Cherry Lane City of Meridian City Clerk OfficE'; The Ada County Highway District (ACHD) staff has received and reviewed the application and site plan for the item referenced above and is submitting this no review letter in response to the lead agency's request for comment. Based on the submitted information, it has been determined that the proposed development will generate less than 10 additional vehicle trips per day (VTD); or improvements exist adjacent to the site and ACHD has no site improvement requirements attributable to this application. ACHD policy states that no site related improvements will be required for developments generating less than 10 additional VTD. If the site plan or use changes in such a manner that more than 10 additional vehicle trips per day are generated, then ACHD will review the site plan and may issue requirements based on the ACHD Policy Manual. ACHD policy requires that before any improvements of any kind are constructed or installed within the public right-of- way, a permit or license agreement permitting the improvements must be obtained. All future design plans and construction shall be in accordance with the Ada County Highway District Policy Manual, ISPWC Standards and approved supplements, Construction Services procedures and all applicable ACHD Ordinances unless specifically waived in writing by the District. Cherry Lane from the current R-4 zone to L-O. The current zoning ofR-4 makes the church a non-conforming use--churches are prohibited in the R-4 zone, but the Cherry Lane Christian Church has been on the site for many years and has "grandfather rights". The requested rezone would clean up the situation, as churches are permitted in the L-O zone. The applicant is also requesting a Conditional Use Permit for a preschooi and future private school. Existing classrooms wouid be used for preschool/private school use. Private schools are prohibited in the current R-4 zone, but are a conditional use in the L-O zone. Other proposed improvements to the site include an enclosed tot lot addition, two lobby expansions, and a library/storage expansion. A revised site pian, dated 9-13-02, also proposes a parking lot expansion to the east, on property currently owned by Nampa Meridian Inigation District (NMID) for the Nine Miie Creek. The applicant is proposing to tile the creek and add two rows of parking with landscaping. The applicant has submitted a letter from NMID stating that they ''would consider conceptually" the proposal. The appiicant is also showing an 8-foot wide asphalt pathway in the 20-foot buffer east of the parking lot. The address is 2511 W. Cherry Lane. SURROUNDING PROPERTIES North - Single-family homes (Sunnybrook Farms Subdivision) zoned R-4. South - Singie-family residences (Haven Cove Subdivision) zoned R-4. East - Singie-famiiy residences (The Vineyards Subdivision) zoned R-4. West - Singie-family residences (Haven Cove Subdivision) zoned R-4. STANDARDS FOR ZONING AMENDMENT The Commission and Council shall review the particuiar facts and circumstances of each proposed zoning amendment in terms of the following standards and shall find adequate evidence answering the following questions about the proposed zoning amendment (11-15-11): A. Will the new zoning be harmonious with and in accordance with the Comprehensive Plan and, if not, has there been an application for a Comprehensive plan amendment; Staff finds that the application was filed on 8/1/02, just prior to the adoption of the new Comprehensive Plan, and is therefore technically under the policies of the 1993 Comprehensive Pian. The 1993 Comprehensive Plan designates the subject property as "Existing Urban". The new Comprehensive Pian designates the property as "Public/Quasi-Public", Churches are a quasi-public use. The requested L-Q zoning is harmonious with both the "Existing Urban" and "Public/Quasi-Public" designations and is in accordance with the overali goals and policies of the Comprehensive Plan. B. Is the area included in the zoning amendment intended to be re-zoned in the future; Staff finds that the proposed zoning amendment complies with the intended zone(s) supported by the Future Land Use Map. The property is not intended for another rezone in the future, C. Has there been a change in the area or adjacent areas which may dictate that the area should be rezoned; The existing legal, non-conforming status of the church suggests that it may be appropriate to rezone the area to make those it a legal, conforming use. The proposed rezone would have such an effect on the church property. E. Will the proposed uses be designed, constructed, operated and maintained to be harmonious and appropriate in appearance with the existing or intended character of the general vicinity and that such use will not change the essential character of the same area; Staff finds that the existing church use is appropriate and harmonious with the existing area and that it will not change the essential character of the general vicinity (as it has been there for many years), Any other uses, such as the proposed preschool/private school, could be harmonious with the existing and intended character of the same area, if constructed and operated appropriateiy. Any uses other than the church use will require zoning approval, as determined by the Scheduie of Use Controi in the City's Zoning Ordinance. F. Will not be hazardous or disturbing to existing or future neighboring uses; Staff finds that the re-zone to loO shouid not be disturbing to existing or future neighboring uses. The Commission and Council should carefully consider all public testimony before making this finding. G. Will be served adequately by essential pnblic facilities and services such as highways, street, police, and tire protection, drainage structures, refuse disposal, water, sewer or that the person responsible for the establishment of proposed conditional use shall be able to provide adequately any such service; Staff finds that the proposed uses will be acIequateiy served by all essential public services and facilities. H. Will not create excessive additional requirements at public cost for public facilities and services and will not be detrimental to the economic welfare of the community; Staff finds that the requested uses will not create excessive additional requirements at public costs for public facilities and services. Additionally, staff finds that the proposed rezone would not be detrimentai to the economic welfare of the community. Will not involve uses, activities, processes, materials, equipment, and conditions that will be detrimental to any persons, property, or general welfare by reason of excessive production of traffic, noise, smoke, fumes; glare or odors; Staff finds that any proposed L-O zoned property will not involve uses, activities, processes, materials, equipment, and conditions that are detrimentai to the general welfare of the community. J. Will have vehicular approaches to the property which shall be so designed as not to create an interference with traffic on surrounding public streets; Staff finds that the proposed use will not interfere with general traffic patterns on any public streets. ACHD has stated that the project is expected to generate less than 10 new vehicle trips per day on surrounding streets. School drop-off/pickup vehicle trips are considered by ACHD as "pass-by" traffic that is likely to have already been on the roads anyway, and are therefore not considered to be adding congestion. K. Will not result in the destruction, loss or damage of a natural or scenic feature of major importance. Staff does not find that any natural or scenic feature will be lost, damaged or destroyed by approval of this rezone. Nine Mile Creek runs adjacent to the subject property and will not necessariiy be affected by the rezone, but may be affected by the accompanying Conditional Use Permit (CUP) if the creek is piped. This issue will be explored in greater detail under the findings for the CUP. L. Is the proposed zoning amendment in the best interest of the City; Staff finds that the zoning amendment wouid be in the best interest of the City by bringing an existing non-conforming use into conforming status. SITE SPECIFIC COMMENTS 1. The legal description submitted with the application is accurate and meets the requirements of the City of Meridian and State Tax Commission. 2. Staff has determined that the rezone request would meet each of the twelve (12) Findings required by Ordinance 11-15-11. 3. If rezoned to L-O, the subject iot would conform to the minimum lot size and minimum frontage of the zone. 4. The existing site does not conform to all of the current standards of the Landscape Ordinance, specifically the required buffer between land uses parking lot iandscaping RZ-02..Q03 Cheny Lane Cltristitln Churoh.RZ.CUP Mayor and Council September 27, 2002 Page 5 requirements. Staff recommends that the site rwt be required to come into full compliance until such time as the parking lot is significantly modified per Ordinance 12-13-11-4. 5. The existing freestanding sign is out of compliance with the City's Sign Ordinance for the proposed L-O zone. Staff recommends that the sign be granted iegal, nonconforming status and subject to the provisions of Ordinance 11-14-8.B for legal, nonconforming signs. 6. Any assessments or re-assessments for sewer and water service for any new uses will be determined during the Certificate of Occupancy process. SITE SPECIFIC CONDITIONS Sta.ffrecommends the following be made conditions of the Rezone: I. The existing parking iot landscaping will be subject to ordinance 12-13-11-4 and upgraded to meet current standards upon any significant parking lot repiacement per said ordinance. 2. The existing sign shall be granted iegal, non-conforming status and become subject to the provisions of ordinance 11-14-8.B. STANDARD REZONE CONDmONS 1. Remove any existing domestic wells and/or septic systems within this project from their domestic service per City Ordinance. Wells may be used for non-domestic purposes such as landscape irrigation. 2. All signage in the proposed project shall be in accordance with the standards set forth in Section 11-14 of the City of Meridian Zoning and Development Ordinance. 3. Provide off-street parking in accordance with the City of Meridian Ordinance 11-13 for use of property. 4. All construction shali conform to the requirements of the Americans with Disabilities Act. STANDARDS FOR CONDmONAL USES The Commission and Councii shall review the particuiar facts and circumstances of each proposed conditional use in terms of the following and may approve a conditional use permit if they shall find evidence presented at the hearing(s) is adequate to establish (11- 17-3): A. That the proposed use and development plan will be harmonious with the Meridian Comprehensive Plan and in accordance with the requirements of this Ordinance; The 1993 Comprehensive Pian shows the subject property as "Existing Urban"; the current Comprehensive Plan shows the property as "Public/Quasi-Public". Proposed zoning is L-O; private schoois require a CUP in the L-O zone according to the Zoning Scheduie of Use Control. Staff finds the proposed use and plan to be in Compliance with the Meridian Zoning Ordinance and the Comprehensive Plan, as long as the conditions of the staff report are met. C. That the design, construction, operation, and maintenance will be compatible with other uses in the general neighborhood and with the existing or intended character of the general vicinity and that such use will not adversely change the essential character of the same area; Staff finds that the proposed deveiopment will not adversely change the essential character of the general vicinity and will be harmonious with the intended character of the same area. D. That the proposed use, if it complies with all conditions of the approval imposed, will not adversely affect other property in the vicinity; Staff does not believe the proposed use will adversely affect other property in the vicinity. The Council and Commission shouid consider all public testimony before making this finding. E. That the proposed use will be served adequately by essential public facilities and services such as highways, street, police, and fire protection, drainage structures, refuse disposal, water, sewer or that the person responsible for the establishment of proposed conditional use shall be able to provide adequately any such services; Staff finds that the proposed development will be adequately served by the essential public facilities and services listed above. F. That the proposed use will not create excessive additional requirements at public cost for public facilities and services and will not be detrimental to the economic welfare of the community; RZ-02-003 Cheny Lane Cbristian Church..RZ.CUP Mayor and Council September 27, 2002 Page 7 Staff finds that the proposed use would not be detrimental to the economic welfare of the community, nor would it create the need for any new faciiities or services to be paid for by the public. G. That the proposed use will not involve activities or processes, materials, equipment, and conditions of operation that will be detrimental to any persons, property, or general welfare by reason of excessive production of traffic, noise, smoke, fumes, glare or odors; Staff does not anticipate that the proposed use wili be detrimental to the general welfare of the community by means of increased traffic, noise, smoke fumes, glare or odors generated by the use. ACHD has stated that the project is expected to generate less than 10 new vehicle trips per day on surrounding streets. School drop-ofl7pickup vehicle trips are considered by ACHD as "pass-by" traffic that is likely to have already been on the roads anyway, and are therefore not considered to be adding congestion. H. That the proposed use will have vehicular approaches to the property which shall be so designed as not to create an interference with traffic on surrounding public streets; Staff finds that the proposed use will not create significant interference with traffic on the surrounding public streets. The appiicant has not proposed any new curb cuts onto existing streets. I. That the proposed use will not result in the destruction, loss or damage of a natural, scenic or historic feature considered to be of major importance. Staff finds that a natural or scenic feature may be lost, damaged or destroyed by issuance of this conditional use. The revised appiication proposes to pipe the Nine Mile Creek and add a parking lot expansion, iandscape buffer, and pathway over the top of it. The 1993 Comprehensive Plan states the following policies: 3.l.b. (page 61): Play a major role in conserving area scenic and natural values, especialiy waterways, drainageways, and natural habitat. 5.3 (page 63): Any fish, wildlife, and vegetation species and habitat should be protected and maintained along... Nine Mile Creek. . . provided it is in the best interests of the City of Meridian. . . . 1.8 (page 71): The appearance of natural creeks (Five Mile, Nine Mile, Ten Miie, and South Siough) throughout commercial activity centers... [and] residential areas...should be improved and harmonized with adjoining land uses in order to protect water quality of the streams.. .as well as to enhance their environmentai amenities. RZ-02~O) Cheny Lane Christian CbUICh.RZ.CUP Mayor and Council September 27, 2002 Page 8 The new 2002 Comprehensive Plan expands the same policies with simiiar statements: Objective A.I (page 39) states "Preserve and conserve our waterways, wetlands, wildlife habitat, and other natural resources. Action item 11 (page 39) states that the City is to "Improve and protect creeks (Five Mile, Eight Miie, Nine Mile, Ten Mile, South Slough, and Jackson and Evans drainages) throughout commercial, industrial and residential areas. Therefore, the Commission and Council need to consider the facts, policies, and testimony at the hearing to determine if preserving the Nine Mile Creek as an open waterway is in the best interest of the City. SPECIAL CONSIDERA nONS The following items are special issues with the project that warrant discussion with the Commission and/or Council. 1. Piping of Nine Mile Creek: As described above, the applicant is proposing to pipe the Nine Mile Creek adjacent to the subject property. Nampa Meridian Irrigation District (NMID) is the titled owner of the property where the proposed piping and parking lot expansion would occur. NMID has stated that they "would consider conceptually" the proposal, but it is not yet ciear whether they would permit the landscaping as proposed. The Comprehensive Plan contains several policies that would support a requirement to ieave the creek open. The Commission and Councii need to determine if it is in the best interest of the City to leave it open or to allow it to be piped. 2, Sanitary Sewer Trunk: The City of Meridian owns and maintains a 21-inch diameter sewer trunk line that parallels the Nme Mile Creek. This trunk line is within a 20-foot wide easement along the east side of Nine Mile Creek, Access must be maintained to this line at all times. Landscaping (trees) will be limited within the easement area. 3. Pathwav: The 1993 Comprehensive Plan did not specifically require a pathway along Nine Mile Creek. The 2002 Comprehensive Plan does require a pathway. The applicant is proposing an 8-foot wide pathway within the required 20-foot bUffer between land uses as a compromise "good faith effort" to meet the intended direction of the new Comprehensive Plan. The Parks Department's standard requirement is for a lO-foot wide pathway. Staff recommends making a condition of approval to provide the lO-foot wide pathway. To avoid crowding the proposed landscaping, staff recommends redesigning the parking lot to include 17-foot deep parking stalls (allowing for a 2-foot overhang) and a 25-foot drive aisle (it is currently over 28 feet wide). This would provide an additional 5 feet to the iandscape buffer (IS landscaping and 10 foot pathway). Of course, if the creek remains oz."..., CberIy ~ CbriJtim ChmdLRl..CUP Mayor and Council September 27,2002 Page 9 unpiped and the parking iot is not expanded, there wouid be no crowding caused by widening the pathway 2 feet. 4. Number of Students: The application does not state an enrollment cap for the number of students anticipated at the site. In a conversation with the applicant, staff has learned that they have two classrooms designed for preschool use and intend to have a maximum of 14 students per classroom. They also intend to start with just a morning session, but may add an afternoon session in the future. Based on this information, staff recommends verifying these figures with the applicant during the hearing and capping the enrollment at 56 students-28 morning and 28 afternoon. 5. Future Private School: The applicant also wishes to make their intent known to add other grades in the future, i.e kindergarten, first grade, etc. These future grades may be several years away before they are actualiy implemented, The Commission and Council may wish to require a separate CUP approval for the private school for the higher grades when the church is actuaIiy ready to do it. Staff was toid the church currently has 5 smaiier ciassrooms avaiiable for the future grades. Another option is that the Commission and Council could approve the future use as part of this CUP and simply require that the applicant submit for a Certificate of Zoning Compiiance (CZC) to verify parking and occupancy requirements. 6. Buffer Between Land Uses: Along the west property line, there is a 5-foot +/- planting strip that currentiy contains nothing but lava rock. Staff recommends a condition of approval to add one tree per 35 lineal feet in that existing planter and remove lava rock per requirement #2 below. No other improvements will be required to the existing parking iot iandscaping at this time. The landscaping will be subject to ordinance 12-13- 11-4 and upgraded to meet current standards upon any significant parking iot repiacement per said ordinance, SITE SPECIFIC REOUlREMENTS 1. Parking Lot Exoansion: Option A-- The proposed parking expansion is denied based on Comprehensive Plan policies that support protection of the natural creeks and waterways in the City. It is in the best interest of the City to preserve the open space and habitat provided by the Nine Miie Creek. Option B-It is in the best interest of the City to allow piping of the Nine Mile Creek and approve the proposed parking iot expansion. The proposed parking lot shall be designed with 9x17 spaces and a 25-foot drive aisle. There shall be no more than 12 spaces in a row without a landscape planter per City Ordinance. 2. Existing Parking Lot: add one tree per 35 lineal feet in the existing planter on the west side of the property. Also, replace the lava rock in said planter with vegetation--i.e. RZ-02..Q(I.) Street Buffer: A 25-foot wide, minimum, landscape buffer shall be required aiong Cherry Lane. 4. Pathway: A 10-foot wide asphalt path shall be required along the Nine Mile Creek. 5. Number of Students: Enrollment for the preschooi use shall be restricted to 56 students-28 morning and 28 afternoon. 6. Future Private School: Option A: Prior to enrollment of students for kindergarten or higher, the applicant shall be required to obtain separate CUP approval as a private elementary school. Option B: Appiicant shall be required to obtain ,a Certificate of Zoning Compliance (CZC) from P&Z staff prior to adding any additional grades beyond the approved pre- school use. 7. Water/sewer: This facility is currently served by the City of Meridian's sanitary sewer and water systems. Existing sanitary sewer and water assessments will compared with the anticipated impact, to determine whether additional assessments are warranted. If additionai assessments are warranted, applicant shall pay for them with the issuance of the building permit. The City of Meridian owns and maintains a 21-inch diameter sewer trunk line that paraliels the Nine Miie Creek. This trunk line is within a 20-foot wide easement along the east side of Nine Mile Creek, Access must be maintained to this line at ali times. Landscaping will be iimited within the easement area. Please show the iocation of the existing 21-inch sewer trunk line, and limits of the existing easement, on the sitellandscaping pians at least ten days prior to the City Council hearing for the requested CUPlRezone . STANDARD REOUIREMENTS 1. Existing trees shall be protected and retained in accordance with Meridian City Code 12- 13-13. 2. Off-street parking shali be provided in accordance with the City of Meridian Zoning and Deveiopment Ordinance andlor as detaiied in site-specific requirements. All parking and areas of circulation shali be improved with a hard surface in accordance with Meridian City Code 11-13-4.D, and shall be installed and striped in accordance with the approved site plan and Ordinance 11-13-4.F. 3. A drainage pian designed by a State of Idaho licensed architect or engineer is required and shall be submitted to the City Engineer (Ord. 557, 10-1-91) for all off-street parking areas. All drainage water is to be maintained on-site. Stonn water treatment and disposai must be designed in accordance with Department of Environmental Quality 1997 publication Catalog of Stonn Water Best Management Practices for Idaho Cities and Counties and City of Meridian standards and policies. Off-site disposal into surface water is prohibited unless the jurisdiction which has authority over the receiving stream provides written authorization prior to deveiopment pian approval. The applicant is responsible for fiiing ali necessary applications with the Idaho Department of Water Resources regarding Shaliow Injection Wells. 5. All exterior lighting, whether attached to the building or iocated within the parking lot, shall be down-shieided or otherwise altered so that the iight does not spill over onto adjacent properties or right-of-way. All parking iot lighting shall be in accordance with Ordinance 11-13-4.C. 6. All signage shall be in accordance with the standards set forth in Section 11-14 of the City loning and Deveiopment Ordinance or as specificaliy approved. All signage is subj ect to design review and shali require separate permits. 7. Provide five-foot-wide pedestrian walkways in accordance with City Ordinance. 8. Screen trash areas on at least three (3) sides. Coordinate screened trash enclosure locations and construction requirements with Sanitary Service Company and provide a letter of approval from their office when applying for a Certificate of Zoning Compliance (ClC). 9. Per Ordinance 11-17-4.B" a conditional use pennit, when granted, shall be valid for a maximum period of eighteen (18) months unless otherwise approved by the City Council. During this time, the permit holder must acquire building permits and commence the construction of permanent footings or structures. Time extensions are allowed per the ordinance. RECOMMENDATION Staff recommends approval of the project with the conditions stated in this staff report and upon satisfactory resoiution of the issues mentioned, including piping of Nine Miie Creek, Pathway width, number of students, process for kindergarten or higher, and the buffer between land uses.
