Dear Mr. Beach:
This letter is to confirm the Director approved your requests for alternative compliance to the
standards in the Unified Development Code (UDC) listed below based on the required Findings
in UDC 11-513-5E also listed below.
• 11-4-3-27C: The total baseline land area of all qualified open space shall equal or exceed
10% of the gross land area for multi-family developments of 5 acres or more; and a
minimum area of outdoor common open space is required based on the square footage of
each unit. Alternative compliance is available for these standards, if a project has a
unique targeted demographic; utilizes other place-making design elements in Old-Town
or mixed-use future land use designations with collectively integrated and shared open
space areas.At the hearing for the conditional use permit (H-2022-0008), the
Commission directed the Applicant to submit an Alternative Compliance application for
the baseline open space requirement due to the project's proximity to Kleiner Park.
Overall, a minimum of 3.74 acres of qualified open space is required to be provided. The
Applicant proposes 2.69 acres of common open space as shown on the attached open
space exhibit. The Applicant proposes 1,290 lineal feet of detached 10-foot wide
regional/multi-use pathways on the site along E. Fairview Ave. and N. Records Way
which will improve pedestrian safety and connectivity to The Village and Kleiner Park.
The proposed development is located across the street from the park for immediate
access.
• Table 11-213-3, which requires a minimum 20-foot wide street buffer along collector
streets (i.e. N. Records Way). In a development where the required street buffer width
results in an otherwise unavoidable hardship to the property, a buffer reduction may be
requested through the alternative compliance process per UDC 11-3B-7C.Ic.

Findings (UDC 11-513-5E):
1. Strict adherence or application of the requirements are not feasible; or
The Director finds that strict adherence or application of the requirements listed in
UDC 11-4-3-27C and UDC Table I1-2B-3 is feasible if the Applicant revises the
proposed development plan.
2. The alternative compliance provides an equal or superior means for meeting the
requirements; and
The Director finds the proposed alternative compliance consisting of the provision of
1,290 lineal feet of regional/multi-use pathways providing increased pedestrian safety
and connectivity to The Village and Kleiner Park, immediate access to the 60-acre
Kleiner Park directly across the street, enhanced landscaping in the street buffer
along Records Way and a "robust"on-site amenity package provides an equal means
for meeting the requirements.
3. The alternative means will not be materially detrimental to the public welfare or
impair the intended uses and character of surrounding properties.
The Director finds the proposed alternative means of compliance to the standards
listed above will not be materially detrimental to the public welfare or impair the
intended uses and character of surrounding properties.
The Applicant, Director, or a Party of Record may request City Council review of a decision of
the Director. All requests for review shall be filed in writing with the Planning Division of the
Community Development Department on or before June 18, 2022, within fifteen (15) days after
the written decision is issued, and contain the information listed in UDC 11-5A-6B.
If City Council review of the decision is not requested, the action of the Director represents a
final decision on a land use application. You have the right to request a regulatory taking
analysis under Idaho Code 67-8003.
