A RESOLUTION VACATING A PORTION OFTHEALLEY, ADJACENT TO THE MERIDIAN
CREAMERY, SITUATED BETWEEN LOTS 1 THROUGH 9 AND LOTS 22 THROUGH 3D,
BLOCK 1, OF THE AMENDED PLAT OF THE TOWNSITE OF MERIDIAN, LOCATED IN THE
SW ~ OF SECTION 7, T3N. R1E, B.M., ADA COUNTY, IDAHO, MORE PARTICULARY
DESCRIBED IN EXHIBIT A.
WHEREAS, THE ADA COUNTY HIGHWAY DISTRICT ADOPTED FINDINGS OF FACTS
AND CONCLUSIONS OF LAW DATED May 24,2006, FINDING THAT THE VACATION
OF A PORTION OF THE ALLEY, ADJACENT TO THE MERIDIAN CREAMERY,
SITUATED BETWEEN LOTS 1 THROUGH 9 AND LOTS 22 THROUGH 30, BLOCK 1, OF
THE AMENDED pLAT OF THE TOWNSITE OF MERIDIAN, LOCATED IN THE SW % OF
SECTION 7, T3N, R1E, B.M., ADA COUNTY, IDAHO,IS IN THE PUBLIC INTEREST.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE
ADA COUNTY HIGHWAY DISTRICT THAT:
VACATION - A PORTION OF THE ALLEY, ADJACENT TO THE MERIDIAN CREAMERY,
SITUATED BETWEEN LOTS 1 THROUGH 9 AND LOTS 22 THROUGH 3D, BLOCK 1, OF .
THE AMENDED PLAT OF THE TOWNSITE OF MERIDIAN, LOCATED IN THE SW ~ OF
SECTION 7, T3N, R1 E, B.M., ADA COUNTY, IDAHO.
SEE EXHIBIT "A"
(WHICH BY ATTACHMENT BECOME A PART HERETO~)
1. Payment of additional costs in the amount of $47,903.00 for the value of right-of-
way as determined by an independent certified appraiser.
2. Subject to retention of public and private utility easements, drainage easements,
irrigation easements and/or other easements of record or not of record or in use
upon or under said described public right-of-way and/or the provisions for the
relocation or replacement of existing facilities.

a. Retention of Idaho Power Company's overhead line easement. IPC must retain
its right to repair, replace, maintain or reinforce, along with ingress/egress to its
facilities.
b. Qwest Corporation's easement encompassing existing and anyfuture telephone
facility requirements.
c. City easements.
Costs associated with relocation or replacement of existing easements and facilities shall
be bome by the applicant with approval of the applicable utility or agency.
Be and same is hereby vacated and abandoned unto the adjacent and abutting property
owners.

office of the Recorder, Ada County, Idaho, and being located in the SW ',4 of Section
7 of Township 3 North, Range 1 East, Boise Meridian, Ada County, Idaho, said parcel
formerly described in Instruments #~69578 and. #269580, and more particularly
described as follows:
Commencing at a brass cap monument marking the northwest corner of said SW v..
(1.4 Corner), from which a brass cap monument marking the southwest corner of said
