Date: OS/24/00 Re: Generations Plaza - Alley Vacation Shari: I have reviewed ACHD comments on this proposed vacation. The direction of traffic flow through the existing City parking lot, as proposed by ACHD, is opposite to how the lot is designed. This proposed reversal would require: 1. Restriping of the parking spaces. 2. Changing of the planter curbing to match the direction of the parking spaces. 3. Changing of the entrance/exit signage. I wonder if the direction of the alley could be reversed so that the vehicle direction in the City lot can remain as is. I have previously corresponded to ACHD concerning the existence of a City sanitary sewer line in the alley and the need to maintain an easement width equal to the present dedicated alley width. As a side note, it is interesting to read ACHD's comment that E.1 st Street has a Level of Service (LOS) F, without this Generations project. Also, that the E.1 st/Pine intersection has a LOS 0, which qualifies it as one of 100 critical intersections in Ada County. These conditions shall be considered in full, unless expressly modified or deleted by motion of the Meridian City Council: GENERAL COMMENTS This alley vacation is associated with the Generations Park Plaza II Conditional Use Permit. The alley is 16 feet wide and the portion to be vacated is approximately 85 feet in length (more or less the depth ofthe site, extending to the public parking lot to the east). One-half of the alley (eight feet) would go to the subject property, the other half would revert back to the City of Meridian to be included as part of the expanded Generations Plaza. The Subdivision and Development Ordinance (Title 12), Chapter 10, only requires the Commission to review and make a recommendation on Vacation applications. A public hearing is only required before the City Council. SITE REQUIREMENTS 1. The City has an existing sewer main in this alley. If the vacation is approved, the applicant will be required to provide an easement to the City for maintenance of this line. The easement agreement shall include provisions that, should the sewer line need to be repaired, all costs to replace improvements on applicant's property will be borne by the applicant. 2. Prior to the issuance of any building permits on the subject lots, applicant must submit relinquishment of easement letters from all applicable utility companies to the City of Meridian. The property intersects E. 1st Street between Pine and Idaho Streets and is generally located at on the north side of Generations Plaza in Meridian, Idaho. 2. The owner of record of the subject property is Laneyland. 3. . The Applicant is Gary Benoit of Boise. 4. The subject property is currently zoned Old Town (OT). The zoning of OT is defined within the City of Meridian's Zoning and Development Ordinance Section 11-7 ~2 1. 5. The subject property is within the city limits of the City of Meridian. 6. The entire parcel of the property is included within the Meridian Urban Service Planning Area as the Urban Service Planning Area is defined in the Meridian Comprehensive Plan. 7. The Applicant requests the easement vacation to expand the site of the existing Generations Plaza. There are no significant or scenic features of major importance that affect the consideration of this application. 9. The applicant obtained notarized approval of the easement vacation from affected utilities. RECOMMENDATION 1. The Meridian Planning and Zoning Commission hereby recommends to the City Council of the City of Meridian that they approve the requested easement vacation as requested by the Applicant for the property described in the application. Please accept the following staff comments in regards to the alley vacation; (1. We support the alley vacation with the lll1derstanding that it primarily benefits the developer and they should be responsible for the improvements and maintenance of the alley. Especially since the Cities half of the alley is serving as the developers sidewalk. 2. There seems to be some confusion on the approved traffic flow through the Cities parking lot, the developers new parking lot and the existing alley. See attachments A, B, and C. If option A or B is adopted, the developer should be responsible for changes to the Cities parking lot including redirecting, parking space lines and islands. 3. The issue of who is paying A.C.H.D. the $10,400.00 value for the alley needs to be resolved. Originally, the developers were proposing to exchange an easement through their new parking lot for the value of the alley (see attachment A) and the City would, in turn, reimburse the developer for our half of the vacated alley. The City COWlcil suggested the developer pay for the Cities half since it is being used as the developers sidewalk. 4. After reviewing the alley traffic flow plans at the A.C.H.D. board meeting in August, it was suggested that the easement should be through the Cities parking lot on Pine Street.
