HomeMy WebLinkAboutVienna Woods Subdivision No. 3 FP-00-027BEFORE THE MERIDIAN CITY COUNCIL C/C 02/06/01 IN THE MATTER OF THE APPLICATION OF SIO/LINE DEVELOPMENT COMPANY, FOR APPROVAL OF FINAL PLAT FOR VIENNA WOODS NO. 3, LOCATED ON THE EAST SIDE OF LOCUST GROVE BETWEEN CHINDEN AND McMILLAN, MERIDIAN, IDAHO CASE NO. FP-00-027 ORDER OF CONDITIONAL APPROVAL OF FINAL PLAT This matter coming before the City Council for Final Plat approval pursuant to Meridian City Code § 12-3-7 on February 6, 200 I, and the Council finding that the Administrative Review is complete which has included certain comments and conditions as stated in a letter to the Mayor and Council from Bruce Frecldeton, Engineering Technician III, and Shaft Stiles, Planning and Zoning Administrator, listing 7 General Comments and 16 Site Specific Comments, which are herein found fair and reasonable, and at the February 6, 2001 meeting, Shari Stiles, Planning and Zoning Administrator, commented at the hearing, and no one appeared in opposition, and the Council having considered the requirements of the preliminary plat the Council takes the following action: IT IS HEREBY ORDERED THAT: ORDER OF CONDITIONAL APPROVAL OF FINAL PLAT FOR VIENNA WOODS NO. 3 (FP-00-027) - 1 1. The Plat of "VIENNA WOODS SUBDIVISION NO. 3" as evidenced in Plat beating the "PLAT SHOWING VIENNA WOODS SUBDWISION NO. 3, A SKYLINE DEVELOPMENT COMPANY DEVELOPMENT, LOCATED IN THE N 1/2 OF THE SW 1/4 OF SECTION 29, TOWNSHIP 4 NORTH, RANGE 1 EAST, BOISE MERIDIAN, ADA COUNTY, IDAHO, 2000, HAND WRITTEN DATE OF: 12/14/00, SHEET 1 OF 3, CIVIL SURVEY CONSULTANTS, INCORPORATED, and Skyline Development Company, Developer", is Conditionally Approved subject to those conditions of Staff comments as set forth in the Memorandum to the Mayor and City Council from Bruce Freckleton, Engineering Technician III, and Shati Stiles, Planning and Zoning Administrator, dated January 29, 2001, listing 7 General Comments and 16 Site Specific Comments, and a copy of the response letter dated February 2, 2001, from Tucker Johnson of Skyline Development Company, of which true and correct copies are attached hereto marked Exhibit "A", and consisting of six pages, and by this reference incorporated herein, with the additional requirements as follows, to-wit: 1.1 That at the City Council meeting of February 6, 2001, action by the Council approved the Applicant's response letter to indude from their letter as conditions the following: Site Specific: i. 1.1 (1 .) Insert the word "applicable" before "City Ordinances" as this project is within the County, has a R-4 County zoning designation, and is subject to the County's Ordinances as the lead agency. 1.1.2 (2.) The corrected net density calculation is 3.15. ORDER OF CONDITIONAL APPROVAL OF FINAL PLAT FOR VIENNA WOODS NO. 3 (FP-00-027) - 2 1.1.3 1.1.4 1.1.5 1.1.6 1.1.7 1.1.8 (5.) The specified improvements in the first sentence are to be installed and approved prior to "the release of the non- build agreement" since the City does not issue the building permits. (6.) Perimeter fencing is to be installed prior to "release of non-build agreement," instead of issuance of City building permit. (7.) Lots 4 and 5 are very large lots (both greater than 11,500 SF). While these lots do not meet the City's front lot line standards, these lots do meet the zoning standards of the County R-4 zoning. Despite a good-faith attempt during the design of the preliminary plat to comply with not only the County Codes, but also Meridian Codes, a few lots (approximately 10 out of 227) were approved with front dimensions just under 80' as part of the County's rezone and preliminary plat. (9.) The rear lot line arrow for Lot 1 of Block 10 should point to the north property line~ not the east property line. While this lot's southern property line doesn't strictly comply with the City's standards (it is 79 per staff's measuring technique vs. 80), it does exceed the Coutny's standard of 70' for the R- 4 zoning. The house on this lot will be better situated with the northern property line as the "rear" line with a 10' utility easement. (9b.) Delete (6.) As this subdivision is within the County's lead jurisdiction. (11.) In Vienna Woods, pertains to the City inspecting the sewer service line the builder installs from the street to the house. The City inspects the work within the right-of-way when the developer is installing the sewer lines and service stubs, but it is the State that inspects the service line from the stub to the house, and then the State also inspects the interior plumbing. The County does not issue the "final" approval until the State has signed-off. ORDER OF CONDITIONAL APPROVAL OF FINAL PLAT FOR VIENNA WOODS NO. 3 (FP-00-027) - 3 1.1.9 (13.) Notation: The County Engineer recently indicated that until the State Code is changed to be in compliance with last summer's Supreme Court ruling, City signature elements will be required on the plat - which is contrary to what the surveyor was told a few months ago. 1.1.10 (I 5.) Notation: The non-occupancy note will likely not be needed. 1.2 Fire Chief, Kenny Bowers, requires that no-parldng of vehides, equipment and/or trailers will be allowed in the crt-de-sac. All common lots will need to be kept dear of trash and weeds. 1.3 The Central District Health Department requires after written approval from the appropriate entities are submitted, they can approve this proposal for central sewage and central water; that plans must be submitted to and approved by the Idaho Department of Health and Welfare, Division of Environmental Quality for central sewage and central water; that mn-off is not to create a mosquito breeding problem; and it is suggested that stormwater be pretreated through a grassy swale prior to discharge to the subsurface to prevent impact to groundwater and surface water quality; that engineers and architects should obtain current best management practices for stormwater disposal and design a stormwater management system that is preventing groundwater and surface water degradation. The final plat upon which there is contained the Certification and signature of the City Clerk and the City Engineer verifying that the plat meets the City's requirements shall be signed only at such time as: ORDER OF CONDITIONAL APPROVAL OF FINAL PLAT FOR VIENNA WOODS NO. 3 (FP-O0-027) - 4 The Plat dimensions are approved by the City Engineer; and The City Engineer has verified that all off-site improvements are completed and/or the appropriate letter of credit or cash has been issued guaranteeing the completion of off-site and required on-site improvements.
