FP-O1-015 ORDER OF CONDITIONAL APPROVAL OF FINAL PLAT This matter coming before the City Council for Final Plat approval pursuant to Meridian City Code § 123-7 on February 5, 2002, and the Council finding that -the Administrative Review is complete which has included certain comments and conditions as stated in a letter to the Mayor and Council from Bruce Frecldeton, Engineering Technician III, and Shari Stiles, Planning and Zoning Administrator, listing 8 General Comments and 22 Site Specific Comments, which are herein found fair and reasonable, and at the February 5, 2002 meeting, Shari Stiles, Planning and Zoning Administrator, and Reese Leavitt of Leavitt ~ Associates Engineers, Inc., commented at the hearing, and no one appeared in opposition, and ORDER OF CONDITIONAL APPROVAL OF FINAL PLAT FOR STATEN PARK SUBDIVISION (FP-O1-015) -1 the Council having considered the requirements of the preliminary plat the Council takes the following action: IT IS HEREBY ORDERED THAT: 1. The Plat of "STATEN PARK SUBDIVISION" as evidenced in Plat bearing the "STATEN PARI< SUBDIVISION BEING A PORTION OF GOVERNMENT LOT 4, OF SECTION 3, T3N., R1W., BM., ADA COUNTY, IDAHO LYING NORTH OF THE CENTERLINE OF THE EIGHT MILE LATERAL, 2001, SHEET 1 OF 2 SHEETS, INDEX NO. 314-3-0-0-0-00-00, JOB NO. 00281.001, LEAVITT & ASSOCIATES ENGINEERS, INC.", and D'ALESSIO BUILDING DEVELOPMENT, DEVELOPER, is Conditionally Approved subject to those conditions of Staff comments as set forth in the Memorandum to the Mayor and City Council from Bruce Frecldeton, Engineering Technician III, and Shari Stiles, Planning and Zoning Administrator, dated September 14, 2001, listing 8 General. Comments and 22 Site Specific Comments, a true and correct copies are attached hereto marked Exhibit "A", and consisting of four pages, and by this reference incorporated herein, with the additional requirements as follows, to-wit: 1.1 Deputy Fire Chief, Joseph Silva, requires that afire-flow be provided as required by the 1997 Uniform Fire Code Appendix III-A. Show all proximity hydrants within 500' of the project on the resbumitted plat. 1.2 All corners shall have a 28' inside radius and 48' outside radius. ORDER OF CONDITIONAL APPROVAL OF FINAL PLAT FOR STATEN PARK SUBDIVISION (FP-O1-015) _2 1.3 The roadways shall be built to Ada County Highway District Standards. 1.4 Acceptance of water supply for fire protection is contingent upon acceptance of the water system by the City of Meridian for water quality. 1.5 Final approval of the fire hydrant locations shall be by the Meridian Fire Department. 1.6 Insure all yet undeveloped parcels are maintained free of combustible vegetation per section 1103.2.4 of the UFC. 1.7 The Nampa ~ Meridian Irrigation District notes that the proposed project is currently in the District's review process. The District reserves all comments until the review process is complete. 1.8 Comply with the Central District Health Department's Environmental Health Division on the Final Plat dated 8/27/01. 2. The final plat upon which there is contained the Certification and signature of the City Clerlc and the City Engineer verifying that the plat meets the City's requirements shall be signed only at such time as: 2.1 The Plat dimensions are approved by the City Engineer; and 2.2 The City Engineer has verified that all off-site improvements are completed and/or the appropriate letter of credit or cash has been issued guaranteeing the completion of off-site and required on- site improvements. These conditions shall be considered in full, unless expressly mod~ed or deleted by motion of the Meridian City Council.• LOCATION The parcel is located on the south side of Ustick Road, %, mile east of Black Cat Road. SURROUNDING PROPERTIES North: Ustick Road and uninwrpoiated agicultiual land, zoned RUT. South: Platted Lakes at Cherry Lane Subdivision, zoned R-4. East: Platted Wilkins Ranch Subdivision, zoned R-4. West: Rural Residential parcels, zoned RUT. 5TTE SPECIFIC REQUIREMENTS 1. Sanitary sewer to this site shall be via extensions from mains installed in the adjacent phases of Willun' s Ranch Subdivision. Water service to this site shall be via extensions from existing mains in Ustick Road. Subdivision designer to coordinate main sizing and routing with the Public Works Depaitment. The lots within this development will be subject to applicable latecomer fees. 2. The sods investigation report submitted with the application indicates that groundwater was encountered at some fairly shallow depths within the project site (approximately 5.5 feet deep}. Design engineer to provide a statement of compliance, prior to the approval of development plans, which certifies that the centerline finish grade of the streets >s at least three feet above the established normal groundwater elevation. This is an effort to ensure that the budding footings are at least one foot above the high groundwater. 3. Applicant has indicated that the pressurized irrigation system within this development is to be a continuation of the existing system owned and maintained by the Nampa & Meridian rva~-ms smm e.n smmw~r~ Ex1-~ b;~ "A" I o~ ~ Mayor and City Council September 14, 2001 Page 2 Irrigation District. 4. Deed restrictions will be required for all lots adjacent to the pathway to limit the height of sight-obscuring fencing to no more than four feet high. Fencing within 20 feet of rights-of- waymay not exceed three feet in height. Provide recorded copies of the deed restriction prior to applying for building permits. 5. The requirement for tiling of the Eight Mile Lateral is waived. 6. A detailed landscape plan for the common areas, including fencing locations, pathways and types of construction, was to be submitted for review and approval with the submittal of the final plat. The landscape plan submitted does not meet the requirements of the Landscape Ordinance. The plan must inchrde sizes and species of trees, shrubs, harming/swale details, and all proposed ground cover/treatment. No fencing will be permitted within the landscape buffers. Landscaping is also required adja~t to the pathway between Lots 3 and 5, Block 3. The five-foot-wide walking path shown oa the final plat was approved as an eight-foot-wide pathway in the Preliminary Plat. ff the proposal is only for afive-foot-wide path, justification should be given for the change slang with a commitment for how the remaining ane and one-half feet on each side of the pathway will be mainheined. 7. A letter of credit or cash surety in the amount of 110% will be required for all fencing, pathways, landscaping, pressurized irrigation, sanitary sewer, water, etc., prior to signature as the final plat. All improvements must be completed prior to obtaining certificates of occupancy. 8. Add a symbol to the legend for_the publig utr7ities,_irrigationantitirainage easement shown on _.. - the lots. 9. The applicant shall bmld an eight-foot-wide walking pathway adjacent to the Eight Mile Lateral, then from the Eight Mile Lateral along the easterly boundary back to W. Campfire Street. 10. Applicant shall be responsible to construct permanent perimeter fencing, except where the City has expressly agreed, in writing, that such fencing is not necessary. Fencing is to be in place prior to applying for building permits. 11. Provide corrected calculations of gross density and net density from page 1 of the application. 12. Recreational amenities of parks and a walking path are shown as being provided to the City item 9, page 1 of application). The City does not accept ownership or maintenance responsibility of these areas. PP-01-013 Mayor and City Council September 14, 2001 Page 3 13. Minimum frontage for lots in an R-4 zone is 80 feet. Lots 3, 4 and b, Block 5, only meet this requirement on one side and will require directional arrows indicating where the front of house must be oriented. Frontage for corner lots is determined by taking the line length plusone-half of the chamfer length. Cul-de-sac lots must have a minimum chord length of 40 feet. 14. Lot 3, Block 3, does not meet the minimum square footage of 8,000 square feet or the minimum chord length frontage of 40 feet. Adjust plat to comply with ordinance. 1S. Land surveyor is required to sign, stamp and date the face of the final plat. lb. The design of drainage areas shall ensure that water is retained only during 25-year storm events for a period of time not to exceed 24 hours, along with Landscape Ordinance requirements. 17. Add "City of Meridian" to the situate statement on page one of the plat map. 18. Please add or revise the following notes: 4. All lot and boundary lines have an adiacent permanent... ...each side of ear interior lot lines, flue (5) feet. 10. Applicant shall ensure that building footpri~s for 2,100-square-foot homes with 6i0- square-foot garage can be accommodated on these lots with the requited building setbacks for an R-4 zone. 20. Label the Real Point of Beginning on the face of the plat. 21. Include the Fight Mile Lateral easement area within Lot 4, Block 3, depict the appropriate easement for the Eight Mile Lateral on the plat, and inchule said easement line type in the legend. 22. Put the domestic water service origir- notation in the Certificate of Owners. GFIVH'u er. REQUIItEMENTS 1. Landscaping and pathways shall be installed prior to obtaining certificates of occupancy. 2. In accordance with City Ordinance 12-13-8-1, underground yeaz-round pressurized irrigation must be provided to all common landscape areas on site. Applicant shall be required to utilize any existing surface or well water for the primary source. If City water is proposed as a secondary source, developer shall be responsible to pay water assessments for the common landscaped areas. Applicant shall submit irrigation performance specifications in compliance with Ordinance 12-13-8-2. 3. Two-hundred-fifty-and 100-watt, high-pressure sodium streetlights will be required at locations designated by the .Public Works Deparment. All streetlights shall be installed at subdivider's expense. Typical locations are at street intersections and/or fire hydrants. 4. Submit compaction test results to the Meridian Building Department for any lots receiving engineered fill material. 5: All irrigation ditches, laterals or canals, exclusive of natural waterways, intersecting, crossing or lying adjacent and contiguous to the area being subdivided shall be tiled per City Ordinance 12-4-13. The ditches to be piped should be shown on the site plans. Plans will need to be approved by the appropriate irrigation/drainage district, or lateral users association, with written confirmation of said approval submitted to the Public Works Department. 6. Any existing domestic wells and/or septic systems within this project will have to be removed from their domestic service per City Ordinance Sections 9-1-4 and 9-4-8. Wells may be used for non-domestic purposes such as landscape irrigation. -- . Five-foot-wide sidewalks and pedestrian walkways shall be provided in accordance with City Ordinance Section 12-5-2.K 8. Please submit a copy of the Ada County Street Name Committee's "Final" approval letter for the Subdivision name, lot and block numbering, and street names. Make any corrections necessary to conform.
