RIGHT OF WAY EASEMENT
This indenture, made and entered into this J/ day of
197/, by and between HARLEY F. SMITH and MARTHA SMITH, husband and wife, of
Meridian, Idaho, as grantors and the City of Meridian, Ada County, Idaho,
a municipal corporation, as grantee, W I T N E S S E D :-
WHEREAS, the said grantors are the owner in fee simple of a parcel of
land lying and being within the corporate limits of said City of Meridian, Ada
County, Idaho, particularly described as follows:
The South 5 feet of the North 90 feet and the North 5 feet of the South 90
feet of the following described property:
The North 180 feet of the East 132.25 feet of Lot 1, Except the East 30 feet
thereof, all in Block 9, NIDAY'S ADDITION TO MERIDIAN, according to the official
plat thereof, filed in Book 2 of Plats at Page 75, records of Ada County, Idaho,
SAVE AND EXCEPT the Westerly 5 feet thereof.
AND WHEREAS, the grantees herein desire to construct a pipe line for
conveying sewage upon and across the above described land in connection with
additional sewer lines and sewage treatment plat authorized by bond election in
said city held August 30, 1955.
THEREFORE, in consideration of the sum of One Dollar ($1.00) lawful money
f the United States and other, good and valuable consideration in hand paid,
e receipt for which is hereby acknowledged, the undersigned, HARLEY F. SMITH
d MARTHA SMITH, do hereby give and grant the City of Meridian, its successors,
d assigns forever, the right to lay, maintain, operate, use, repair and remove
certain pipe line for conveying sewage through, over and across the above des-
cribed real property for the purpose aforesaid.
Said pipe and pipe line shall be laid under the surface of the ground
and the soil around the same shall be packed reasonably level with the surface
if the ground.
The grantees shall at all times have full and free access to the right of
for said pipe line for any necessary purpose connected with the use, opera-
tion, repair and enjoyment of said pipe line, and shall have full and free
ccess at all times through its agents, servants and employees, to and across the
ve described lands of the grantors for all purposes connected with this ease -

This easement and the considerations paid thereunder are agreed by the
undersigned grantors to be in full settlement of all damages which in an
or manner may be sustained by reason of the installation, construction r way
pair, use and occupancy of the said pipe line thru and across the within d
lands of the said grantors, except as herein specifically stated. described
