RE: Proposed Modification to Development Agreement H-2021-0081

On August 1,2023 Ten Mile West Commercial, LLC acquired the southern 75 acres of the property
previously owned by Meridian 118, LLC, ("Property"). The Property is subject to the existing Development
Agreement between Meridian 118, LLC, recorded May 25, 2022 as Instrument No. 2022-049799
("Development Agreement").
Ten Mile West Commercial, LLC("Applicants") is committed to developing the Property
consistent with the zoning set forth in the Development Agreement,they do however, seek modification
to certain provisions:
1. The Development Agreement includes a phasing plan and some language, that the applicant
seeks to amend to align with their development schedule.
2. While the Development Agreement does specifically list distribution and light manufacturing
as examples of intended uses for the mixed employment zone (Reference p. 22 & 27 of the
recorded Development Agreement), it does not adequately address the design requirements
for these buildings. This modification proposes design guidelines for these buildings.
3. Warehousing and distribution is allowed in the mixed employment zone with a conditional
use permit(CUP), and the Applicant is concurrently pursuing a CUP for a portion of this zone.
To ensure the mixed employment zone maintains the variation of uses desired by the city,the
applicant is proposing a limitation on flex and warehouse uses in approximately 1/3 of the
mixed employment zone.
