APPLICATION SUMMARY & BACKGROUND
The applicant, Clayton Jones, has requested approval of a conditional use permit for the construction
of a new Carl Jr's drive-through restaurant at the corner of Main St and Meridian Road. The
proposed restaurant would replace the existing building that used to house the Kentucky Fried
Chicken, located between the existing Taco BeU and the new A&WIKFC restaurants.
When the new A&WIKFC restaurant received approval fur their required conditional use pennit, one
of the conditions of approval was to abandon the drive-through use of the existing KFC building (File
No CUP-OI-021, FFICL 12.2, pg 5), but it makes no mention of prohibiting a new building with drive
though uses at this location.

The subject property is located near the northern corner of the intersection of Meridian Road, 1"
Street and Central Drive.

STANDARDS FOR CONDITIONAL USES
The Commission and Council shall review the particular facts and circumstances of each proposed
conditional use in terms of the fullowing and may approve a conditional use permit if they shall find
evidence presented at the hearing(s) is adequate to establish (11-17-3):
A. That the site is large enough to accommodate the proposed use and all yards, open
spaces, parking, landscaping and other features as may he required by this Ordinance;
Staff finds that the site is large enough to accommodate the required landscaping, yards
and other features required by the Zoning Ordinance.
The MCC (12-13-5) requires 1 parking space for each 200 square feet of restaurant floor
area, therefore 19 parking spaces are required per code, and the submitted site plan
contains 24 spaces. The handicap parking space provided on the site plan is van accessible
per ADA requirements.
B. That the proposed use and development plan will be harmonious with the Meridian
Comprehensive Plan and in accordance with the requirements of this Ordinauce;
The 93 'Comprehensive Plan Land Use Map (in effect at the time of submittal) designates the
property as "Existing Urban". Staff finds the proposed use is harmonious with the
Comprehensive Plan. Staff finds further that the proposed use is in compliance with the
Meridian City Code.
C. That the design, construction, operation, and maintenance will be compatible with
other uses in the general neighborhood and with the existing or intended character of
the general vicinity and that such use wiD not adversely change the essential character
of the same area;
Staff finds that the proposed use will be compatible with the other commercial and restaurant
uses found in the general vicinity of the subject property
The Council and Commission should consider public testimony when determining if the
proposed use will change the essential character of the area.
D. That the proposed use, if it complies with all conditions of the approval imposed, will
not adversely affect other property in the vicinity;
Staff does not anticipate that the proposed uses will have an adverse affect on the other

property in the vicinity, if designed, constructed, operated and maintained in accordance with
any conditions of approval and the City Ordinances.
The Council and Commission should rely upon public testimony to determine if the
development will adversely affect the other properties in the vicinity.
E. That the proposed use will be served adequately by essential public facilities and
services such as highways, street. police. and fire protection, drainage structures, refuse
disposal, water, sewer or that the person responsible for the establishment of proposed
conditional use shall be able to provide adequately any such services;
Staff finds that the proposed development will be adequately served by the essential public
facilities and services listed above.
F. That the proposed use will not create excessive additional requirements at public cost
for public facilities and services and wiD not be detrimental to the economic welfare of
the community;
Staff finds that the proposed use would not create additional requirements at public cost for
public facilities and service and will not be detrimental to the economic welfare of the
community.
G. That the proposed use will not involve activities or processes, materials, equipment, and
conditions of operation that will be detrimental to any persons, property, or general
welfare by reason of excessive production oftrame, noise, smoke. fumes, glare or odors;
Staff does not anticipate that the proposed use will be detrimental to the general welfare of
the community by means of increased traffic, noise, smoke fumes, glare or odors generated by
the uses.
H. That the proposed use will have vehicular approaches to the property which shaU be so
designed as not to create an interference with traffic on surrounding public streets;
Staff finds that the proposed use will not create any interference with any traffic on the
surrounding public streets
J, That the proposed use will not result in the destruction, loss or damage of a natural,
scenic or historic feature considered to be of major importance.
Staff finds that no natural or scenic feature will be lost, dan18ged or destroyed by issuance of
this conditional use.

SITE SPECIFIC REOUIREMENTS
1. All parking and areas of circulation shall be improved with a hard surface in accordance with
MCC 11-13-4.D, and shall be installed and striped in accordance with the submitted site plan,
ADA and MCC 11-13-4.F.
2. All exterior lighting, whether attached to the building or located within the parking lot, shall
be down-shielded or otherwise altered so that the light does not spill over onto adjacent
properties or right-of-way. All parking lot lighting shall be in accordance with Ordinance 11-
13-4C.
3. All signage shall be in accordance with the standards set forth in Section 11-14 of the City
Zoning and Development Ordinance. All signage is subject to design review and shall require
separate permits. Temporary or portable signs shall be prohibited, and shall be removed upon
3 days notice to the applicant.
4. All construction and site improvements shall conform to the requirements ofthe Americans
with Disabilities Act.
5. A drainage plan designed by a State ofIdaho licensed architect or engineer is required and
shall be submitted to the City Engineer (Ord. 557, 10-1-91) for all off-street parking areas.
Storm water treatment and disposal must be designed in accordance with Department of
Environmental Quality 1997 publication Catalog of Storm Water Best Management Practices
for Idaho Cities and Counties and City of Meridian standards and policies. Off-site disposal
into a surfuce water is prohibited unless the jurisdiction which has authority over the receiving
stream provides written authorization prior to development plan approval. The applicant is
responsible for filing all necessary applications with the Idaho Department of Water
Resources regarding Shallow Injection Wells.
6. Trash: The trash enclosure shall be enclosed on at least 3 sides by a solid wall or sight
obscuring fence at least four feet in height in accordance with Ordinance ll-12-1C.
Coordinate location and construction requirements with Sanitary Services, Inc.
7. Certificate of Occupancy: All required improvements must be complete prior 10 obtaining a
Certificate of Occupancy for the proposed development.. A temporary Certificate of
Occupancy may be obtained by providing surety to the City in the form of a letter of credit or
cash in the amount of 110010 of the cost of the required improvements (including paving,
striping, landscaping, and irrigation). A bid must accompany any request for temporary
occupancy. Any temporary occupancy will not exceed 60 days to complete the required
improvements.
8. As part of a conditional use pennit, the City of Meridian may impose additional
restrictions/conditions.

9. Water and sewer service locations to serve this proposed building were not shown on the
submitted site plan. The designer shall furnish the Public Works Department a new site plan
showing existing and proposed utility mains and service connection.
10. A Certificate of Zoning Compliance and a Building Permit shall be obtained prior to the start
of construction.
COMPREHENSIVE PLAN ANALYSIS
The 1993 Comprehensive Plan contains a variety of goals and policies relevant to this application.
The following sections most directly apply to the proposed project and are repeated here for the
Council and Commission's consideration during the hearing process.
Goal 3 is "to encourage the kind of economic growth and development which supplies employment
and economic self-sufficiency for existing and future residents, reduces the present reliance on Boise
and strengthens the City's ability to finance and implement public improvements, services, and its
open space character."
Goal 8 is "to establish compatible and efficient use of land through the use of innovative and
functional site design."
Economic Development
1.1 The City of Meridian shall make every effort to create a positive atmosphere that
encourages. . . commercial enterprises to locate in Meridian.
1.3 The character, site improvements and type of new commercial or industrial developments
should be harmonized with the natural environment and respect the unique needs and features
of each area.
RECOMMENDATION
Staff recognizes that the approval of this application will add additional traffic to this already busy
intersection; nevertheless, staff recommends approval of this application, with the aforementioned
findings and site specific requirements.

applicant is requesting conditional use approval to construct a drive-thru restaurant. This proposed
development is located on the comer of Meridian Road and East 1" Street. This development is
estimated to generate 1,786 additional vehicle trips per day (1,488 existing) based on the Institute of
Transportation Engineers Trip Generation Manual.

East 1" Street is improved with 5-traffic lanes, with no curb, gutter or sidewalk.
B. On June 11,2001, the District Planning and Development staff inspected this site and evaluated
the transportation system in the vicinity. On June 15,2001, the staff met as the District's
Technical Review Committee and reviewed the impacts of this proposed development on the
District's transportation system. The results of that analysis constitute the following Facts and
Findings and recommended Site Specific Requirements.
C. For the purposes of estimating daily trip generation and assessing impact fees for this project, the
proposed use ofthis development has been classified as Fast Food Restaurant with drive-thru
window. (Per the ITE Manual) The impact fee rate from the fee tables for this use is $6,108 per
thousand square feet of gross building area, based on the impact fee ordinance in effect at this
time. Note: This rate is provided for informational purposes only and shall not be
construed as an impact fee rate certification. The impact fee wiD be assessed at the time of
plans acceptance by District staff, and shall be based on the fee tables aud provisions of the
District's Impact Fee Ordinance in effect at that time.
D. The Meridian Road and East 1" Street intersection is currently in the ACHD Five-Year Work
Program for reconstruction in the fiscal year 2002.
E. The applicant should be required to construct a 5-foot wide concrete sidewalk on Meridian Road
and East 1" Street located 2-feet within the new right-of-way. Coordinate the location and
elevation ofthe sidewalk with District staff. Ifthe sidewalk meanders outside of the right-of-
way, the applicant should provide an easement for the sidewalk.

F. The applicant is proposing to utilize an existing shared driveway on Meridian Road at the north
property line. This driveway is located approximately 330-feet north of East 1" Street. This
driveway meets District policy and should be approved with this application.
G. The applicant is proposing to close the existing driveway on Meridian Road located
approximately 160- feet north of East I st Street. The applicant is proposing to construct a new
driveway on Meridian Road approximately 190- feet north of East 1" Street. District policy
requires driveways to offset controlled intersection a minimum of 440- feet for a full access
driveway and 220-feet for a right-in/right-out driveway. This driveway does not meet District
policy and should not be approved with this application.
H. The applicant is proposing to utilize an existing shared driveway on East 1" Street located on the
north property line approximately 300-feet north of Meridian Road. Because this driveway
serves several parcels, it should be approved with this application.
1. The applicant should replace unused curb cuts on Meridian Road and East 1 st Street with
standard curb, gutter and/or concrete sidewalk to match existing improvements.
J. The applicant should replace any damaged curb, gutter and/or sidewalk on Meridian Road and
East 1 st Street with new curb, gutter and/or concrete sidewalk to match existing improvements.
Segments to be replaced shall be determined by ACHD Construction Services staff. Contact
Construction Services at 387-6280 (with file number) for details.
K. Graveled driveways abutting public streets create maintenance problems due to gravel being
tracked onto the roadway. In accordance with District policy, the applicant should be required to
pave the driveways their full width and at least 30-feet into the site beyond the edge of pavement
of Meridian Road and East 1st Street and install pavement tapers with 15-foot radii abutting the
existing roadway edge.
L. The applicant should provide a recorded cross access easement among the parcels to the north for
access to the pub lie streets.
M. Utility street cuts in pavement less than five years old are not allowed unless approved in writing
by the District. Contact Construction Services at 387-6280 (with file numbers) for details.
N. Any existing irrigation facilities should be relocated outside ofthe right-of-way.
O. All utility relocation costs associated with improving street frontages abutting the site should be
borne by the developer.
P. Based on development patterns in this area and the resulting traffic generation, staff anticipates
that the transportation system will be adequate to accommodate additional traffic generated by
this proposed development with the requirements outlined within this report and once the East I"
Street and Meridian Road intersection has been reconstructed.
The following requirements are provided as conditions for approval:

Site Specific Requirements:
I. Dedicate 40-feet of right-of-way from the centerline of Meridian Road abutting the parcel by
means of recordation of a final subdivision plat or execution of a warranty deed prior to
issuance of a building permit (or other required permits), whichever occurs first. Allow up to
30 business days to process the right-of-way dedication after receipt of all requested material.
The owner will be paid the fair market value of the right-of-way dedicated which is an addition
to existing ACHD right-of-way if the owner submits a letter of application to the impact fee
administrator prior to breaking ground, in accordance with Section 15 of ACHD Ordinance
#193. The right-of-way purchase agreement must be completed and signed by the applicant
prior to scheduling the final plat for signature by the ACHD Commission.
2. Road Trust for a 5-foot wide detached concrete sidewalk on Meridian Road and East I't Street
located 2-feet within the new right-of-way. Coordinate the location and elevation of the
sidewalk with District staff. If the sidewalk meanders outside of the right-of-way, provide an
easement for the sidewalk.
3. The existing shared driveway on Meridian Road located approximately 330-feet north of East
I" Street is approved with this application.
4. Close the existing driveway on Meridian Road located approximately 160-feet north of East I"
Street, as proposed.
The applicant is proposing to relocate the driveway on Meridian Road approximately 190-feet

13. Other than the access points specifically approved with this application, direct lot or parcel
access to Meridian Road and East I" Street is prohibited.
Standard Requirements:
1. A request for modification, variance or waiver of any requirement or policy outlined herein
shall be made in writing to the ACHD Planning and Development Supervisor. The request
shall specifically identifY each requirement to be reconsidered and include a written explanation
of why such a requirement would result in a substantial hardship or inequity. The written
request shall be submitted to the District no later than 9:00 a.m. on the day scheduled for
ACHD Commission action. Those items shall be rescheduled for discussion with the
Commission on the next available meeting agenda.
Requests submitted to the District after 9:00 a.m. on the day scheduled for Commission action
do not provide sufficient time for District staff to remove the item from the consent agenda and
report to the Commission regarding the requested modification, variance or waiver. Those
items will be acted on by the Commission unless removed from the agenda by the Commission.
2. After ACHD Commission action, any request for reconsideration of the Commission's action
shall be made in writing to the Planning and Development Supervisor within six days of the
action and shall include a minimum fee of$110.00. The request for reconsideration shall
specifically identifY each requirement to be reconsidered and include written documentation of
data that was not available to the Commission at the time of its original decision. The request
for reconsideration will be heard by the District Commission at the next regular meeting of the
Commission. If the Commission agrees to reconsider the action, the applicant will be notified
of the date and time of the Commission meeting at which the reconsideration will be heard.
3. Payment of applicable road impact fees are required prior to building construction in
accordance with Ordinance #193, also !mown as Ada County Highway District Road Impact
Fee Ordinance.
4. All design and construction shall be in accordance with the Ada County Highway District
Policy Manual, ISPWC Standards and approved supplements, Construction Services

procedures and all applicable ACHD Ordinances unless specifically waived herein. An
engineer registered in the State ofIdaho shall prepare and certify all improvement plans.
5. The applicant shall submit revised plans for staff approval, prior to issuance of building permit
(or other required permits), which incorporates any required design changes.
6. Construction, use and property development shall be in conformance with all applicable
requirements of the Ada County Highway District prior to District approval for occupancy.
7. It is the responsibility of the applicant to verifY all existing utilities within the right-of-way.
Existing utilities damaged by the applicant shall be repaired by the applicant at no cost to
ACHD. The applicant shall be required to call DIGLINE (1-800-342-1585) at least two full
business days prior to breaking ground within ACHD right-of-way. The applicant shall contact
ACHD Traffic Operations 387-6190 in the event any ACHD conduits (spare or filled) are
compromised during any phase of construction.
8. No change in the terms and conditions of this approval shall be valid unless they are in writing
and signed by the applicant or the applicant's authorized representative and an authorized
representative of the Ada County Highway District. The burden shall be upon the applicant to
obtain written confirmation of any change from the Ada County Highway District.
9. Any change by the applicant in the planned use of the property which is the subject of this
application, shall require the applicant to comply with all rules, regulations, ordinances, plans,
or other regulatory and legal restrictions in force at the time the applicant or its successors in
interest advises the Highway District of its intent to change the planned use ofthe subject
property unless a waiver/variance of said requirements or other legal relief is granted pursuant
to the law in effect at the time the change in use is sought.
Conclusion of Law:
I. ACHD requirements are intended to assure that the proposed use/development will not place an
undue burden on the existing vehicular and pedestrian transportation system within the vicinity
impacted by the proposed development.

STORM WATER MANAGEMENT RECOMMENDATIONS
It is recommended that storm water be pre-treated through a grassy swale
prior to discharge to the subsurface to prevent impact to ground water and
surface water quality. The engineers and architects involved with the design
of this project should obtain current best management practices for storm
water disposal and design a storm water management system that is
preventing groundwater and surface water degradation. Manuals that could
be used for guidance are:

Enclosed please find a Land Use Change Application for your use to file with the Irrigation
District for its review on the above-referenced development. If this development is under a
"rush" to be finalized, I would recommend that you submit a cashier's check, money order or
cash as payment of the fees in order to speed the process up. If you submit a company or
personal check, it must clear the bank before processing the application.
Should this development be planning a pressure urban irrigation system that will be owned,
operated and maintained by the Irrigation District, I strongly urge you to coordinate with John P.
Anderson, Water Superintendent for the Irrigation District, concerning the installation of the
pressure system. Enclosed is a questionnaire that you must fill out and return in order to initiate
the process of contractual agreements between the owner or developer and the Irrigation
District for the ownership, operation and maintenance of the pressure urban irrigation system.

NOTICE IS HEREBY GIVEN pursuant to the Ordinances of the City of Meridian
and the Laws of the State of Idaho, that the Meridian Planning and Zoning Commission
of the City of Meridian will hold a public hearing at the Meridian City Hall, 33 East Idaho
Avenue, Meridian, Idaho, at the hour of 7:00 p.m. on October 3, 2002, for the purpose
of reviewing and considering the application of Clayton Jones in a request for
Conditional Use Permit for a 3817 square foot Carl's Jr. restaurant with a drive-thru in
a C-G zone, generally located on South Main Street (formerly East 1st Street), north of
the Meridian Road and Main Street intersection.
A more particular description of the above property is on file in the City Clerk's
office at Meridian City Hall, 33 East Idaho Avenue, and is available for inspection during
regular business hours, Monday through Friday, from 8:00 a.m. to 5:00 p.m.
A copy of the application is available upon request. Any and all interested
persons shall be heard at said public hearing, and the public is welcome and invited to
submit testimony. Oral testimony may be limited to three (3) minutes per person.
Written materials may be submitted seven (7) days prior to the above hearing date so
that all interested parties may examine them prior to the hearing. All materials
presented at public meetings shall become property of the City of Meridian. Anyone
desiring accommodation for disabilities related to documents and/or hearings, please
contact the City Clerk's Office at 888-4433 at least 72 hours prior to the public meeting.
