is still anticipated to be phased as the congregation and its financial abilities grow, and will be submitted to the city for review for each phase of its proposed expansion. Please see the specific sections of the development agreement requested for modification in the attached document. RECITALS: 1.1 WHEREAS, "O\.vNERlDEVELOPER" is the sole owner, in law and/or equity, of certain tract of land in the County of Ada, State of Idaho, described in Exhibit A for each owner, which is attached hereto and by this reference incorporated herein as if set forth in full, herein afterreferred to as the ('Property"; and 1.2 WHEREAS, I.C. g 67 -6511 A, Idaho Code, provides that cities may, by ordinance, require or permit as a condition of re~zoning that the "Owner/Developer" make a written commitment concerning the use or development of the subject "Property"; and 1.3 WHEREAS, <'City" has exercised its statutory authority by the enactment of Ordinance 11-15-12 and 11-16-4 A, which authorizes development agreements upon the annexation and/or re-zoning of land; and 1.4 WHEREAS, "Owner/Developer" has submitted an application for annexation and zoning of the "Property's" described in Exhibit A, and has requested a designation of (C-N) Neighborhood Business District, (Municipal Code of the City of Meridian); and 1.5 WHEREAS, "OwnerIDeveloper" made representations at the public hearings both before the Meridian Planning & Zoning Commission and before the Meridian City Council, as to how the subject "Property" will be developed and what improvements will be made; and DEVELOPMENT AGREEMENT (AZ 05-023) CHERRY LANE CHRISTIAN CHURCH) PAGE] OF 11 /~ t.. At this time the owner/developer proposes to use the property primarily as a church, including anticipated related support facilities and services as follows: worship facilities, educational facilities, administrative offlces, child care facilities, maintenance buildings, caretaker/security residences, recreational facilities/pocket park, religious bookstore, food service. 5, That the applicant agrees to provide cross-access to the parcels to the west and north, prior to issuance of a Certificate of Zoning Compliance (C2C) pennit for any future use. 6. The "OwnerIDeveloper" has completed a traffic study which has been accepted by ACHD (Ada County Highway District) and submitted to "City". ACHD Commissioners approved the following entry points to the property: From Ten Mile Road 130 feet south of the north property line as shared access with the City Meridian for their well site 150 feet south of the well site for a parking lot for the recreation area 150 feet south of the parking lot for a drive way to the maintenance area and house 318 feet north of Franklin Road, just south ofTen Mile Creek From Franklin Road A j oint roadway with the Silver Oaks subdivision on the West property line 550 feet west ofTen Mile Road as a minor access 236 feet west of the minor access point for a main entrance 7. COMPLIANCE PERIOD/CONSENT TO REZONE: This Agreement and the commitments contained herein shall be terminated, and the zoning designation reversed, upon a default ofthe "OwnertDeveloper" or "OwnerslDevelopers" heirs, successors, assigns, to comply with Section 6 entitled "Conditions Governing Development of Subject Property" of this agreement within two years of the date this Agreement is effective, and after the "City" has complied with the notice and hearing procedures as outlined in Idaho Code ~ 67- 6509, or any subsequent amendments or recodifications thereof. 8. CONSENT TO DE-ANNEXATION AND REVERSAL OF ZONING DESIGNATION: DEVELOPMENT AGREEMENT (AZ 05-023) CHERRY LANE CHRISTIAN CHURCH) PAGE 5 OF II ~- t ' C' "OwnerJDeveloperll consents upon default to the reversal of the zoning designation of the "Property" subject to and conditioned upon the following conditions precedent to-wit: 8.1 That the "City" provide written notice of any failure to comply with tlus Agreement to "Owner/Developer" and ifthe "O\vnerlDeveloper1' fails to cure such failure within six (6) months of such notice. 9. INSPECTION: "OwnerlDeveloper" shall, immediately upon completion of any portion or the entirety of said development of the "Propelty" as required by this agreement or by City ordinance or policy, notify the City Engineer and request the City Engineer's inspections and wdtten approval of such completed improvements or portion thereof in accordance with the terms and conditions of this Development Agreement and all other ordinances of the "Citi' that apply to said Development. 10. DEFAULT: 1 0.1 In the event "Owner/Developer", "Owner/Developer1sll heirs, successors, assigns, or subsequent owners of the "Property" or any other person acquiring an interest in the "Property", fail to faithfully comply with all of the tenus and conditions included in this Agreement in cOlUlection with the "Property", this Agreement may be modified or terminated by the "City" upon compliance with the requirements ofthe Zoning Ordinance, 10.2 A waiver by "City" of any default by "Owner/Developer" of anyone or more ofthe covenants or conditions hereof shall apply solely to the breach and breaches waived and shall not bar any other rights or remedies of "City" or apply to any subsequent breach of any such or other covenants and conditions. 11. REQUIREMENT FOR RECORDATION: "City" shall record either a memorandum of this Agreement or this Agreement, including all of the Exhibits, at "Owner/Developer's~' cost, and submit proof of such recording to "OwnerlDeveloper", prior to the third reading of the Meridian Zoning Ordinance in cOllllection with the re-zoning of the "Property" by the City CounciL If for any reason after such recordation. the City Council fails to adopt the ordinance in connection with the annexation and zoning of the "Property" contemplated hereby, the "City" shall execute and record an appropriate instrument of release of this Agreement. ZONING: "City" shall, following recordation of the duly approved Agreement; enact a valid and binding ordinance zoning the "Property" as specified herein, ]3. REMEDIES: This Agreement shall be enforceable in any court of competent jurisdiction by either "Citt' or ~'OwnerlDeveloper", or by any successor or successors in title or by the assigns ofthe parties hereto. Enforcement may be sought by an appropriate action at law or in equity to secure the specific performance of the covenants, agreements, conditions, and obligations contained herein, 13.1 In the event of a material breach of this Agreement, the parties agree that "City" and "Owner/Developer" shall have thirty (30) days after delivery of notice of said breach to correct the same prior to the non- breaching party's seeking of any remedy provided for herein; provided, however, that in the case of any such default which cannot with diligence be cured within such thirty (30) day period, if the defaulting party shall commence to cure the same within such thirty (30) day period and thereafter shall prosecute the curing of same with diligence and continuity, then the time allowed to cure such failure may be extended for such period as may be necessary to complete the curing of the same with diligence and continuity. 13.2 In the event the performance of any covenant to be perfOlmed hereunder by either "OwnerlDeveloper" or "City" is delayed for causes which are beyond the reasonable control of the party responsible for such performance, which shall include, without limitation; acts of civil disobedience, strikes or similar causes, the time for such performance shall be extended by the amount of time of such delay. 14. SURETY OF PERFORMANCE: The "City" may also require surety bonds, irrevocable letters of credit, cash deposits, certified check or negotiable bonds, as allowed under Meridian City Code 912-5-3, to insure that installation of the improvements, which the "OwnerlDeveloper" agrees to provide) if required by the "City". 15. The Public Works Department has confirmed that the submitted legal description meets the requirements of the City of Meridian and the Idaho State Tax Commission. 2. Any future subdivision and/or development of this property shall comply with the City of Meridian ordinances in effect at the time. 3, Prior to the annexation ordinance approval, a Development Agreement (DA) shall be entered into between the City of Meridian, property owner (at the time of annexation ordinance adoption), and the developer. Access: Limiting vehicular access to this property is essential to maintaining traffic flow on Franklin Road during peak hours. ACHD policy requires right- in/right-out driveways located on arterial roadways to be constructed a minimum of 150 feet from a stop controlled intersection; 220 feet is required for a full access driveway. Although this property has sufficient frontage to meet the District's policy, there is need and a request by ACHD for a detailed traffic study prior to development When the FranklinlTen mile intersection is signalized) or if safety of any accesses should become an issue) the ACHD may restrict the access to right-inlright-out only for all access points. The final locations of points of access will be determined at a later date, during detailed approval through the Planned Development process. Because only one access to the public roadway system is being proposed for this property to the west of the site, staff recommends that cross access be provided to the site to the west. The idea with providing cross access to the multifamily development is that when the church expands and/or redevelops, cross access will be reciprocated to the proposed multifamily development. If cross access is provided then patrons of the church can access Franklin Road at a signalized intersection without having to cross traffic lanes on Franklin Road to exit fue site. See Annexation & Zoning Facts and Comments #2 below. Landscaping: Franklin Road and Ten mile Road are classified arterial roadways. A 25-foot wide landscape buffer is currently required adjacent to arterial roadways (MCC 12- r3-1O-4). Landscape buffers along Meridian Road and Ustiok Road wilJ be required by the City with CZClPlanned Development approval. If the subject annexation and zoning application is approved, C~N property will be adjacent to roral residential properties zoned RUT in Ada County and an outdoor storage facility. To buffer the existing land uses to the south and west from future commercial office uses on this site, landscape buffers along the perimeter of the site should be installed when a CZClPlat is approved (see MCC 12.13-12). Parking: For Churches/Schools/Gynmasium, parking stalls are cUTl'ently required at the rate of one space per 4 auditorium seats. one space per each 5 church seats, one space per 400 s.f. of gross office floor area (administration building), 2 parking spaces per elementary classroom, 10 parking spaces per high school classroom plus 1 for each 10 seats in and auditorium or gymnasium. The applicant shall execute City of Meridian standard forms of easements for any mains that are required to provide service. MERIDIAN FIRE DEPARTMENT COMMENTS 1. Acceptance of the water supply for fire protection will be by the Meridian Fire Department and water quality by the Meridian Water Department for bacteria testing. 2, Final Approval of the fire hydrant locations shall be by the Meridian Fire Department. a. Fire Hydrants shall have the 4 W' outlet face the main street or parking lot aisle. b. The Fire hydrant shall not face a street which does not have addt'esses on it. c. Fire hydrant markers shan be provided per Public Works spec. d. Locations with fire hydrants shall have the curb painted red 10' to each side of the hydrant location. e. MERIDIAN PUBLIC WORKS DEPARTMEN1: 1. All development improvements, including but not limited to sewer. fencing. micro-paths, pressurized irrigation and landscaping shall be installed and approved prior to obtaining certificates of occupancy. 2. Applicant shall be required to pay Public Works development plan review, and construotion inspection fees, as determined during the plan review process, prior to signature on the final plat per Resolution 02-374. 3. It shall be the responsibility of the applicant to ensure that aU development features comply with the Americans with Disabilities Act and the Fair Housing Act. 4. Applicant shall be responsible for application and compliance with and NPDBS penmtting that may be required by the Environmental Protection Agency. 5. Applicant shall be responsible for application and compliance with any Section 404 Permitting that may be required by the Anny Corps of Engineers. 6. The following is the list of standards found in 11-15-11 and analysis: A. Will the new zoning be harmonious with and in accordance with the Comprehensive Plan and, if not, has there been an application for a Comprehensive Plan amendment; Staff finds that the requested Neighborhood Commercial (C-N) zoning designation is in accord with the Comprehensive Plan's Future Land Use Map, which delineates the subject property as "Mixed Use-Regional". Chapter VI C.2 P71 - Multiuse pathways: Pathways that encourage use by bicyclists and pedestrians can decrease road congestion and add to the community's quality of life. The proposed off-street and multiuse pathway systems are depicted in Figures VI-3 and Vl-4. New and existing developments should ensure that the guidelines, laid out in this plan are adopted. Staff further finds that the proposed uses wiil change the existing character of the area, but that the proposed zone and future use(s) should be hannonious and appropriate in appearance with the character of the overall area. Based on the joint agency/depmtment meeting and other comments received from agencies/departments, stafffinds that the public services listed above can be made available to accommodate the proposed development. Will the proposed uses not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property or the general welfare by reason of excessive production of traffic, noise, smoke, fumes, glare or odors; Staff finds that any future uses on this site will generate additional traffic on adjacent roadways above and beyond the existing residences. The level of impact will depend upon the type of future use(s) and the square footage of the buildings. Staff recognizes that traffic and noise will increase with the approval of this development; however, do to the large size of the site and number of proposed accesses, staff does not believe that the amount generated will be detrimental to the general welfare of the public. Traffic will further be reviewed and accommodated by ACHD review of the detailed traffic study. The purpose ofthe C-N zone is to "to pennit small scale convenience business uses which are intended to meet the daily needs of the residents in the immediate neighborhood. .. .and shall not constitute all or any part of a strip development concept:' (MCCll-7-2.H) As such, staff does not anticipate future uses will create smoke, fumes, glare, or odors that will be detrimental to the general welfare of persons or property in the area. Staff does not anticipate the proposed annexation and subsequent use(s) will create excessive noise, smoke, fumes, glare, or odors. Staff finds that the proposed Church! Private School uses should not be detrimental to people, property or the general welfare of the area. MCC 11-16-4 provides the P&Z Conlmission and City Council the authority to require a property owner to enter into a Development Agreement with the City of Meridian that may require some written commitment for all future uses to more fully comply with this finding. Due to the close proximity of existing and future residential uses, the scale of the project, and relation to neighboring uses, staff believes that a Development Agreement is necessary to ensure that the purpose of the C~N zone is maintained. Please see Annexation & Zoning Facts and Comments below. J. Will the area have vehicular approaches to the property which shan be so designed as not to create an interference with traffic on surrounding public streets; Tills parcel has a large amount of frontage on both Franklin Road and limited frontage on Ten-Mile Road. The applicant is conceptually proposing four driveway approaches to Franklin Road: a shared access at the mid section (for possible future signalization), two right in and right out accesses, and a full access at approximately the ~ section line. ACHD considers access points in their analysis of development applications and has requested a detailed traffic study. Staff believes that these locations will provide adequate access, but it may be restricted based upon the detailed traffic study. To help future traffic flows in this Cherry Lane Christian Church Exhibit D (-- (' area, staff believes that cross access between the subject property and the property to the west and north should be provided. If cross access is provided from the west and north, patrons of the church/school, storage facility, and multifamily development can access Franklin Road at the 1h section line, also to be cost shared with the property to the west. Staff believes that the proposed uses (and access) should not be hazardous to neighboring uses or traffic flows, but development should be restricted until ACHD has had adequate time to review a traffic study. The Commission and Council should rely on public testimony, ACHD staff, and City staff's analysis when detennining whether or not a vehicular approach to Franklin Road will interfere with traffic on surrounding public streets. See Special Consideration #1 below for more analysis. K. Will not result in the destruction, loss 0);' damage of a natural or scenic feature of major importance; and Staffis unaware of any natural of scenic features of major importance on this site and finds that no natural or scenic features of maj or importance will be lost or damaged by approving the annexation and zoning application. (Ord. 592, 11-17-1992),j The legal description submitted with the application, prepared by Stephen Lee PLS of Pinnacle Engineers, Inc., shows that the property is contiguous to the existing corporate boundary ofthe City of Meridian. The land directly north, and northeast ofthe subject property have previously been annexed into the City and this is a logical expansion of the City boundary. The applicant is proposing to develop the land in substantial compliance with the City's Comprehensive Plan. In accordance with the findings listed above, staff finds that the annexation/zoning of this property would be in the best interest oillie City.
