Dear Jane: UDC 11-2B-3 requires a 25-foot landscape buffer to residential uses in the C-G Zorung District. However, UDC ll-5B-5 allows the City to provide for alternative means to certain standard development regulations, including landscape requirements, In granting such requests, the City typically requires specific improvements to be made, ensuring that the intent of the regulation being altered is maintained. The City [mds that the proposed design includes features that promote walkable, mixed use neighborhoods. Therefore, I am grantitig approval of a 6-foot tall vinyl fence (including two access point gates) with landscaping between the interior, southern boundary of the C-C and northern boundary of the TN-R of the Harks Canyon Creek Subdivision, located at 1845 W. Franklin Road. To meet the intent of the Alternative Compliance section of the UDC, this approval is valid only for the 370-foot (plus or minus) linear section between the C-C and TN-R zones and nowhere else on site, and is subject to the following provisions: 1) The fence shall be placed on the subjeCt portion of the property and not within any right-of-way; , 2) Per UDC 11-3B-9C-lc: at least one tree per 35 lineal feet, plus shrubs, lawn or other vegetative groundcover shall be planted on either side of the subject fence; 3) A separate building pennit for the subject fence shall be obtained from the Meridian Building Department. Watertower Lane, Suite 202 Meridi~ ID 83642 Subject: Harks Canyon Creek Subdivision - AZ 05-056/PP 05-058/CUP 05 051 Alternative Compliance for Landscaping Dear Jennifer: The approval of the subject development project included conditions of approval that required submittal of a revised landscape plan and an application for alternative compliance for administrative review (see conditions 1.5, 1.6 and 1.14). ' Briefly, the alternative compliance for the landscaping is to address the required landscape buffer between the commercial and residential uses. In an effort to promote cOlUlectivity between uses, we are requesting that the typical 25' landscape buffer (UDC 11-2B-3) be replaced with a 6' vinyl fence with gates. Landscaping will be installed along the fence line to soften the look of the fence' material. The fencing, along with the 20' alley, will provide some visual and noise attenuation between the uses while still promoting a more urban connection between the residences and the shops/offices. Our new and improved landscape plan was prepared by Kim Siegenthaler at Jensen- Belts_ Please let Kim or me know if you ,have any questions about the landscape plan or the alternative compliance application.
