Thank you, Councilwoman Strader, Mr. and Mrs. Gardner. I appreciate you sharing your concerns with the City, and for
this opportunity to respond to a potential fast-food restaurant in your neighborhood.
At this time the City does not have an application for you to officially review and comment on. We are, however,
meeting with restaurant representatives next week to discuss the potential for them to develop an In N Out near
Chinden/Ten Mile. I can also share with you that you are not the only ones to express concern; City Staff share similar
concerns to the ones you’ve noted below. Staff plan to let the developer know next week when we meet with them that
there will likely be substantial neighborhood opposition, and Staff concerns, if they plan to move forward with an
application for a drive-through at the location near Costco.
Should they choose to move forward, the application they would need to file with the City is called a Conditional Use
Permit (CUP). A CUP application is subject to a public hearing. I would encourage you to keep an ear/eye out; the
applicant will need to hold a neighborhood meeting prior to submitting the CUP application to the City and the City will
send postcards to property owners within 500’ of the site prior to the public hearing if the restaurant chooses to move

Thank you for reaching out to me. I am not certain if the in and out burger will be coming back before the city
as part of a development modification or if it is being built within the existing concept of an already approved

development. That will determine what input the city has (if any) as to the plans for this area of 10 mile. I am

Dear Ms. Strader
As residents of Meridian who live near the Costco on Ten Mile, we would like to extend
our disapproval of the building of an In and Out Burger on Ten Mile. Apart from the traffic congestion
that it will create, Meridian already has far too many fast food establishments, to the point that we and
many of our friends have unfortunately nicknamed our city, the City of Fast Food. This is not what we
want for our city. We need healthier local-flavored restaurants in Meridian.

Good Morning Mr. and Mrs. Gardner,
I know you didn’t specifically request this information however, I hope it explains the process in which to develop the
proposed use. You are not the only person who has shared the traffic concern which I believe is valid. This business is
defined as a restaurant with a drive-through in City code, which requires the approval of a conditional use permit. At this
time the City doesn’t have an official application for this project. The developer has requested a pre-application meeting
with the City to discuss this as a possible location for a second In-n-Out restaurant. This is typically the first step in the
process. At the meeting we will be discussing City requirements for developing the property. Part of the discussion will
include how they propose to mitigate issues with the traffic, site circulation, and vehicle stacking in the drive-through.
The developer will also be required to hold a neighborhood meeting prior to submitting the application. If you are within
500 of the property boundary you should receive notification of the meeting. This meeting allows the developer to
inform citizens about their development and solicit any citizen feedback. It is the City’s hope the developer will adjust
plans to address any comments received during this meeting. When these two meetings are concluded, the developer
can officially submit the application. This can occur as quickly as 10 days after the neighborhood meeting is held. Once
the application is submitted it is routed to the various City departments for review. If all application items are submitted
and department reviews complete, the application is deemed complete and scheduled for a public hearing. City code
requires the City to publish hearing level applications in the paper, send notification to all property owners within 500
feet of the project boundary and posting the site with a public hearing sign 10 days prior to the public hearing. During
this time the public has the ability to provide written or verbal testimony on the project. The City tries to be transparent
in our application process so you do have the ability to review all documents associated for this project if/when they
become available. I have provided you with two links to help in this effort: the first explains how to access our various
