The Regular Meeting of the Meridian City Council was called to order by Mayor Grant P.
Kingsford at 7:30 P.M.:
Members Present: Bob Giesler, Ron Tolsma, Bert Myers, Max Yerrington:

The Motion was made by Myers and seconded by Yerrington to approve the Minutes of
the Previous Meeting held February 19} 1991 as written:
Motion Carried: All Yea:
Fire Chief Bowers: Introduced the new Full Time Fireman Steve Gempler to the Mayor
and Council. Also showed Mayor and Council the new fire suits that are in.
ITEM #1: PUBLIC HEARING: VARIANCE REQUEST ON 5FT. SIDE YARD SETBACK BY KEN WESTBY:
Kingsford: I will now open the Public Hearing, is there anyone present who wishes to
testify on this issue, if so please come forward and be sworn by the attorney.
Ken Westby} 234 E. 2nd, was sworn by the attorn~y.
Westby: Explained request and plans to the Council.
Kingsford: Anyone else to testify, hearing no response the Public Hearing was closed.
The Motion was made by Giesler and seconded by Myers that the City Council of the City
of Meridian does hereby adopt and approves these Findings of Fact and Conclusions.
Roll Call Vote: Yerrington - Yea; Giesler - Yea; Myers - Yea; Tolsma - Yea;
Motion Carried: All Yea:
The Motion was made by Giesler and seconded by Myers to approve the Variance and
set-back requirements for Ken Westby.

ITEM #2: PUBLIC HEARING: PRELIMINARY PLAT ON MERIDIAN GREENS #2:
Kingsford: I will now open the Public Hearing} is there anyone who wishes to testify}
if so please come forward and be sworn.
Yerrington: I have a conflict of interest in this matter so I will be stepping down.
Don Hubble} Hubble Engineering} was sworn by the attorney.

Hubble: There will be 84 lots and all will be hooked to City water and sewer.
Density will be approximately two lots per acre, with 175 lots in Meridian Greens.
We don't have any problem with any of the City Engineer's comments or recommendations.
The Planning and Zoning Members recommended four conditions and we hope that you
will concur with their recommendation. They were undecided about how to treat the
connection to the existing Mesa Way. As mentioned in Engineer Smith's letter
under miscellaneous conditions #4 said that the developer should start the planning
process for developing a street access to the west and or to the south which would be
Victory Road via Mesa Way. Our best route would be to proceed with that Mesa Way,
the developer has no problem with that and would like to do that. The only other
two items that I would like to mention would be miscellaneous condition regarding
street lights. The developer would like to install a street lights at the street
intersections and then relay on yard lights through the middle of the blocks. If that's
acceptable to you that would be the way we would like to see the condition. Then
another comment here under C3, says that a pressure sprinkling system needs to be
provided for the subdivision. We'd just like to point out that there was a
pressurized irrigation system installed in Meridian Greens Unit #l. We think that
approximately 1/3 of the homeowners have connected and are using that existing system.
There are some pro's and conls about that system. One of the con's being that water
is only available between April 15th and September 15th but the irrigation season
runs longer than that so most of those people or maybe all have to connect to both
systems. What we'd like to present to you tonight is an informal question for your
consideration as to whether that ought to be a condition. An alternative for that
may be for the developer to contribute to the City a certain amount of money per lot
equal to what it would have cost him for that installation of that system to offset
costs for the City to construct additional wells in the future. If it is your desire
that a pressurized sprinkling system be installed then they will certainly do that.
Giesler: Have they looked into a well for the irrigation system to see it that's
feasible? I was wondering if it would be feasible to look into the cost of a well
to handle that irrigation rather than the ditch.
Hubble: We've only done some preliminary estimating with that.
Giesler: Can you refresh my memory as to what the light set up is in #l?
Kingsford: It is photo cell yard lights. There were no street lights at the intersections
as I recall. Any other questions.
Tolsma: That culdesac on Antigua Place it said that was in excess of the required
450 feetl has that been altered or changed yet?
Hubble: No and I'm glad you brought that up. We did request a variance from that
standard. We are aware of it.
Kingsford: Anyone else have any questions, no response. Anyone else from the public
to testify?
Les Schild, 2425 Mesa Way, was sworn by the attorney.
Schild: I represent the property owners in Kachina Estates. Since my property adjoins
this easement that we the Kachina Estates Property owners would not like to see a road
go through there. Spoke of a petition signed and turned in to ACHD. The ACHD informed
me that they were going to wait to even accept this petition until after the meeting
tonight.

Kingsford: We'd like to see additional access as would the ACHD particularly for
emergency access. I can appreciate your wanting the rural setting but is your thought's
logically that many of those people are going to go south, there is no place to go to
going south, it seems to me that it would benefit you folks rather than hurt you.
Schild: We didn't feel that there would be as much traffic impact but according to
Mr. Hubble's study it does show that there would be quite an impact. The other
thing that concerns us is this would turn Mesa Way into a Collector Street.
Kingsford: It is my understanding that the developer would have to pave to Mesa Way.
Schild: Another question, Bert Cafferty is the adjoining property, our two properties
are adjoining that easement. There is an irrigation ditch that runs through there,
goes around the culdesac now obviously if the road goes through you know we are going to
have to do something to get his water to him.
Kingsford: I've got to think that this would help you guys.
Schild: Voiced further concerns about impact of additional traffic.
Giesler: What year was this subdivision platted, do you know?
Kingsford: 1974 it shows on this map. Anyone else to testify?
Steve McDonald, 2889 Mesa Way, was sworn by the attorney.
McDonald: When this subdivision is put in and if the subdivision people want to use
that as access to go to Victory Road, #1 Ada County has never done anything for us, are
they going to make us put curb & gutter in, are they going to all of a sudden going to
say you guys have to be on the sewer system?
Kingsford: The Highway District is certainly not going to do that and the City won't
either.
McDonald: If you annex into the City are you going to annex us into the City and make
that road go through?
Kingsford: No} not unless you request it.
McDonald: Spoke of the condition of the road and that there is no upkeep done to it.
Kingsford: I would gladly write a letter to support more upkeep to your road.
Anyone else?
Bert Cafferty, 2555 Mesa Way, was sworn by the attorney.
Cafferty: My biggest concern is that there is no speed limit signs on that road or
anything right now.

Cafferty: Ada County needs to be aware that something needs to be done there.
Hubble: I'd like to comment on a few things that have corne up in this discussion.
First of all we did do a traffic study for the Ada County Highway District, they asked
us to evaluate what impacts we saw onto Mesa Way. Explained the study figures that
have been done. (TAPE ON FILE)
Kingsford: Would the developer have a site that they may be willing to give the
City for water, a new well? I have some real concerns about having just one line
out there. Also some concerns about the pressure.
Hubble: There are some sites available and the developer is willing to work with the
City.
Crookston: On the irrigation and the street lights you are going to have to have a
variance.
Kingsford: We have no control over the curbs, gutters and sidewalks, that's up to
Ada County Highway District. Anyone else to testify?
Bob Waitley, 2055 S. Locust Grove, was sworn by the attorney.
Waitley: I've got property that lays behind lots 36,37 & 38. I'm a little concerned that
someplace down the line they are going to start yelling about keeping the weeds down on
that or dumping their garbage on that piece of property.
Kingsford: Anyone else? Hearing no response I will close the Public Hearing.
Giesler: Where are we at on S.E. 5th Way as far as improving that?
Kingsford: How many more lots was it until they required you to open up 5th?
Hubble: Roughly forty to sixty lots.
The Motion was made by Giesler and seconded by Myers to table this until the next
meeting which is March 19th.

ITEM #3: PRE-TERMINATION HEARING: WATER/SEWER/TRASH DELINQUENCIES:
Kingsford: This is to inform you in writing, if you choose to, you have the right
to a pre-determination hearing at 7:30 P.M. 3/5/91 before the Mayor and City Council,
to appear in person to be judged on facts and defend the claim made by the City that
your water, sewer, and trash bill is delinquent. You may retain Counsel. This service
will be discontinued on 3/13/91 unless paid in full. Is there anyone from the public
that would like to contest their waterJsewer, trash bill? There was no response.
They are hereby informed that they may appeal or have the decision of the City reviewed
by the Fourth Judicial District Court, pursuant to Idaho Code. Even though they appeal
the water will be shut off.
The Motion was made by Myers and seconded by Tolsma to approve of the turn off list.

Kingsford: The total amount of the delinquencies is $13,834.74.
ITEM #4: APPROVE THE BILLS:
The Motion was made by Myers and seconded by Tolsma to approve the Bills.

ITEM #5: REQUEST FOR A 1 YEAR EXTENSION BY SMITH & BEWS ON THE PRELIMINARY PLAT ON
MERIDIAN MANOR #7:
The Motion was made by Giesler and seconded by Tolsma to approve the extension for 1 year
by Smith & Bews.

ITEM #6: REQUEST BY VALLEY BIBLE FELLOWSHIP FOR PORTABLE CLASSROOM STRUCTURE:
Kingsford: Is there a representative present, please come forward and tell us of your
proposal.
Mark AgenbroadJ 1871 Jericho Road: I have some site plans to show. We would like to
place a portable structure on the property to facilitate church offices, fellowship
hall & additional classroom spaces.
Kingsford: Were you asking for a permanent placement?
Agenbroad: It would be there for a period of time. One of our other options that we
are not yet pursuing would be to excavate under the building.
Myers: I'd be more inclined to agree on one of those like portable classroom rather than
a mobile home.
Kingsford: We'd need to be sure that it meets the fire & life safety codes and all the
setback requirements.
Agenbroad: Of Course.
The Motion was made By Yerrington and seconded by Tolsma to table this until the
next Meeting.

ITEM #7: BID ON PUMP & PUMPHOUSE WELL #12:
Eng. Smith: On February 27th we opened bids for construction of the Pump & Pumphouse
for Well #12, which is located near the intersection of Cherry Lane Road and Ten Mile
Road. We had three bidders: Bitterroot Construction, The Ewing Co., and Schmidt Construction
Co.. Schmidt Construction was the low bidder at $67,166.00, second low was The Ewing Co.
at $67,449.54, and Bitterroot was the third bidder. All figures have been checked on all
of the bids. Discussion. (Tape on File) - I would recommend that we award the
Contract to Schmidt Construction Co. of Star, Idaho for the amount of $67,166.00

The Motion was made by Tolsma and seconded by Myers to approve of the low bidder who is
Schmidt Construction Co. of Star, Idaho, for the amount of $67,166.00.

The Motion was made by Myers and seconded by Yerrington to authorize the Mayor and
City Clerk to sign the Notice to Proceed and the Award of Contract Documents.

ITEM #8: APPROVE AND ACCEPT THE 1989-90 FISCAL YEAR AUDIT REPORT:
The Motion was made by Myers and seconded by Tolsma to approve the 1989-90 Fiscal
Year Audit Report.
Motion Carried: All Yea:
Kingsford: Commended the Office Staff.
ITEM #9: DEPARTMENT REPORTS:
Eng. Smith: Explained that the Property Owners Hearing was held here at City Hall
to see how many people would be interested in having sewer in N. Meridian Road from
Blue Heron Lane north to Ustick. There was a considerable amount of interest voiced
at that meeting. Explained to Council the costs estimated for this. Also explained
the project - (TAPE ON FILE)
The Motion was made by Myers and seconded by Yerrington to approve the extension of the
8" line from Blue Heron to Ustick and extension of the water line also to include the
crossing for the south slew.

Tolsma: I think congratulations are in order for Terry Smith - Man of the Decade.
Kingsford: I would like to remind the Council that on March 14th we will be making
our presentation before the Department of Commerce and I would appreciate it if all
of you can plan to be there. Also we have received a letter from State of Idaho
Department of Administration stating that if we are going to buy from their surplus
properties program we have to have a Resolution filed with them.

prepared for this.

Kingsford: The Methodist Church has for some time owned the property that the City
gas pumps are on, they would like to have those moved as they are ready to do some
expanding. Jack has some various proposals for this. We have a proposal for

Petro Services Inc. to provide us with a thousand gallon tank that sits above
ground, installed with everything its at $9,200.00. It would be my recommendation
that you approve that.
The Motion was made by Tolsma and seconded by Giesler to approve of the tank for
$9200.00.

The Motion was made by Giesler and seconded by Myers to go into Executive Session
to discuss pending litigation on the City vs. Tamera Perkins case at 9:15 P.M.:

proceed.
