Re: International Fire Code
The Idaho AGC does not have a formal position on the adoption of the International Fire Code, and therefore
does not oppose the City of Meridian adopting the code.
Re: Fire Inspection Fees
Based on our conversation about the city's plan to adopt fees for fire inspections for building construction, the
AGC does not oppose the adoption of the new fee. The most important issue for contractors is for inspections to
be timely, and as I understand the issue, the new fees will improve the delivery and speed of inspection services.
In addition, the fees need to be implemented with advance warning, so that contractors can include the fees in
their bids to owners. The fees needs to be phased in over time. Otherwise a contractor who makes a bid before
the fee increase, but doesn't need the inspection until after the fee adoption, has to absorb that additional cost.
Some inspections may not take place for up to a year from the date a bid is accepted by an owner.

For the City Council's information, Idaho AGC is the recognized leader of the commercial construction industry in
Idaho. We have 850 members, including 100 general contractors, 480 specialty contractors in all trades, and 270
professional firms and suppliers.

The Public Works Department respectfully requests the following items be placed on the
August 12 City Council consent agenda:
~ Waste Water Treatment Plant Facility Plan Update - Task Order #1 The original contract
(Task Order #1) was awarded to Carollo Engineers. We now have a need to design and bid
the expansion of the headwork:s screening and influent pump station. Attached is a contract
for the project management and design for this project totaling $78,861.00. The design and
bidding documents will be completed near the start of the 2004 budget year. The contract is
attached.
Recommended Council Action: The Public Works Deparbnent recommends
that City Council approve $78,861.00 for Task Order #2 with Carollo Engineers
for the project management and design of the headworks screening and
influent pump station and authorize the Mayor to sign it
Dissolved Air Floatation Thickener Proiect - ChanQe Order #1 This project is currently being
constructed by the Ewing Company. This change order is for removal and replacement of
an underground fuel storage tank and additional surveying of piping exposed during
excavation. As a result of potholing, it has been determined that the fuel tank is in the
preferred underground pipe path for this project. It is budgeted to be removed and replaced
with an above ground tank in the coming budget year, but it would be advantageous to do
this work now. Removal of a underground tank requires a specific set of tasks including
extensive soils testing of the surrounding area. The replacement tank
will be double walled, located above ground, and will be UL listed. The
additional surveying is required to map any underground features that
are exposed during construction which will aid in future design and

CITY OF MERIDIAN (OWNER)
AND
CAROLLO ENGINEERS, A PROFESSIONAL CORPORATION (ENGINEER)
This Task Order is issued by the OWNER and accepted by the ENGINEER pursuant to
the mutual promises, covenants and conditions in the Agreement between the above
named parties dated the 23rd day of July, 2002, in connection with: The Wastewater
Treatment Plant Facility Plan Update Project (Project).
PURPOSE
The ENGINEER's scope of services, time of completion and compensation shall be as
set forth herein. Services shall generally be described as engineering services for design
of expansion of the headworks screening and influent pump station for the OWNER's
wastewater treatment plant.
ENGINEER'S SERVICES
Services shall be generally described as those necessary for the Headworks Project
Design.
TASK 1 - PROJECT MANAGEMENT
ENGINEER will provide the following project management services for the duration of
the project:
1.1 - Work Plan. Establish a project work plan including budget and schedule based
upon this Task Order No.2.
1.2 R Management. Manage the efforts of the project team members and
sUbconsultants, assign manpower, delegate responsibilities, review work progress, and
communicate with the City.
1.3 - Project Meetings. Attend project meetings with the City. Our proposed schedule
includes the following meetings:
D Two meetings during the design phase.
D Attendance at the pre-bid walk through.
TASK 2 - DESIGN
This task includes the preparation of plans and specifications, suitable for bidding by
contractors.
2.1 - Plans and Specifications. ENGINEER will prepare a set of civil, mechanical,

structural, electrical and instrumentation design drawings and technical specifications
suitable for competitive bidding by contractors. The ENGINEER's front-end documents
will be used in the specifications.
2.2 - Submittals. Preparation of the plans and specifications will include the submittal of
50 percent and 90 percent complete documents for review by the City. Ninety percent
review plans will also be submitted to State DEQ for review. One hundred percent
complete plans and specifications incorporating final review comments will be submitted
to the City. ENGINEER will be responsible for printing and issuing plans and
specifications to prospective bidders.
2.3 - Engineer's Estimate of Construction Costs. ENGINEER will prepare an opinion
of the estimated construction cost at the 100 percent completion stage of the design
project.
TASK 3 - SERVICES DURING BIDDING AND CONSTRUCTION
This task includes the engineer's services during bidding.
3.1 - Services During Bidding. ENGINEER will assist during the project bidding phase
by:
a. Attending the pre-bid conference.
b. Responding to bidder's questions.
c. Preparing addenda, if required.
d. Reviewing the technical portion of the bids and recommending a contract
award.
PROJECT DELlVERABLES
The following deliverables will be prepared as part of the project:
A. Fifty percent design plans and technical specifications (3 copies to the
City).
B. Ninety percent design plans and technical specifications (3 copies to the
City, 2 copies to the State DEQ).
C. One hundred percent design plans and specifications (5 copies to the
City, 20 copies to contractors).
OPTIONAL SERVICES
0-1.0 - Geotechnical Report. It is anticipated that a geotechnical report will be required
for the project. This report could be completed under separate contract between the City
and a local geotechnical firm. If requested, these services could be added to this
contract. An estimated cost for geotechnical services is approximately $4,000. This cost
is not included in this contract at this time.

0-2.0 - Site Survey. It is anticipated that a site survey will be required for the project.
This report could be completed under separate contract between the City and a local
surveying firm. If requested, these services could be added to this contract. An
estimated cost for a site survey is approximately $2,000. This cost is not included in this
contract at this time.
SERVICES PROVIDED BY OWNER
OWNER will provide necessary information from previous projects and from plant
operating data for ENGINEER to complete Task 2, above. OWNER will also secure
all necessary permits and approvals for construction of the project from state and
local agencies.
TIME OF COMPLETION
The target project milestones for completion are:

The ENGINEER will perform its services in a manner that will permit the OWNER to
meet this schedule unless delayed due to a cause beyond the ENGINEER's control at
which time the ENGINEER's compensation may be subject to an increase.
COMPENSATION
OWNER shall pay ENGINEER on an hourly basis in accordance with the attached
engineering cost estimate (Exhibit A). Subconsultants shall be invoiced at ENGINEER's
cost plus ten (10) percent. All other direct costs shall be invoiced at the actual cost.
ENGINEER's total compensation for the Scope of Services identified in this Task order
shall not exceed the amount of seventy nine thousand dollars ($78,861), without
additional authorization from OWNER. The ENGINEER shall submit monthly statements
to the OWNER based on the ENGINEER's labor and expenses accrued at the time of
billlng. OWNER shall make monthly payments in response to ENGINEER's statement.

At this time Sundance Investment is processing several applications on the above mentioned
project. This project is to the east of the existing Silverstone Corporate Center and 'Will be in
front of you for approvals in the very near future. In reviewing the Planned Unit Development
Fee Schedule we realize the fee for these approvals would be $40,000.00. This seems excessive
in light of Sundsnce doing such a large project and going through the approval process one time.
On Silverstone Corporate Center we paid a PUD fee based on the first building of 60, OOOS.L
As a result of the previous project fees Sundance would like the you to consider a Plan Unit
Development fee for the largest building show on the Master Plan. The largest building shown
on the Master Plan is 69,057 square feet. The fees for this building would be $ 3,452.85 for the
building square footage plus $480.00 for a total fee of$3~932.85. We request your consideration
of this request for a reduced fee amount on Silverstone Business Campus.

At this time Suudance Investtnent is processing several applications on the above mentioned
project. This project is to tb,e east of the existing Silverstone COIporate Center and VJiIJ. be in
:front of you for approvals in the very near future. In .reviewing the Planned Unit Development
Fee Schedule we realize the fee for these approvals would be $40,000.00. This seems excessive
jnlight of Sundance doing such a large project and going through the approval process one time.
On Silverstone Corporate Center we paid a PUD fee based an the first building of60.000s.f
As a result of the previous project fees Sundance would like the you to consider a Plan Unit
Development fee for the largest bwlding BOOw on the Master Plan. The largest building shown
on the :Master Plan is 69,057 square feet. The fees for this building would bo $ 3,452.85 for the
building square footage plus $480.00 for a total fee of $3~932_85. We request your consideration
ofthi9 request for a reduced fee amount on Silverstone Business Campus.

Protection District, setting forth certain findings and purposes; authorizing the Chairman
and Secretary to sign and enter into, on behalf of said district, certain addenda to that

CONTRACT AND JOINT EXERCISE OF POWER AGREEMENT
WHEREAS, the Meridian Rural Fire Protection District has purchased as its own
certain equipment; and
WHEREAS, the City of Meridian and the Meridian Rural Fire Protection District
have entered into a certain agreement entitled "CITY OF MERIDIAN MERIDIAN RURAL
FIRE PROTECTION DISTRICT FIREFIGHTING AND LIFE PRESERVATION SERVICE
CONTRACT AND JOINT EXERCISE OF POWER AGREEMENT," hereinafter referred to
as the "Agreement," that sets forth the equipment, vehicles and otherwise property owned
separately and jointly by the City of Meridian and by the Meridian Rural Fire Protection
District; and
WHEREAS, because the Meridian Rural Fire Protection District owns said certain
equipment separately from the City of Meridian, the parties hereto agree to execute an
addendum to Exhibit "E" of the Agreement to memorialize the Meridian Rural Fire
Protection District's separate ownership of said certain equipment;
NOW, THEREFORE, for good and sufficient consideration, the receipt of which is
hereby acknowledged, the parties hereto enter into this addendum to Exhibit "E" of the
Agreement as follows:

A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF
MERIDIAN TO PROVIDE FOR FINDINGS AND TO ESTABLISH A COMPUTER
USAGE POLICY FOR THE CITY OF MERIDIAN; PROVIDING FOR THE
FOLLOWING: SYNOPSIS, OBJECTIVE, DEFINITIONS, COMPUTING PRIVACY,
SOFTW ARE/HARDWARE, SERVER MAINTENANCE, COMPUTER ACCESS AND
SECURITY, BACK-UPS, REMOTE CONTROL, INVENTORY, PURCHASING,
INTERNET AND E-MAIL ACTIVITY, CONDITIONS TO AUTHORIZATION,
VIOLATIONS, NOTICE TO THE PUBLIC, WEBSITE LINKS POLICY, AND POLICY
UPDATES, AND A QUESTION AND ANSWER SECTION; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the Mayor and Council have the authority [pursuant to I.C. S 50-
302] to establish resolutions not inconsistent with the laws of the state ofIdaho as may be
expedient, in addition to the special powers therein granted, to maintain the peace, good
government and welfare of the corporation and its trade, commerce and industry; and
WHEREAS, the computer systems owned and operated by the City of Meridian
are made available to City staff to improve efficiency, effectiveness and productivity by
improving employee abilities to do their jobs, and are intended for City business only; and
WHEREAS, the Computer Usage Policy shall incorporate definitions, regulate
computer activity during business hours, non-business hours, nights weekends and/or holidays,
and provide for periodical running of inventory on software; and
WHEREAS, the Computer Usage Policy shall regulate the installation of
hardware and software by Information Technology staff or an authorized department
representative, workstation setup, and record keeping of authorized computer software; and
WHEREAS, Given the importance of computer servers it is necessary to restrict
the ability to install software, monitor and configure servers, and therefore the Computer Usage
Policy authorizes only IT personnel to install, monitor and configure servers owned and operated
by the City of Meridian; and

WHEREAS, All employees shall be responsible for maintaining good security
practices with the City's computer systems, information systems and data, including their
passwords, and restrict usage of their own computers by other City employees; and
WHEREAS, the Computer Usage Policy provides for back-up schedules of the
server data to prevent the potential loss of critical data, and allocates responsibility for backing
up the local system, and provides that that no employee shall have remote control of another
user's computer; and
WHEREAS, the Computer Usage Policy provides for maintaining an accurate
computer inventory within all departments, and periodic audits of inventory records, along with
guidelines for purchasing computer software and hardware; and
WHEREAS, the Computer Usage Policy provides guidelines for the usage of
internet and e-mail activity for City employees, and that all users of the computer system and
networks, including Internet access, are responsible for complying with all local, state, federal
and international laws; and
WHEREAS, the Computer Usage Policy provides for disciplinary action against
for City employees who violate the policies concerning use oftheir computers, as well as other
officers, agents or representatives, within the City of Meridian who create any liability on behalf
of the City; and
WHEREAS, the Mayor and Council have deemed it expedient and in the best
interests of the City of Meridian to establish a Computer Usage Policy for the City of Meridian
to implement guidelines for the appropriate use of the computer systems for all City employees
for the City of Meridian.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COUNCIL OF THE CITY OF MERIDIAN, IDAHO as follows:
SECTION 1. Pursuant to Idaho Code g50~301 et seq., the Mayor and City Council
hereby adopt the City of Meridian Computer Usage Policy for the City of Meridian, a copy of
which is attached hereto and by this reference incorporated herein. A copy of this Resolution
and the attached City of Meridian Computer Usage Policy shall be held on file in the office of
the City Clerk.
SECTION 2: EFFECTIVE DATE. This Resolution shall be in full force and effect on

VIOLATIONS, NOTICE TO THE PUBLIC, WEBSITE LINKS POLICY, AND POLICY
UPDATES, AND A QUESTION AND ANSWER SECTION; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the Mayor and Council have the authority [pursuant to I.e. 9 50~
302] to establish resolutions not inconsistent with the laws of the state ofIdaho as may be
expedient, in addition to the special powers therein granted, to maintain the peace, good
govenunent and welfare of the corporation and its trade, commerce and industry; and
WHEREAS, the computer systems owned and operated by the City of Meridian
are made available to City staff to improve efficiency, effectiveness and productivity by
improving employee abilities to do their jobs, and are intended for City business only; and
WHEREAS, the Computer Usage Policy shall incorporate definitions, regulate
computer activity during business hours, non-business hours, nights weekends and/or holidays,
and provide for periodical running of inventory on software; and
WHEREAS, the Computer Usage Policy shall regulate the installation of
hardware and software by Infonnation Technology staff or an authorized department
representative, workstation setup, and record keeping of authorized computer software; and
WHEREAS, Given the importance of computer servers it is necessary to restrict
the ability to install software, monitor and configure servers, and therefore the Computer Usage
Policy authorizes only IT personnel to install, monitor and configure servers owned and operated
by the City of Meridian; and

WHEREAS, All employees shall be responsible for maintaining good security
practices with the City's computer systems, infonnation systems and data, including their
passwords, and restrict usage of their own computers by other City employees; and
WHEREAS, the Computer Usage Policy provides for back-up schedules of the
server data to prevent the potential loss of critical data, and allocates responsibility for backing
up the local system, and provides that that no employee shall have remote control of another
user's computer; and
WHEREAS, the Computer Usage Policy provides for maintaining an accurate
computer inventory within all departments, and periodic audits of inventory records, along with
guidelines for purchasing computer software and hardware; and
WHEREAS, the Computer Usage Policy provides guidelines for the usage of
internet and e-mail activity for City employees, and that all users of the computer system and
networks, including Internet access, are responsible for complying with all local, state, federal
and international laws; and
WHEREAS, the Computer Usage Policy provides for disciplinary action against
for City employees who violate the policies concerning use oftheir computers, as well as other
officers, agents or representatives, within the City of Meridian who create any liability on behalf
of the City; and
WHEREAS, the Mayor and Council have deemed it expedient and in the best
interests ofthe City of Meridian to establish a Computer Usage Policy for the City of Meridian
to implement guidelines for the appropriate use of the computer systems for all City employees
for the City of Meridian.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COUNCIL OF THE CITY OF MERIDIAN, IDAHO as follows:
SECTION 1. Pursuant to Idaho Code 950-301 et seq., the Mayor and City Council
hereby adopt the City of Meridian Computer Usage Policy for the City of Meridian, a copy of
which is attached hereto and by this reference incorporated herein. A copy of this Resolution
and the attached City of Meridian Computer Usage Policy shall be held on file in the office of
the City Clerk.
SECTION 2: EFFECTIVE DATE. This Resolution shall be in full force and effect on

SYNOPSIS
Computer systems are provided to City employees with the purpose of improving the
employee's ability to do their job. Computer systems owned by the City are intended for
City business only. Computer systems are to be maintained by authorized personnel
only, which includes the installation of software and hardware. Servers are to be
maintained exclusively by Information Technology (IT) staff. Inappropriate use of
computer equipment may result in disciplinary action. Users of these systems should
avoid any activity using the computer systems that could result in a breech of security,
compromise the financial position or create a contingent liability against the City of
Meridian.
OBJECTIVE
It is the objective of the City of Meridian's Computer Usage policy to protect the integrity
and quality of the City's Information Systems. Computer systems owned and operated
within the City are made available to City staff to improve efficiency, effectiveness and
productivity. In order to maximize the stability and longevity of the City's computer
systems, it is necessary to implement guidelines for the appropriate use of the City of
Meridian computer systems.
DEFINITIONS
Administrator Privileges: In Windows 2000 & Windows XP administrator privileges are
the authorization to install software, configure networking, defragment hard-drives and
set-up printers. (Users who do not have administrative privileges are authorized to
configure their desktop, screensavers, background, create new files and e-mails, use

compression software (WinZip, PKZip) and set-up your favorites on the internet. In no
way is this list of authorize_d uses meant to be comprehensive.)
Authorized Department Representative: An individual who works either in your
department or physical location who has been authorized by Information Technology and
your department head to install software, printers and to provide first level computer
support. This individual is appointed by the department head and is responsible for
complying with all City Policies relating to the installation or hardware and software.
Network Configuration: The settings specific to your workstation that enable your
machine to access network servers, printers, shared file directories, Internet and e-mail.
Remote Control: Remote Control in the context of this policy means to take control or
another person's computer through the use of either VPN (Virtual Private Network)
software. Examples of VPN software are Microsoft Terminal Service, Citrix Metaframe,
PC Anywhere or Remote Admin. Remote control includes software that tunnels through
the Internet and Dial-Up software.
Server: A computer that provides services such as software applications, files, printers or
networking services to other computers. Typically a machine running Windows NT
Server, Windows 2000 Server, Windows 2003 Server or Linux.
VPN: A virtual private network is one or more WAN links over a shared public network,
typically over the Internet or an IP backbone from a Network Service Provider (NSP) that
simulates the behavior of dedicated WAN links over leased lines.
Workstation: The machine at your desk that you use to access your e-mail, create
documents and access the Internet.
I. COMPUTING PRIVACY (Reference HR SOP 6.2.2)
A. Since computer systems are intended for City business, users of City owned
computer systems shall have no expectation of privacy or confidentiality in any
activity using City computers, equipment, networks, e-mail or internet. This
includes but is not limited to activities that occur during business hours, non-
business hours, on nights, weekends and/or holidays.
B. The City will periodically run inventory software that determines what software is
installed, that appropriate licenses have been purchased, and the configuration of
the hardware. This information is to ensure that the City has no license liability,
and that software and hardware configurations are best matched to a particular
users needs. This process may reveal installation of software that is not in
compliance with City policy.

II. SOFTWARE I HARDWARE
A. All hardware and software, except those systems specifically excluded in this
policy, shall be installed by Information Technology staff or by an authorized
department representative.
1. The following computer systems are outside the scope of this policy and are
not the responsibility of City Information Technology Staff. Departments who
use these systems are responsible for working with contractors to insure
proper maintenance, back up and oversight.

c. SPILLMAN
d. HYDRA (Sewage Collection System Hydraulic Analysis)
e. EPANET (Water Distribution System Hydraulic Analysis)
f. GIS (Geographic Information System)
B. Each workstation is configured at the time it is initially installed to work in our
complex networked environment. All software, network and printer access is
established when the workstation is setup. Users are not to change their system's
setup configuration. If you believe that your workstation's setup is configured
incorrectly, you should contact Information Technology staff for assistance.
C. Department managers or their assigned agent shall keep a record of authorized
computer software for all individuals within their department. The City will utilize
inventory software to maintain a current list of all software installed on City
computers.
III. SERVER MAINTENANCE
A. Only IT personnel are authorized to install, monitor and configure servers owned
and operated by the City of Meridian. Non-Information Technology employees
should not access Windows and Linux servers without first obtaining authorization,
or receiving instruction from the Information Technology Department. Servers are
the cornerstones of our networks and are responsible for maintaining our
databases, data files, passwords and user accounts. Given the importance of
these machines it is necessary to restrict access.
IV. COMPUTER ACCESS AND SECURITY (Reference HR SOP 6.2.2 & 6.2.3)
A. All employees of the City of Meridian are responsible for maintaining good security
practices with City computer systems, information systems and data.

B. Employees are responsible for safeguarding their passwords. Passwords should
not be stored onlir18 or given to any employee other than your supervisor or IT
personnel.
C. Users of City computers should not access or utilize another employee's
password.
D. Users should not modify, copy or delete files belonging to another user without first
obtaining permission from the owner of the file.
E. Users should not attempt to gain access to computer resources they are not
authorized to access. This includes the attempt to try and circumvent current
security controls.
1. In accordance with this objective, with the exception of those authorized
employees operating software as outlined in Section 2(A) 1 above,
individual employees will not have Administrative Privileges on their local
computer or the City network. This policy is necessary to reduce the
potential of viruses and non-business related software.
F. Password must be a minimum of six (6) characters in length and contain three (3)
of the four (4) following variables.
1. Capitalized alphabetic characters.
2. Lowercase alphabetic characters.
3. Numbers.
4. Special characters. i.e. (!@#$%^&*-_=+-':;"'I7\I*)
G. Passwords must be changed every sixty (60) days and can not be any of the
previous five (5) passwords used.
V. BACK-UPS
A. Each department location within the City of Meridian is to perform daily back-ups
of server data. Completed back-ups are not to be stored onsite to reduce the
potential loss of critical data due to Terrorism, Acts of God or other Natural
disasters. It is recommended that the employee responsible for changing the back-
up tapes take home the previous day's back up tape. Monthly back-up tapes can
be sent to the Information Technology Department for long-term storage.
1. Back-up schedules will be based on the Grandfather I Father I Son rotation
schedule. Each location will use three sets of tapes. The three sets will
consist of four (4) daily tapes, four (4) weekly tapes and twelve (12) monthly
tapes.

2. The daily back-up tape set will consist of a Monday, Tuesday, Wednesday
and Thursday tape. The weekly tape set will consist of a Week 1, Week 2,
Week 3, and Week 4 tape. The Monthly tape set will have a tape for each
month of the year. However, depending on your locations back-up needs
you can use a minimum of a six (6) tape monthly set. If you use a six tape
monthly set, rather than having a tape for each month of the year, you will
have a January/July, February/August, March/September, April/October,
May/November and a June/December tape.
B. In order to extend the life and operating condition of back up drives, each
department will on a weekly basis use a cleaning tape on the tape back-up drive.
Cleaning tapes will require replacement after approximately 50 uses. Each
department is responsible for replacing their back-up tapes after 100 uses or every
18 months.
C. It is the City's policy to back-up the server data, not individual workstations. If a
user decides not to store their data files on the server, they are responsible for
backing up their local system.
VI. REMOTE CONTROL
A. Users are not to remotely control another user's computer or allow anyone to
remotely control their computer system. The remote control of another computer
within the City of Meridian requires authorization from the Department Head and
Information Technology personnel.
VII. INVENTORY
A. Department managers are responsible for maintaining an accurate computer
inventory within their department. When Information Technology staff removes or
add computer equipment from a department, notice will be sent by IT staff making
the department and the Finance Department aware of this transfer. Tagging of
new equipment is the responsibility of each department.
B. The Information Technology staff will conduct periodic audits of inventory records
maintained by each department to insure their accuracy.
VIII. PURCHASING
A. In accordance with City purchasing policy, all computer software and hardware
acquisitions will be coordinated through the Information Technology Department of
the City of Meridian. By coordinating the purchasing of hardware and software,
the City can increase their buying power while maintaining consistency between
the different systems used throughout the City of Meridian.

IX. INTERNET AND E-MAIL ACTIVITY (Reference HR SOP 6.2.3 & 6.2.4)
A. Use of City Internet and e-mail is for business purposes only. The City may restrict
Internet access to authorized employees as determined by each department.
B. Employees will not be held responsible for unsolicited e-mail received that
contains inappropriate material. The employee should immediately delete the e-
mail received and under no circumstance should the employee forward the e-mail
to anyone.
C. Internet accounts are to be used for City business only. Employees are not to use
City owned Internet accounts for home or personal use.
X. CONDITIONS TO AUTHORIZATION (Reference HR SOP 6.2.3 & 6.2.4)
A. All users of the computer systems and networks including Internet access are
responsible for complying with all Local, State, Federal and International laws.
B. An employee's authorization to use the computer systems within the City is
contingent on his or her continued compliance with the following conditions:
1. City computers, including Internet access, shall not be used to distribute,
display, view or store advertisements, solicitations, malicious code, political
material, pornography, or any other unauthorized materials.
2. Computers owned by the City of Meridian shall not be used to distribute,
display or store (bye-mail, instant messaging or use other electronic
communication such as bulletin boards, chat rooms) material that is
fraudulent, harassing, embarrassing, sexually explicit, profane, obscene,
intimidating, defamatory or otherwise inappropriate or illegal.
3. Unless expressly authorized to do so, employees are prohibited from
sending, transmitting, or otherwise distributing proprietary information, data
or other confidential information belonging to the City of Meridian.
4. Users are not to use City Computers or Internet connections to play or
download games, view or download entertainment materials (including
pornography), visit sporting sites, look for jobs or employment, or to visit
gambling sites.
XI. VIOLATIONS

A. An employee's authorization to use the computer systems within the city is
contingent on their gontinued compliance with this policy.
B. An employee who knowingly violates this policy shall be subject to formal
disciplinary action up to and including termination from City employment. In
addition, employees who have violated this policy may have their computer access
suspended or permanently revoked.
C. Officers, employees, agents or representatives of the City of Meridian who
knowingly create any liability on behalf of the City, due to inappropriate use of the
network, e-mail, or internet shall agree to indemnify and hold the City harmless,
should it be necessary for the City to defend itself against such actions engaged in
by the user.
XII. NOTICE TO THE PUBLIC
A. Communication made through e-mail or any other form of electronic
communication shall in no way be deemed to constitute legal notice to the City or
any of its departments, officers, employees, agents, or representatives with
respect to any existing or potential claim or cause of action.
XIII. WEBSITE LINKS POLICY
A. The City of Meridian is limiting external links placed on our website to the following
kinds of entities and organizations.
1. The State of Idaho, the Federal Government or any other governmental
agency serving the residents of the Treasure Valley or other organizations
related to the function of a department.
2. Educational institutions serving the residents of the City of Meridian.
3. Public utilities that serve the City of Meridian (e.g., trash collection, Gas
Company, Power Company, etc.)
4. The City's Web site does not provide direct links to external sites that are
commercial or political in nature. The City's Web site is not intended to
function as a public forum. The provision of these links should not be
construed as an endorsement or sponsorship of these external Web sites,
their content or their hosts.
XIV. POLICY UPDATES
A. The City of Meridian reserves the right to add, delete and modify any and all

parts of this policy as approved by the Mayor and City Council.
QUESTION (Q) & ANSWER (A) SECTION
Q. I received a copy of a demo software package and when I put the CD in
the drive it pops up with a dialog box asking me for a password to install
the software. When I put in my password it doesn't like it and tells me
that I do not have sufficient privileges to install this program, what
should I do?
A. In order to install software, you must have Administrator Privileges.
Since individual users are not given administrator privileges you will
need to contact the Information Technology department or your
Authorized Department Representative who will help you install the
software.
Q. After reading this policy I am really confused about what I am authorized
to change on my computer. I do not want to do anything that violates
City Policy, but I do not like the colors of my computers background and
would like to add my family picture to my desktop, is this ok?
A. The policy does not preclude you from changing the background I adding
your family photo or even listening to a cd from your computer.
Q. Occasionally I receive an e-mail from a friend that is not business
related is this ok?
A. The best rule of thumb in this situation is to ask yourself a couple of
questions, by receiving this e-mail is it preventing me from doing my job
or interfering with my work, does it violate any of the other policies of the
city, could it be construed as harassing or obscene. The goal of the e-
mail policy is common sense. It is important to note that e-mails
received on city computers become the property of the city and fall
under the public information rules of the state.
Q. How do I get computer help?
A. This is the order that should be followed; speak with your Authorized
Department Representative or Department Head to make them aware of
the problem. Next fill out the form on the web at
http://www.meridiancity.org/itrequest.asp. You should be contacted
within 24 hours indicating that your request has been received and will

be scheduled. Do not call the Information Technology department; only
departm~nt heads or the authorized department representative should
call to request support.
Q. I came back from lunch and one of my coworkers was on my
workstation. I do not know what this individual was doing, but I am
concerned that they might have been doing something that violates this
policy and I am going to be blamed, what should I do?
A. Contact your supervisor immediately and make them aware of the
situation.
To avoid this problem it is important that when you are not at your
workstation (pc) that you logoff of the computer or lock the computer.
To logoff of the pc, go to the start button and select logoff. If your
machine's operating system is Windows 2000 or Windows XP, you can
press CTL + AL T + DEL and then press enter and it will lock your
computer. This will prevent another user from accessing your pc while
you are away, unless they know your password. If you are running
Window 95, 98 or ME you must logoff of your machine.
Q. Why do this policy and the HR SOP policy's say that you can monitor our
computer activities? Do you monitor everything we do?
A. The City of Meridian has limited resources to provide services to the
citizens of our city. We have a fiduciary responsibility to maximize these
resources, which includes getting the most out of the equipment we
currently own. Typically the fewer programs that are installed and
running on your computer the more reliably your computer will run.
Currently the city does not monitor the activities of each individual user.
We own and use software that inventories each machine's hardware and
software and meters the use of the software programs on each
workstation, but this software does not tell us what you were using the
software to do. So if you are using Microsoft Word, we do not know if
you were using it to write a letter to a customer or to your mom. It only
lets us know that you had Microsoft Word open. It is not currently the
practice of the City of Meridian to secretly track your computer activities.
Q. What does the policy mean when it says, "Users are not to attempt to
gain access to computer resources they are not authorized to access?
This includes the attempt to try and circumvent current security
controls."

A. Due to the nature of computers, it is impossible to secure a computer
system aijainst every possible weakness. Microsoft and other software
vendors are constantly releasing patches and fixes to resolve the latest
security hole. It is the practice of the city to implement security controls
to prevent users from accessing unauthorized resources and to secure
our networks from individuals outside of the City of Meridian.
As an authorized user of our networks, you are not to try and find
vulnerabilities to our system, In the case that you discover a weakness
in the security of our networks, you are to immediately inform your
department head and IT staff so that we can evaluate the risk of this
weakness and take the appropriate action.
Q. What does it mean when it says authorization is "per incident"?
A. Per incident means your authorization to modify, add, delete or
configure any system settings that are identified in this policy are limited
to that single incident. Authorization does not continue in perpetuity, in
other words it expires once the original task is complete.
For example, employee A is beginning employment for your department
today. You meant to send a request to have this new employee set-up,
but you got busy and did not send notice to the IT Department to have
this employee added. Unfortunately due to scheduling conflicts, the IT
Department cannot get to this task for two days, which is too long to
wait. The IT Department instructs you on the steps to setup employee A
with a user account. Next week employee B is starting work and you
figure that instead of asking the IT Department to come over and setup
this user that you will add the new employee yourself. You figure that
you remember the steps that were given when you added employee A,
so why not save the IT Department the trip and add employee B
yourself. In this situation it would be a violation of this policy, because
your authorization was to add employee A not employee 8.
Q. At night when I go home am I required to shut down my computer and
turn off the monitor?
A. Although it is not required to shut down your PC, it is recommended. If
you do not want to shut down your computer, some of the newer
operating systems provide an option to hibernate which is also
acceptable.
It is important to note that even though you are not required to shut
down your PC, you are required to log off of the network.

repealed, rescinded and annulled.
SECTION 6: This ordinance shall be in full force and effect from and after its passage, approval
and publication, according to law.
SECTION 7: The Clerk of the City of Meridian shall, within ten (10) days following the
effective date of this ordinance, duly file a certified copy of this ordinance and a map prepared in a
draftsman manner plainly and clearly designating the boundaries ofthe City of Meridian, including the
lands herein annexed, with the following officials of the County of Ada, State of Idaho, to-wit: the
Recorder, Auditor, Treasurer and Assessor and shall also file simultaneously a certified copy of this
ordinance and map with the State Tax Commission of the State ofIdaho, all in compliance with Idaho
Code S63-2215 and S50-223.

3. It is detennined that Urban Services can be made available to accommodate the
proposed development if the plat complies with the requirements and conditions hereinafter set
forth as conditions of preliminary plat approval.
4. The proposed development is a continuity of the proposed development within the
City's Capital Improvement Program and if the conditions, which are requested by the Planning
and Zoning Administrator and the Engineering Technician III, and as proposed by the developer
as stated on the preliminary plat, there will be public financial capability of supporting services
for the proposed development.
5. The development if built in accordance with the conditions and as proposed, will
not create health, safety or environmental problems and there have been no specifics of any such
concerns brought to the Council's attention.
6. It is found that the Recommendation To City Council of the Platming and Zoning
Commission is reasonable and appropriate for the conditions of approval of the preliminary plat
as hereinafter set forth.

5 commercial lots on property consisting of 2.69 acres in an L-O zone. All proposed lots will
have frontage on W. Cherry Lane. Access to the five lots will be provided through a single point
of access off of W. Cherry Lane. The property is currently zoned L-); the property was rezoned
as part of the Development Agreement for Devlin Place Subdivision. The proposed lots range in
size from 19,419 square feet to 30,052 square feet. All proposed subdivision lots meet the
dimensional standards for the L-O District. The location ofthe proposed subdivision on W.
Cherry Lane, a principal arterial, and the close proximity to another commercial development
make this a suitable location for an office/medical type development.

1. Sanitary sewer service to this site will be via extensions from existing mains
adjacent to the proposed development. Subdivision designer to coordinate main
sizing and routing with the Public Works Department. Sewer manholes are to be
provided to keep the sewer lines on the south and west sides of the centerline. A
portion of the site may require fill material in order to maintain minimum cover
requirements over sewer mains. Alternate pipe materials shall be employed where
depth of cover from sub-grade to top of pipe is three feet or less. In no case will
three feet of cover from finish grade to top of pipe be accepted
2. Water service to this site will be via extensions from existing mains adjacent
to the proposed development. Applicant will be responsible to construct the water
mains to and through this proposed development. Subdivision designer to
coordinate main sizing and routing with the Public Works Department. Please
provide the Public Works Department with information on anticipated fire flow and
domestic water requirements for the proposed site.

installed at subdivider's expense.
4. Underground year-round pressurized irrigation must be provided to all
landscape areas on site. Please submit hook-up and design details based on the
proposed landscaping. Applicant shall be required to either utilize the existing
pressurized irrigation stubs to the property from the Nampa & Meridian Irrigation
District owned system serving Devlin Place Subdivision, or provide an independent
system. Applicant should contact the NMID for the details. If this development is
to be served off of the NMID system, developer shall be responsible to pay water
assessments for the entire common open area to the City of Meridian since a back-
up connection to the City's water mains already exists within Devlin place.
5. A revised landscaping plan meeting the standards of the Meridian City code
must be submitted ten days prior to the City Council hearing.
6. Connect the existing pathway out of Devlin Place Subdivision to the
sidewalk or parking area within the proposed development. Final location shall be
shown on the revised landscape plan.
7. Add a note to the final plat restricting access to the site to the single
approved accessed point off of W. Cherry Lane.
8. A cross-access agreement between the proposed subdivision lots will be
required.
9. A 20' landscape buffer will be required between the subject property and
adjoining single-family residential uses.
10. All existing ditches and canals on the subject property must be piped.
II. The preliminary plat must comply with the subject property's existing
Development Agreement.
C. Adopt the Recommendations of ACHD as follows:

1. Reconstruct the existing curb return access point on Cherry Lane located
approximately 125-feet east ofthe west property line and in alignment with

centerline). Lots 1-5, Block 1, shall share said access point for access to Cherry
Lane, as proposed. Provide a copy of a recorded cross access easement to the
District that allows all of the lots within the subdivision to use the access point
for access to the public streets.
2. Other than the access point specifically approved with this application,
direct lot or parcel access to Cherry Lane is prohibited. Lot access restrictions, as
required with this application, shall be stated on the final plat.
3. Comply with all Standard Conditions of Approval.
Standard Conditions of Approval
1. Any existing irrigation facilities shall be relocated outside of the right-of-
way.
2. All utility relocation costs associated with improving street frontages
abutting the site shall be borne by the developer.
3. Replace any existing damaged curb, gutter and sidewalk and any that may
be damaged during the construction of the proposed development. Contact

4. Utility street cuts in pavement less than five years old are not allowed
unless approved in writing by the District. Contact Construction Services at 387-

5. All design and construction shall be in accordance with the Ada County
Highway District Policy Manual, ISPWC Standards and approved supplements,
Construction Services procedures and all applicable ACHD Ordinances unless
specifically waived herein. An engineer registered in the State ofIdaho shall
prepare and certify all improvement plans.
6. The applicant shall submit revised plans for staff approval, prior to
issuance of building permit (or other required permits), which incorporates any
required design changes.
7. Construction, use and property development shall be in conformance with
all applicable requirements of the Ada County Highway District prior to District
approval for occupancy.

8. Payment of applicable road impact fees are required prior to building
construction in accordance with Ordinance #197, also known as Ada County
Highway District Road Impact Fee Ordinance.
9. It is the responsibility ofthe applicant to verify all existing utilities within
the right-of-way. Existing utilities damaged by the applicant shall be repaired by
the applicant at no cost to ACHD. The applicant shall be required to call
DIGLINE (1-800-342-1585) at least two full business days prior to breaking
ground within ACHD right-of-way. The applicant shall contact ACHD Traffic
Operations 387-6190 in the event any ACHD conduits (spare or filled) are
compromised during any phase of construction.
10. No change in the terms and conditions of this approval shall be valid
unless they are in writing and signed by the applicant or the applicant's
authorized representative and an authorized representative of the Ada County
Highway District. The burden shall be upon the applicant to obtain written
confirmation of any change from the Ada County Highway District.
11. Any change by the applicant in the planned use of the property which is
the subject of this application, shall require the applicant to comply with all rules,
regulations, ordinances, plans, or other regulatory and legal restrictions in force
at the time the applicant or its successors in interest advises the Highway District
of its intent to change the plmmed use of the subject property unless a
waiver/variance of said requirements or other legal relief is granted pursuant to
the law in effect at the time the change in use is sought.
D. Adopt the Meridian Fire Department Recommendations as follows:
1. Commercial and office occupancies will require a fire-flow consistent with the
Uniform Fire Code to service the proposed project. Fire hydrants shall be placed an
average of 400' apart. 1997 UFC Appendix III-A
2. Acceptance ofthe water supply for fire protection will be by the Meridian Water
Department.
3. Final Approval of the fire hydrant locations shall be by the Meridian Fire
Department thru the Public Works Department.
4. All roads shall have a turning radius of28' inside mId 48' outside.

6. The phasing plan may require that any roadway greater than 150' in length that
IS not provided with an outlet shall be required to have a turn around.
7. The fire department requests that any future signalization installed as the result
of the development of this project be equipped with Opticom Sensors to ensure a safe
and efficient response by fire and emergency medical service vehicles. This cost of
this installation is to be borne by the developer
8. All access roads leading into and within the project shall have a clear driving
surface with a minimum width of 20' available at all times. UFC 902.2.2.1
E. Adopt the Recommendation ofNampa & Meridian Irrigation District as follows:
1. Applicant shall apply for a land use change/site application for review
prior to final platting. All laterals and waste ways must be protected. All
municipal surface drainage must be retained on site. If any surface
drainage leaves the site, the District must review drainage plans.
2. The developer must comply with Idaho Code 31-3805.
F. Adopt the Recommendations of the Central District Health Department as
follows:
1. This proposal can be approved for central sewage & central water after
written approval from appropriate entities is submitted.
2. The Applicant's central sewage and central water plans must be
submitted to and approved by the Idaho Department of Health & Welfare,
Division of Environmental Quality.
3. Run-off is not to create a mosquito breeding problem.
4. Stormwater shall be pretreated through a grassy swale prior to discharge
to the subsurface to prevent impact to groundwater and surface water quality.

5. The Engineers and architects involved with the design of the subject
project shall obtain current best management practices for stonnwater disposal
and design a stonnwater management system that prevents groundwater and
surface water degradation.
G. Adopt the Recommendations of Settlers' Irrigation District as follows:
1. That all irrigation/drainage facilities along with their easements be
protected and continue to function. The Settlers Southside Canal is
located along the southern boundary of the property. The canal is piped
in 36 inch RCP and has a 30' easement.
2. SID will not accept any stonn drainage.
NOTICE OF FINAL ACTION
AND RIGHT TO REGULA TORY TAKINGS ANALYSIS
The Applicant is hereby notified that pursuant to Idaho Code 67-8003, the Owner
may request a regulatory taking analysis. Such request must be in writing, and must be filed

in this matter therefore makes the following Findings of Fact and Conclusions of Law, and

2. The City Council takes judicial notice of its zoning, subdivision and development
ordinances codified at Titles 11 and 12, Meridian City Code, and all current zoning maps thereof,
and the Amended Comprehensive Plan ofthe City of Meridian adopted August 6, 2002,
Resolution No. 02-382, and maps and the ordinance Establishing the Impact Area Boundary.
3. The property which is the subject of the application for annexation and
zoning is described in the application, is approximately 24.004 acres in size and is located west
ofN. Eagle Road and south ofE. Ustick Road, Meridian, Idaho, all within the Area ofImpact of
the City of Meridian and the Meridian Urban Service Planning Area as defined in the Meridian
Comprehensive Plan.
4. The owners of record of the subject property are William W. Calhoun and Sherri

5. The property is presently zoned R1 (Ada County), and consists of a residential
subdivision.
6. The Applicant requests the property be zoned as R-2 (Rural Low Density
Residential District).
7. The subject property is bordered to the north by the proposed Parkstone
Subdivision, to the south by Packard Subdivision, school and future offices, to the east by rural
residential/agricultural property, and to the west by Packard Subdivision and rural
residential/agricultural property.
8. The Applicant proposes to develop the subject property in the following manner:
The current residential use will not change.
9. The Applicant requests zoning of the subject real property as R-2, which is
consistent with the Meridian Comprehensive Plan Generalized Land Use Map which designates
the subject property as Low Density Residential.
10. There are no significant or scenic features of major importance that affect the
consideration of this application.

11. The City Council recognizes the concerns of Betty Rossow, 2832 Leslie Drive,
Meridian, Idaho, expressed in her letter dated June 29,2003.
12. Giving due consideration to the comments received from the
governmental subdivisions providing services in the City of Meridian planning jurisdiction,
public facilities and services required by the proposed development will not impose expense
upon the public if the following conditions of development are imposed:
A. Adopt the Recommendations of the Meridian Planning & Zoning Department as follows:
ANNEXATION AND ZONING CONDITIONS OF APPROV AL
I. Remove any existing domestic wells and/or septic systems within this project from
their domestic service, per City Ordinance Section 5-7-517, with the exception that the
property owners are allowed 12-months from the date of this annexation approval to make
the physical connection to the City of Meridian's sanitary sewer and water systems. Wells
may be used for non-domestic purposes such as landscape irrigation.
2. All future development of the subject property shall be constructed in accordance
with City of Meridian ordinances in effect at the time of development.
3. Each property owner within this annexation shall be subject to the current sanitary
sewer and water assessment fees, and service line construction reimbursement costs at the
time of cOlmection. Property owners will also have to obtain all necessary permits and
inspections.
B. Adopt the Recommendations of the ACHD as follows:

1. Dedicate 33-feet of right-of-way for the new collector road along the south
property line of the site abutting the parcel by means of recordation of a final subdivision
plat or execution of a warranty deed prior to issuance of a building permit (or other
required permits), whichever occurs first. Allow up to 30 business days to process the
right-of-way dedication after receipt of all requested material. The owner will be
compensated for all right-of-way dedicated as an addition to existing right-of-way from
available impact fee revenues in this benefit zone, if the owner submits a letter of
application to the impact fee administrator prior to breaking ground, in accordance with
Section 15 of ACHD Ordinance #193.
2. Comply with requirements onTD for State Highway 55 (Eagle Road) frontage.
Submit to the District a letter from ITD regarding said requirements prior to District
approval of the final plat or issuance of a building permit (or other required permits),
whichever occurs first. Contact District III Traffic Engineer at 334-8340.
3. The Eagle Road Access Study identified that the new east-west collector street
located 2640-feet north of Pair view Avenue will be restricted to right-inlright-out
operation as traffic volumes on Eagle Road increased.
4. Utility street cuts in the new pavement are not allowed unless approved in writing
by the District. Contact Construction Services at 387-6280 (with file number) for details.
5. As required by District policy, restrictions on the width, number and locations of
driveways, shall be placed on future development of this parcel.
6. Construct a 5-foot wide concrete sidewalk on new the east/west collector street
abutting the parcel prior to District approval of a final plat. The sidewalk shall be located
two feet within the new right-of-way of the collector road. Coordinate the location and
elevation of the sidewalk with District staff.
7. Construct the new commercial street as a 40-foot street sections with curb gutter,
and 5-foot wide concrete sidewalks within 58-feet of right-of-way, located as proposed
320-feet.
8. Locate driveways off the new commercial street a minimum of 50-feet north of
the collector roadway. Construct the driveways as 24 to 30-foot wide curb cuts and paved
their full width to a point 3D-feet beyond the edge of pavement of the commercial street.
9. Construct an ACHD approved turnaround with a 45-foot radius at the north end of
the new north-south street. Submit a design of the turnaround for review and approval
by District staff.

10. No access points to Eagle Road have been proposed and none are approved with
this application.
11. No access points to the new east-west street have been proposed and none are
approved with this application.
Standard Requirements
1. A request for modification, variance or waiver of any requirement or policy
outlined herein shall be made in writing to the ACHD Plmming and Development
Supervisor. The request shall specifically identify each requirement to be reconsidered
and include a written explanation of why such a requirement would result in a substantial
hardship or inequity. The written request shall be submitted to the District no later than
9:00 a.m. on the day scheduled for ACHD Commission action. Those items shall be
rescheduled for discussion with the Commission on the next available meeting agenda.
Requests submitted to the District after 9:00 a.m. on the day scheduled for
Commission action do not provide sufficient time for District staff to remove the item
from the consent agenda and report to the Commission regarding the requested
modification, variance or waiver. Those items will be acted on by the Commission unless
removed from the agenda by the Commission.
2. After ACHD Commission action, any request for reconsideration of the
Commission's action shall be made in writing to the Planning and Development
Supervisor within six days of the action and shall include a minimum fee of $110.00.
The request for reconsideration shall specifically identify each requirement to be
reconsidered and include written documentation of data that was not available to the
Commission at the time of its original decision. The request for reconsideration will be
heard by the District Commission at the next regular meeting of the Commission. If the
Commission agrees to reconsider the action, the applicant will be notified of the date and
time of the Commission meeting at which the reconsideration will be heard.

1. That a fire-flow of 1,000 gallons per minute be available to service the entire project.
Fire hydrants shall be placed an average of 450' apart. 1997 UFC Appendix III-A
D. Adopt the action of the City Council taken at their August 12, 2003 meeting as follows:
1. That any property owners who have applied for annexation for this project,
shall be allowed to continue to maintain the number and types of livestock
allowed under the existing Carol Subdivision Covenants and Restrictions, as a
nonconfonning use.

2. That as a condition of annexation of the properties which are adjacent to the
open ditch, they shall not be required to tile that existing ditch.
3. For clarification, the owners who have applied for annexation shall have 12
months from the time of official am1exation to physically connect to water and
sewer.
13. It is found that the Comprehensive Plan Future Lane Use Map depicts the subject
property as "Low Density Residential" which complies with the requested zoning designation ofR-2.
It is found that the requested zone of R-2 will be harmonious with and in accordance with
Comprehensive Plan.
14. It is not anticipated that the applicant intends to rezone the subject property in the
future.
15. It is found that the existing residential subdivision is a permitted use within the
requested R-2 zone.
16. City services have become available to the residents of Carol Subdivision since the
subdivision was originally created.
17. It is found that there are no new proposed uses and that the existing uses are
harmonious with the character of the general vicinity.
18. It is found that the existing use will not be disturbing or hazardous to the existing or
future neighboring uses.
19. It is found that the property to be annexed may be served adequately by all essential
public facilities and services. Review of ACHD's report and the Fire Department's comments
concerning this existing subdivision will provide further infonnation regarding availability of

20. It is found that there will not be excessive additional requirements at public cost and
that the annexation and zoning will not be detrimental to the community's economic welfare.
21. It is found that the proposed annexation will not create additional traffic and noise
that may be detrimental to the general welfare of the surrounding residential area.
22. It is found that no new vehicular approaches have been created.
23. It is found that no natural or scenic features of major importance will be lost or
damaged by approving the annexation and re-zone. Any existing trees larger than 4" caliper that are
removed shall be mitigated for, per the Landscape Ordinance.
24. It is found that the annexation will create county enclave lots. White it would be
preferred from public services perspective to perform a single annexation of the entire
subdivision, it is found that the annexation of the subject 22 lots is in the best interest of the City.
25. It is found that if the developer pays for the requested improvements
and complies with the conditions set forth in these Findings of Fact No. 12, and all sub-parts, the
economic welfare of the City and its residents and tax and rate payers will be protected, a
condition of annexation and zoning designation.
26. It is also found that the development considerations as referenced in Finding No.
12 are reasonable to require and must be taken into account, in order to assure the proposed
development is designed, constructed, operated and maintained in a manner which is hannonious
and appropriate in appearance with the existing, or intended character of the general vicinity, in
order to assure that the proposed use will not change the essential character of the affected

vicinity and will insure that the proposed uses will not be hazardous or disturbing to the existing,
or future neighboring uses, particularly considering the impact of proposed development on
potential to produce excessive traffic, noise, smoke, fumes, glare and odors.
CONCLUSIONS OF LAW
1. The City of Meridian has authority to annex real property upon written request for
annexation and the real property being contiguous or adjacent to city boundaries and that said
property lies within the area of city impact as provided by ldaho Code Section 50-222. The
Meridian City Code ~ 11-16 provides the City may annex real property that is within the
Meridian Urban Service Planning Area as set forth in the City's Comprehensive Plan.
2. The Council may take judicial notice of government ordinances, and policies, and
of actual conditions existing within the City and State.
3. The City of Meridian has exercised its authority and responsibility as provided by
"Local Land Use Planning Act of 1975", codified at Chapter 65, Title 67, Idaho Code by the
adoption ofthe Amended Comprehensive Plan City of Meridian adopted August 6, 2002,
Resolution No. 02-382.
4. The zoning of Rural Low Density Residential (R-2) is defined in the Zoning
Ordinance at ~ 11-7-2 A as follows:
(R-2) Rural Low Density Residential District: The purpose of the R-2 District is to
permit the establishment of rural low density single-family dwellings, and to delineate those
areas where predominantly rural residential development has, or is likely to occur in accord
with the Comprehensive Plan ofthe City, and to protect the integrity of rural residential areas
by prohibiting the intrusion of incompatible nonresidential uses. The R-2 District allows for
a maximum of two (2) dwelling units per acre and requires connection to the Municipal
water and sewer systems of the City.
5. Since the am1exation and zoning of land is a legislative function, the City has

authority to place conditions upon the annexation ofIand. See Burt vs. The City ofIdaho Falls, 105
Idaho 65, 665 P2d 1075 (1983).
6. The development of the annexed land, if annexed, shall meet and comply with the
Ordinances of the City of Meridian including, but not limited to: Section 12-2-4 which pertains to
development time schedules and requirements; Section 12-4-13, which pertains to the piping of
ditches; and Section 12-5-2 N, which pertains to pressurized irrigation systems, and Zoning and
Subdivision and Development Ordinance of the City of Meridian.
7. Pursuant to Section 11-16-4 A of the Zoning and Development Ordinance the owner
and/or developer shall enter into a Development Agreement, if such is required by the City.
DECISION AND ORDER
NOW, THEREFORE, BASED UPON THE ABOVE AND FOREGOING FINDINGS
OF FACT AND CONCLUSIONS OF LAW, the City Council does hereby Order and this does
Order:
1. The applicant's request for annexation and zoning of approximately 24.004 acres to
Rural Low Density Residential (R-2) is granted subject to the terms and conditions of this Order
hereinafter stated.
2. The application is for annexation and zoning of24.004 acres. The legal description
shall be prepared by a Registered Land Surveyor, Licensed by the State ofIdaho, and shall conform
to all the provisions of the City of Meridian Resolution No. 158. The legal description for
annexation must place this parcel contiguous to the Corporate City Limits per Ordinance No. 686.
3. Developer shall be required to met the conditions set forth and in the event the

conditions herein are not met by the Developer that the property shall be subject to de-mmexation,
with the City of Meridian, which provides for the following conditions of development, to-wit:
A. Adopt the Recommendations of the Meridian Planning & Zoning Department as follows:
ANNEXATION AND ZONING CONDITIONS OF APPROVAL
1. Remove any existing domestic wells and/or septic systems within this project from
their domestic service, per City Ordinance Section 5-7-517, with the exception that the
property owners are allowed 12-months from the date of this almexation approval to make
the physical connection to the City of Meridian's sanitary sewer and water systems. Wells
may be used for non-domestic purposes such as landscape irrigation.
2. All future development ofthe subject property shall be constructed in accordance
with City of Meridian ordinances in effect at the time of development.
3. Each property owner within this annexation shall be subject to the current sanitary
sewer and water assessment fees, and service line construction reimbursement costs at the
time of connection. Property owners will also have to obtain all necessary pennits and
inspections.
B. Adopt the Recommendations of the ACHD as follows:
Site Specific Requirements
1. Dedicate 33-feet of right-of-way for the new collector road along the south
property line of the site abutting the parcel by means of recordation of a final subdivision
plat or execution of a warranty deed prior to issuance of a building pennit (or other
required permits), whichever occurs first. Allow up to 30 business days to process the
right-of-way dedication after receipt of all requested material. The owner will be
compensated for all right-of-way dedicated as an addition to existing right-of-way from
available impact fee revenues in this benefit zone, if the owner submits a letter of
application to the impact fee administrator prior to breaking ground, in accordance with
Section 15 of ACHD Ordinance #193.
2. Comply with requirements ofITD for State Highway 55 (Eagle Road) frontage.
Submit to the District a letter from ITD regarding said requirements prior to District
approval of the final plat or issuance of a building pennit (or other required permits),
whichever occurs first. Contact District III Traffic Engineer at 334-8340.

3. The Eagle Road Access Study identified that the new east-west collector street
located 2640-feet north of Fairview Avenue will be restricted to right-inlright-out
operation as traffic volumes on Eagle Road increased.
4. Utility street cuts in the new pavement are not allowed unless approved in writing
by the District. Contact Construction Services at 387-6280 (with file number) for details.
5. As required by District policy, restrictions on the width, number and locations of
driveways, shall be placed on future development of this parcel.
6. Construct a 5-foot wide concrete sidewalk on new the east/west collector street
abutting the parcel prior to District approval of a final plat. The sidewalk shall be located
two feet within the new right-of-way of the collector road. Coordinate the location and
elevation of the sidewalk with District staff.
7. Construct the new commercial street as a 40-foot street sections with curb gutter,
and 5-foot wide concrete sidewalks within 58-feet ofright-of-way, located as proposed
320-feet.
8. Locate driveways off the new commercial street a minimum of 50-feet north of
the collector roadway. Construct the driveways as 24 to 30-foot wide curb cuts and paved
their full width to a point 3D-feet beyond the edge of pavement of the commercial street.
9. Construct an ACHD approved turnaround with a 45-foot radius at the north end of
the new north-south street. Submit a design of the turnaround for review and approval
by District staff.
10. No access points to Eagle Road have been proposed and none are approved with
this application.
11. No access points to the new east-west street have been proposed and none are
approved with this application.

Standard Requirements
1. A request for modification, variance or waiver of any requirement or policy
outlined herein shall be made in writing to the ACHD Planning and Development
Supervisor. The request shall specifically identify each requirement to be reconsidered
and include a written explanation of why such a requirement would result in a substantial
hardship or inequity. The written request shall be submitted to the District no later than
9:00 a.m. on the day scheduled for ACHD Commission action. Those items shall be
rescheduled for discussion with the Commission on the next available meeting agenda.
Requests submitted to the District after 9:00 a.m. on the day scheduled for Commission
action do not provide sufficient time for District staff to remove the item from the consent
agenda and report to the Commission regarding the requested modification, variance or
waiver. Those items will be acted on by the Commission unless removed from the
agenda by the Commission.
2. After ACHD Commission action, any request for reconsideration of the
Commission's action shall be made in writing to the Planning and Development
Supervisor within six days of the action and shall include a minimum fee of $11 0.00.
The request for reconsideration shall specifically identifY each requirement to be
reconsidered and include written documentation of data that was not available to the
Commission at the time of its original decision. The request for reconsideration will be
heard by the District Commission at the next regular meeting of the Commission. If the
Commission agrees to reconsider the action, the applicant will be notified of the date and
time of the Commission meeting at which the reconsideration will be heard.
3. Payment of applicable road impact fees are required prior to building construction
in accordance with Ordinance #193, also known as Ada County Highway District Road
Impact Fee Ordinance.
4. All design and construction shall be in accordance with the Ada County Highway
District Policy Manual, ISPWC Standards and approved supplements, Construction
Services procedures and all applicable ACHD Ordinances unless specifically waived
herein. An engineer registered in the State of Idaho shall prepare and certifY all
improvement plans.
5. The applicant shall submit revised plans for staff approval, prior to issuance of
building permit (or other required permits), which incorporates any required design
changes.
6. Construction, use and property development shall be in confonnance with all
applicable requirements of the Ada County Highway District prior to District approval for

occupancy.
7. It is the responsibility of the applicant to verifY all existing utilities within the
right-of-way. Existing utilities damaged by the applicant shall be repaired by the
applicant at no cost to ACHD. The applicant shall be required to call DIG LINE (1-800-
342-1585) at least two full business days prior to breaking ground within ACHD right-of-
way. The applicant shall contact ACHD Traffic Operations 387-6190 in the event any
ACHD conduits (spare or filled) are compromised during any phase of construction.
8. No change in the terms and conditions of this approval shall be valid unless they
are in writing and signed by the applicant or the applicant's authorized representative and
an authorized representative of the Ada County Highway District. The burden shall be
upon the applicant to obtain written confirmation of any change from the Ada County
Highway District.
9. Any change by the applicant in the planned use of the property which is the
subject of this application, shall require the applicant to comply with all rules,
regulations, ordinances, plans, or other regulatory and legal restrictions in force at the
time the applicant or its successors in interest advises the Highway District of its intent to
change the planned use of the subject property unless a waiver/variance of said
requirements or other legal relief is granted pursuant to the law in effect at the time the
change in use is sought.
C. Adopt the Recommendations of the Meridian Fire Department as follows:
1. That a fire-flow of 1 ,000 gallons per minute be available to service the entire
project. Fire hydrants shall be placed an average of 450' apart. 1997 UFC Appendix Ill-A
D. Adopt the action of the City Council taken at their August 12, 2003 meeting as follows:
1. That any property owners who have applied for annexation for this project, shall
be allowed to continue to maintain the number and types of livestock allowed under the
existing Carol Subdivision Covenants and Restrictions, as a nonconforming use.
2. That as a condition of annexation of the properties which are adjacent to the open
ditch, they shall not be required to tile that existing ditch.
3. For clarification, the owners who have applied for annexation shall have 12
months from the time of official annexation to physically connect to water and sewer.

4. The City Attorney shall prepare for consideration by the City Council the appropriate
ordinance for the almexation and zoning designation of the real property which is the subject ofthe
application to (R-2) Rural Low Density Residential District, and Meridian City Code 9 11-7-2.
5. Subsequent to the passage of the Ordinance provided for in section 4 ofthis Order the
engineering staff of the Public Works Department shall prepare the appropriate mapping changes of
the official boundaries and zoning maps as provided in Meridian City Code S 1] -21-1 in accordance
with the provisions of the annexation and zoning ordinance.
NOTICE OF FINAL ACTION
AND RIGHT TO REGULATORY TAKINGS ANALYSIS
The Applicant is hereby notified that pursuant to Idaho Code 67-8003, the Owner may
request a regulatory taking analysis. Such request must be in writing, and must be filed with the
City Clerk not more than twenty-eight (28) days after the final decision concerning the matter at
issue. A request for a regulatory takings analysis will toll the time period within which a Petition
for Judicial Review may be filed.
Please take notice that this is a final action of the governing body of the City of Meridian.
Pursuant to Idaho Code S 67-6521 an affected person is a person who has an interest in real property
which may be adversely affected by the issuance or denial of the annexation and zoning and who
may within twenty-eight (28) days after the date of this decision and order seek ajudicial review as
provided by Chapter 52, Title 67, Idaho Code.
