Anna Canning, Planning Director Sonya Watters, Assistant City Planner $V FROM: SUBJECT: The Shops at Cherry Lane Request for an 18 Month Time Extension on the Conditional Use PennitJPlanned Development for The Shops at Cheny Lane by Brent Dixon, High Point Equities, LLC (File# lE-06-021) We have reviewed this submittal and offer the following comments: APPLICATION SUMMARY The applicant, Brent Dixon, High Point Equities LLC, has requested approval of an 18 month time extension to commence the use on the conditional use pennit for The Shops at Cherry Lane. The conditional use pennit/planned development approval was for retail uses in the C-N zone. The conditional use permit/planned development (CUP~04-048) was approved by City Council on March 29, 2005 and will expire on September 29, 2006. As required by Meridian City Code (MCC) 12-3~6B, the applicant submitted a request for a time extension prior to the expiration of the conditional use permit/planned development The applicant states that the reason for the delay in commencing the use on the conditional use permit/planned development is that he was unable to enter into a shopping center development agreement with the adjacent Albertson's supennarket. The applicant states that he expects this to occur sometime within the next few months. For this reason, they are unable to meet the time requirements specified in MCC 11-17-4 under which the conditional use permit/planned development was approved. The City of Meridian's new Unified Development Code (UDe 11-5B-6F) allows'the Director to authorize a single extension of time to commence the use on the conditional use permit/planned development, not to exceed 18 months, when the applicant files a written request for an extension prior to the expiration of the conditional use pennitlplanned development, which the applicant has done. As mentioned above, the applicant is requesting an 18 month time extension. The Planning Commission may consider additional time extensions up to 18 months through the public hearing process. With all extensions, the City may require compliance with the current provisions of the UDe as a condition for granting a time extension (UDC 11-5B-6F4). Staff believes that there are no additional site specific conditions that should be added to those approved by the City Council with the conditional use pennit/planned development for this subdivision. LOCATION The subject site is located on the south side ofW. Cherry Lane, approximately 1/8 mile west of Ten Mile Road, in Section 10, Township 3 North, Range 1 West. STAFF RECOMMENDATION Staff recommends approval of an 18 month time extension from the date of expiration to commence the use on the conditional use permit/planned development approved for The Shops at Cherry Lane, to expire on March 29, 2008. The CUP was originally granted on March 29, 2005 at a City Council hearing. My understanding is that it is set to expire 18 months following the approval or on September 29,2006. I did not meet the original time frame because I was unable to enter into a shopping center development agreement "vith the adjacent Albertson's Supermarket; I now fully expect this to occur sometime within the next few months.
