procedure and incorporate our decision with your disposition of this request.

Application Procedure
Commission And Council Action

APPLICA TION PROCEDURE:
A. Application: Any property owner desiring to vacate an existing
subdivision, public right of way or easement shall complete and file
an application with the Administrator. These provisions shall not
apply to the widening of any street which is shown on the
Comprehensive Development Plan, or the dedication of streets,
rights of way or easements to be shown on a recorded subdivision.
B. Administrator Action: Upon receipt of the completed application, the
Administrator shall affix the date of application acceptance thereon.
The Administrator shall place the application on the agenda for
consideration at the next regular meeting of the Commission which is
held not less than fifteen (15) days after said date of acceptance.

COMMISSION AND COUNCIL ACTION:
A.
Commission Recommendation: The Commission shall review the
request and all agency responses and make a recommendation to
the Council for either approval, conditional approval, or denial.

B. Council Action:
1. Hearing; Notice: When considering an application for vacation
procedures, the Council shall establish a date for a public hearing
and give such public notice as required by law. The Council may
approve, deny or modify the application. Whenever public rights of

way or lands are vacated, the Council shall provide adjacent
property owners with a quit-claim deed for the vacated rights of way
in such proportions as are prescribed by law.

2. Street Improvements; Bond: When considering an application for
dedication procedures, the Council may approve, deny or modify the
application. When a dedication is approved, the required street
improvements shall be constructed or a bond furnished assuring the
construction, prior to acceptance of the dedication. To complete the
acceptance of any dedication of land, the owner shall furnish to the
Council a deed describing and conveying such lands to be recorded
with the County Recorder.

C. County Highway District Approval: Vacations and dedications of
rights of way for public streets must be in conformity with the policies
of, and approved by, the Ada County Highway District. (Ord. 430,

as a pornon of the 16 foot public alley of Block 5 of the Amended Plat of the Townsite of
Meridian as rued for record in the office ofthe Ada County Recorder, Boise, Idaho in Book 1 of
Plats at page 30 lying in the SW ~ of Section 7, T.3N., R.1E., B.M., Meridian, Ada County.
To Whom It May Concern:
The Ada County Highway District has received a petition from the adjacent property owners requesting the
vacation and abandonment of public rights-of-way as shown on the attached legal description.
The legal description and a drawing of the right-of-way that the Ada County Highway District has been
requested to consider for vacation and abandonment are enclosed. It is requested that you review the
enclosures and advise this office no later than May 10,2000 of your present use and future plans for this area,
including, but not limited to present/future bike/pedestrian pathways, city parks, future access to and from
properties and public rights-of-way, etc. Comments will be used to assist the Board of Commissioners of the
Ada County Highway District in the disposition of this request for the right.of-way vacation and abandonment
After their review and consideration, should the Board of Commissioners of the Ada County Highway District
elect to accept this petition and application for vacation, a public hearing will be tentatively scheduled for
Wednesday, June 14,2000 at 7:00 p.m., or as soon thereafter as the matter may be heard, in the auditorium
of the Ada County Highway District, 318 East 37th Street, Boise, Idaho.
Addressees having an inte:est in this right-of-way vacation will be advised of the disposition of the proceedin.gs
upon receipt of written request.

Dear Mr. Churella:
The City of Meridian presently has an eight (8) inch diameter sanitary sewer line beneath the surfu.ce of this
alley that carries sewage flow from east to west. A manhole is located just east of the east right of way line
ofE. 1 st Street. It is necessary for the City to continue use of this sewer line and in that regard we will
need to maintain a sixteen (16) foot wide sanitary sewer line easement through the length of the
proposed public right of way vacation.

NOTICE IS HEREBY GIVEN, that the Board of Commissioners of the Ada County Highway District will
hold a public hearing in accordance with the provisions of the Idaho Code, to consider the vacation and
abandonment of the following described public right-of-way:
Vacation:
A tract ofland being public right-of-way, more commonly known as a portion of the 16 foot
alley along the east side of 151 Street and between Idaho Avenue and Pine A venue in Meridian
described as follows:

A portion of the 16 foot public alley of Block 5 of the Amended Plat of the Townsite of
Meridian as filed for record in the office of the Ada County Recorder, Boise, Idaho in Book
1 of Plats at page 30 lying in the SW 1,4 of Section 7, T.3N., R.IE., B.M., Meridian, Ada
County, Idaho and more particularly described as follows:
BEGINNING at a point marking the Northwest comer of Lot I of said Block 5 of
the Amended Plat of the townsite of Meridian; thence along the West boundary of said public
alley
North 00057'31" East 16.00 feet to a point marking the Northwest comer of said
public alley; thence along the North boundary of said public alley
South 88020'26" East 85.87 feet to a point; thence leaving said North boundmy
South 00057'31" West 16.00 feet to a point on the South boundary of said public alley;
thence along said South boundmy
North 88020'26" West 85.87 feet to the POINT OF BEGINNING,
Said parcel ofland contains 1,374 square feet, more or less.
Subject to retention of public and private utility easements, drainage easements, irrigation easements and/or
other easements of record or not of record or in use upon or under said described public right of way and or
the provisions for relocation or replacement of existing facilities. Costs associated with relocation or
replacement of existing easements and facilities shall be borne by the applicant with approval of the applicable
utility of agency.
The public hearing will be held in the Office of the Ada County Highway District, 318 East 37m Street, Boise,
Idaho 83714, on Wednesday, June 14,2000, at 7:00 p.m., or as soon thereafter as the matter may be heard.
