Staten Park AZ 01-009RECt1RDED-RE UEST Cf .&CA COUNTY RECORAER „*) ` ;.I7AF'Ii +dCNARRO 1 p f~y/01`e~' ?UD2 oc 16 ppl 3: 27 I I~ ~ 1 19 2 4 2 MERIDIAN CITY CITY OF MERIDIAN ORDINANCE N0.02- ~ ~ / AN ORDINANCE FINDING THAT CERTAIN LAND TO BE KNOWN AS STATEN PARK SUBDIVISION THE LOCATION OF WHICH LIES CONTIGUOUS OR ADJACENT TO THE CITY LIMITS OF THE CITY OF MERIDIAN, COUNTY OF ADA, STATE OF IDAHO; AND FIlVDING THAT THE OWNER, CAFCO, INC., AN IDAHO CORPORATION, HAS MADE A REQUEST FOR ANNEXATION IN WRITING TO THE COUNCIL; AND THAT SAID LAND BE ANNEXED TO THE CITY OF MERIDIAN AND ZONING DESIGNATED LOW DENSITY RESIDENTIAL DISTRICT (R-4); AND DECLARING THAT SAID LAND, BY PROPER LEGAL DESCRIPTION AS DESCRIBED BELOW, BE A PART OF THE CITY OF MERIDIAN, COUNTY OF ADA, STATE OF IDAHO; REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH; AND DIRECTING THE CITY ENGINEER TO ADD SAID PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF MERIDIAN, IDAHO; AND DIRECTING THE CLERK OF THE CITY OF MERIDIAN TO FILE A CERTIFIED COPY OF THE ORDINANCE AND MAP OF THE AREAS TO BE ANNEXED WITH ADA COUNTY RECORDER, AUDITOR, TREASURER AND ASSESSOR, AND THE STATE TAX COMMISSION OF THE STATE OF IDAHO, PURSUANT TO IDAHO CODE SECTION 50-223 AND SECTION 63-2215. BE I T O RDAINED B Y T HE M AYOR A ND T HE C OUNCIL O F T HE C ITY OF MERIDIAN, COUNTY OF ADA, STATE OF IDAHO: SECTION 1. FINDINGS: That the following described land is contiguous and adjacent to the City of Meridian, Idaho, and that the City of Meridian has received a written request for annexation to the City of Meridian, Idaho, by the owner of said Property to-wit: PARCEL 2, as shown on Record of survey No. 4892, recorded as Instrument No. 97101984 in the Ada County Recorder's office, being a parcel of land in Government Lot 4 of Section 3., T.3N., R.1 W., B.M., Ada County, Idaho, being more particulazly described as follows: Commencing at the northwest corner of said Section 3, in the intersection of Ustick Road and Black Cat Road; thence, S. 89°10'38" E, 1314.32 feet (S. 89°53"E., 1320.0 feet per previous deed) along the north line of said Section (centerline of Ustick Road) to the northeast corner of said Government Lot 4 and the POINT OF BEGINNING; thence, ANNEXATION AND ZONING ORDINANCE (AZ-O1-009) - 1 S. 00°33'02" W. (S.0°08"W), 834.98 feet along the east line of said Lot 4 to a point in the centerline of Eight Mile Lateral of the Ridenbaugh canal; thence, along said centerline the following courses: N. 49°45'05" W., 57.26 feet; thence N. 57°20'47" W., 192.74 feet; thence, N. 54°35'00" W., 126.50 feet; thence, N. 63°59'23" W., 202.17 feet; thence, N. 60°05'49" W., 48.03 feet to a point; thence, leaving said centerline, N. 00°33'02" E., 515.75 feet to a point on the north line of said Section 3 (centerline ofUstick Road); thence continuing, N. 00°33'02" E., 25.00 feet to a point on the north right of way of Ustick Road; thence, S. 89°10'38" E., 535.54 feet along said right of way to a point; thence, S. 00°33'02" W., 25.00 feet to the POINT OF BEGINNING, said Parcel 2 containing 8.46 acres of land, more ore less, and being subject to the right of way of said Ustick Road and the easement for said Eight Mile Lateral. SECTION 2: That the above-described real property be, and the same is hereby annexed and made a part of the City of Meridian, Ada County, Idaho. SECTION 3: That the real property herein by this ordinance annexed to the City of Meridian hereinabove described shall be zoned Low Density Residential District (R-4). SECTION 4: That the .City Engineer is hereby directed to alter all use and area maps as well as the official zoning maps, comprehensive plan and all official maps depicting the boundaries of the City of Meridian in accordance with this ordinance. SECTION 5: The zoning designation set forth in Section 3 of this ANNEXATION AND ZONING ORDINANCE (AZ-O1-009) - 2 ordinance is subject to the terms and conditions of that certain Development Agreement by and between the City of Meridian and the owner of the land described in Section 1 dated the '¢t= day of DGfm~~ 2002 and that the uses are to be developed under the planned residential development. SECTION 6: All ordinances, resolutions, orders orparts thereof in conflict herewith aze hereby repealed, rescinded and annulled. SECTION 7: This ordinance shall be in full force and effect from and after its passage, approval and publication, according to law. SECTION 8: The Clerk of the City of Meridian shall, within ten (10) days following the effective date of this ordinance, duly file a certified copy ofthis ordinance and a map prepared in a draftsman manner plainly and clearly designating the boundaries of the City of Meridian, including the lands herein annexed, with the following officials of the County of Ada, State ofIdaho, to- wit: the Recorder, Auditor, Treasurer and Assessor and shall also file simultaneously a certified copy of this ordinance and map with the State Tax Commission of the State of Idaho, all in compliance with Idaho Code '63-2215 and'S0-223.
