Partial Release of Easement
WHEREAS, by subdivision recorJ1.:d in Plat Book 8g, at Pages 10025 through 10029 on December 31,
2003, as Insttument Number 103212805, ill the: records of Ada County, Stw:: ofIdaho. Sundance Subdivision
No.3, granted to IDAHO POWER COMPANY an easement (the "Easeme;o.t") for the construction, operation
and maintenance of certain power line facilities upon the following premises located in Ada County, State of
Idaho. to-wit:
Sundance Subdivision No. J - Located In the SW%. Section 31, TOW1l3h/p 4 North Range lEast, B.M..
Mer/dlan, Ada Caunty, Idaho,
AND, WHEREAS, it ill no longer necellllaI)' or desirable that a certain portion of the Easement be
retained.
NOW, THEREFORE, in considcnition of the pmnises. IDAHO POWER COMPANY does hereby
release and abandon that certain portion of the Easement over the following described lands:
The public utility ecuement as depicted on the Attached Exhibit ",4" affecting Lets 21, 12, 25 & 26,
Block 7, of Sundance Subdivision #3.
ALL RIGHTS and privileges wuier the above-described document in and to tbe remaining lands
covered by the Easement and any and all prescriptive or other rights the Grantee has acquired through
occupaney and use over time of said remaining lands shall remain and continue in the Grantee and shall not be
affected in any way heICby.
IN WITNESS WHEREOF, IDAHO POWER ~MPANY bas caused these presents to be executed by
its proper officers thereunto duly authorized this .;(.3 day of August, 2006.
