'",,,,,,-,,,,,<,=~:(/I TO: Anna Canning, Planning Director Sonya Watters, Assistant City Planner ~ FROM: SUBJECT: Wyndstone Place Subdivision Request for a One Year Time Extension to Record the Final Plat Consisting of 8 Commercial Building Lots and 3 Common/other Lots on 4,63 Acres in an L-O Zone by Quasar Development, LLC (File# TE-06-020) We have reviewed this submittal and offer the following comments: APPLICATION SUMMARY The applicant, Quasar Development, LLC, has requested approval of a one year time extension to record the final plat for Wyndstone Place Subdivision. The final plat consisted of 8 commercial building lots and 3 common/other lots on 4.63 acres in an L-O zone. The final plat for Wyndstone Place Subdivision (FP~05-048) was approved by City Council on August 9,2005 and will expire on August 9, 2006, Since the plat was approved, the applicant has finished the construction drawings, received agency approvals, and has been constructing the project The applicant is requesting a one year time extension to record the final plat to provide adequate time to finish construction and to submit the final plat for signature, The applicant states that the reasons for the delay in completing the project within the allotted time are as follows: The developer elected not to bond for the improvements; the construction drawing finalization and agency approvals took a few months out of the allotted one year time frame; Idaho Power Company had a mix-up on the type of power service that was to be installed within the development and resolving this issue and reconstructing certain length of conduit took a few months; a delay in scheduling contractors to complete the work because of the recent boom in construction; and there is still work to be . completed and accepted prior to final plat signature. For these reasons, they are unable to meet the time requirements specified in Unified Development Code (UDC) 11-6B-7. The City of Meridian's Unified Development Code (UDC 11-6B-7) allows the Director to authorize a single extension of time to record the fma1 plat, not to exceed 18 months, when the applicant files a written request for an extension prior to the expiration of the plat, which the applicant has done. As mentioned above, the applicant is only requesting a one year time extension. Additional time extensions up to 18 months as determined and approved by the City council may be granted. With all extensions, the City may require compliance with the current provisions of the UDC as a condition for granting a time extension (UDC 11-6B-7C). Staff believes that there are no additional conditions that should be added to those approved by the City Council with the fmal plat for this subdivision. LOCATION The property is located on the south-west comer of S. Wells Street and E. Wells Circle, in the S,E. Y4 of Section 17, T.3N., R IE. Watertower Suite 202 Meridian, Idaho 83642 RE: Wyndstone Place Subdivision - (FP-GS-G48 Time Extension Request) To Whom it May Concern, Please find the enclosed application for a Time Extension Request for. the Wyndstone Place Subdivision. The final plat for the project was approved by the,Meridian City Council on August 9, 2005 and will expire on August 9, 2006. We ate requesting a one (1) year extension for the final plat approval to provide adequate time to finish construction and receive signature on the plat from the City Engineer. A one year extension will preserve the final plat approval until August 9,2007. Since the final plat was approved, we've finished the construction drawings, received agency approvals, and have been constructing the project. There are a few reasons why the project is not completed and we are requesting the extension. First. the developer elected not to bond for the improvements; Second, construction drawing finalization and agency approvals took a few months out of the allotted 1-year time frame; Third, Idaho Power Company had a mix up on the type of power service that was to be installed within the development. Resolving the power mix- up and reconstructing certain length of conduit took a few months; Fourth, It has been challenging scheduling contractors to complete the work with the recent boom in construction; and Fifth, there is still work to be completed and accepted prior to final plat signature from the City Engineer. A summary of work that remains that will be completed within the requested time extension includes installation of entry signage, landscaping,site lighting, fencing, and project amenities. We are confident that the aforementioned work will be completed and final plat signature will be received within the requested, extended approval.
