HomeMy WebLinkAboutVienna Woods Subdivision No. 4 FP-00-028BEFORE THE MERIDIAN CITY COUNCIL C/C 02/06/01 IN THE MATTER OF TIlE APPLICATION OF SKYLINE DEVELOPMENT COMPANY, FOR APPROVAL OF FINAL PLAT FOR VIENNA WOODS NO. 4, LOCATED ON THE EAST SIDE OF LOCUST GROVE ROAD APPROXIMATELY ONE-HALF MILE NORTH OF McMILLAN ROAD, MERIDIAN, IDAHO CASE NO. FP-O0-028 ORDER OF CONDITIONAL APPROVAL OF FINAL PLAT This matter coming before the City Council for Final Plat approval pursuant to Meridian City Code § 12-3-7 on February 6, 2001, and the Council finding that the AdminiStrative Review is complete which has included certain comments and conditions as stated in a letter to the Mayor and Council from Bruce Freckleton, Engineering Technician III, and Shaft Stiles, Planning and Zoning Administrator, listing 8 General Comments and 12 Site Specific Comments, which are herein found fair and reasonable, and at the February 6, 2001 meeting, Shari Stiles, Planning and Zoning Administrator, commented at the heating, and no one appeared in opposition, and the Council having considered the requirements of the preliminary plat the Council takes the following action: ORDER OF CONDITIONAL APPROVAL OF FINAL PLAT FOR VIENNA WOODS NO. 4 (FP-00-028) - I IT IS HEREBY ORDERED THAT: 1. The Plat of "VIENNA WOODS SUBDMSION NO. 4" as evidenced in Plat beating the "PLAT SHOWING VIENNA WOODS SUBDIVISION NO. 4, A SKYLINE DEVELOPMENT COMPANY DEVELOPMENT, LOCATED IN THE N 1/2 OF THE SW I/4 OF SECTION 29, TOWNSHIP 4 NORTH, RANGE 1 EAST, BOISE MERIDIAN, ADA COUNTY, IDAHO, 2000, SHEET 1 OF 2, CIVIL SURVEY CONSULTANTS, INCORPORATED, and Skyline Development Company, Developer", is Conditionally Approved subject to those conditions of Staff comments as set forth in the Memorandum to the Mayor and City Council from Bruce Freddeton, Engineering Technician III, and Shaft Stiles, Planning and Zoning Administrator, dated January 29, 2001, listing 8 General Comments and 12 Site Specific Comments, and a copy of the response letter dated February 2,2001, from Tucker Johnson of Skyline Development Company, of which true and correct copies are attached hereto marked Exhibit "A', and consisting of six pages, and by this reference incorporated herein, with the additional requirements as follows, to-~vit: 1.1 That at the City Council meeting of February 6, 200 I, action by the Council approved the Applicant's response letter to include from their letter as conditions the following: Site Specific: 1.1.i (1.) Insert the word "applicable" before "City Ordinances" as this project is within the County, has a R-4 County zoning designation, and is subject to the County's Ordinances as the lead agency. ORDER OF CONDITIONAL APPROVAL OF FINAL PLAT FOR VIENNA WOODS NO. 4 (FP-00-028) - 2 1.1.2 (4.) The spedfied improvements in the first sentence are to be installed and approved prior to "the release of the non- build agreement" since the City does not issue the building permits. 1.1.3 (5.) Perimeter fencing is to be installed prior to "release of non-build agreement," instead of issuance of City building permit. 1.1.4 (6.) This lot, like the 2 in Phase 3, meets the County's standards, but it just shy of meeting the City's design standards within a City Zoning designation. This lot is a full 1/2 acre in size. 1.1.5 (9.) Delete (6.) as this subdivision is within the County's lead jurisdiction. 1.1.6 (10.) In Vienna Woods, pertains to the City inspecting the sewer service line the builder installs from the street to the house. The City inspects the work within the right-of-way when the developer is installing the sewer lines and service stubs, but it is the State that inspects the service line from the stub to the house, and then the State also inspects the interior plumbing. The County does not issue the "final" approval until the State has signed-off. 1.1.7 (12.) Notation: The County Engineer recently indicated that until the State Code is changed to be in compliance with last summer's Supreme Court ruling, City signature elements will be required on the plat - which is contrary to what the surveyor was told a few months ago. General Comments: 1.1.8 (2.) The corrected net density for Phase 4 is 3.0. 1.1.9 (8.) Delete the typo of "Two hundred-fifty and". Only 100- watt lights are required within the subdivision. ORDER OF CONDITIONAL APPROVAL OF FINAL PLAT FOR VIENNA WOODS NO. 4 (FP-00-028) - 3 1.2 Fire Chief, Kenny Bowers, requires that no-parking of vehicles, equipment and/or trailers will be allowed in the cul-de-sac. All common lots will need to be kept clear of trash and weeds. Road and street name signs will need to be constructed and installed before building is started. 1.3 The Central District Health Department requires after written approval from the appropriate entities are submitted, they can approve this proposal for central sewage and central water; that plans must be submitted to and approved by the Idaho Department of Health and Welfare, Division of Environmental Quality for central sewage and central water; that run-off is not to create a mosquito breeding problem; and it is suggested that stormwater be pretreated through a grassy swale prior to discharge to the subsurface to prevent impact to groundwater and surface water quality; that engineers and architects should obtain current best management practices for stormwater disposal and design a stormwater management system that is preventing groundwater and surface water degradation. The final plat upon which there is contained the Certification and signature of the City Clerk and the City Engineer verifying that the plat meets the City's requirements shall be signed only at such time as: a. The Plat dimensions are approved by the City Engineer; and b. The City Engineer has verified that all off-site improvements are completed and/or the appropriate letter of credit or cash has been ORDER OF CONDITIONAL APPROVAL OF FINAL PLAT FOR VIENNA WOODS NO. 4 (FP-00-028) - 4 issued guaranteeing the completion of off-site and required on-site improvements.
