Ste. 200, Meridian, Idaho 83642 RE: Mussell Corner Subdivision, Development Agreement Modification Mr. Hood: ~~~ ~~¢ '~ We are submitting the Development Agreement Modifcation for the Mussell Corner subdivision (please refer to the attached vicinity map). We are requesting that the stipulation "all future uses on proposed lots or parcels within the annexation area shall be approved through conditional use permit, " be removed from the Development This language was included in the origins[ development agreement and associated ftndings of fact. We understand that most, if not all, of the new subdivisions approved under City of Meridian guidelines do not require this language. We fee[ that the requirement for a Conditional Use Permit approval is redundant, and will cause undue hardship far the development of this property, and will result in unnecessary work required by the planning staff for the City of Meridian and the developer. The Mussel[ Corner Subdivision is currently zoned for commercial use, and compliance with zoning requirements will establish development standards for this property, 1. Date of original approval of development agreement by City Kuna Victory, LLC ("Applicant") entered into a purchase and sale agreement with Tim and Carol Mussell ("Seller") for the subject property, Mussell Corner Subdivision ("Property") on May 26"', 2004. Prior to the purchase agreement, the Seller had submitted an application for annexation and zoning and requested that the zoning have a designation of General Retail and Service Commercial District {C-G). With the purchase ofthe Property, the Applicant was assigned and assumed control of the Development Agreement ("Agreement") that had been drafted and was in the processes of approval, between the Seller and the City of Meridian ("City"). 2. Recorrlatio-r date of development agreenrerrt and irrstrurnent number The Agreement was made and entered into on November 17`'', 2004 by and between the Seller and the City. The Agreement was recorded on December 3`d, 2004 with instrument number 104153422. 3. Sections of the development agreenrerrt to be morlifred ar:d proposed modifications In the Development Agreement, Section 4.1.a and Section 6.B. l.a, and Section 12.A.I .a of Findings of Fact and Section 3.A.l.a. per Decision and Order of Exhibit B (collectively the "CUP Sections"} to the Agreement stipulate that "all future uses on proposed lots or parcels within the annexation area shall be approved through conditional arse permit. Reason for development agreement morlifieation ~ s ,> The current City of Meridian regulations do not require subdivisions resubmit individually for each developed parcel, for Conditional Use Approval, as is the case the Mussel] Corner subdivision. Thus, it is the request of the Applicant to be held to cun•ent City standards with regards to future uses on their lots by deleting the CUP Sections of the Agreement in their entirety. tt is the belief of the App]icant that this will alleviate an already very heavy workload for City Staff and the developer, and free up City funds for other uses since a development agreement modiFication is far less time consuming than a CUP application. In addition, the requirement for CUP on the Mussel] Subdivision property, as it now stands, provides a hardship for development of this subdivision. S. Outer supporting information As with all their projects, the Applicant seeks to tie in the design of future development with that of sun•ounding structures. For example, the applicant is planning on using a similar design concept, and similar materials, as nearby Double D Home and Ranch. The applicant also requests a three year extension for the submittal of the Mussell Co~~ner Subdivision Masterplan. The Victory Greens nursery currently has three years remaining on their current lease. The Victory Green nursery will occupy the majority of the Subdivision through .luly of 2009. It is the belief of the Applicant that this request for additional time will allow the development team, and the City of Meridian, to accurately assess the best combination oFprojects for the subject property.
