HomeMy WebLinkAboutResolution No. 37RESOLUTIN NO. 37 RESOLUTION PROVIDING FOR THE SALE OF A STRIP OF LAND 8 FEET WIDE AND 330 FEET LANG IN THE S0,4 OF SECTION 12, TOWNSHIP 3 NORTH, RANGE 1 WEST, BOISE MERIDIAN, IN ADA COUNTY, IDAHO, OWNED BY THE CITY OF MERIDIAN, ADA COUNTY, IDAHO. The matter of the sale of a strip of land 8 feet wide and 330 feet long in the SEA of Section 12, Township 3 North, Range 1 West, Boise Meridian, in Ada County, Idaho, owned by the City of Meridian, Ada County, Idaho, was presented to the Council by the Mayor for consideration. After full and careful consideration, Councilman W. D. Skiver introduced and moved the adoption of the following Resolution of the City of Meridian, Ada County, Idaho, to -wit:: RESOLUTION PROVIDING FOR THE SALE OF A STRIP OF LAND 8 FEET WIDE AND 330 FEET LANG IN THE SE'4 OF SECTION 12, TOWNSHIP 3 NORTH, RANGE 1 WEST, BOISE MERIDIAN, IN �- ADA COUNTY, IDAHO. i- WHEREAS, The City of Meridian is the owner of the following described real estate, situate, lying and being in the said City of Meridian, to -wit:. Beginning at the Northwest corner of the SEA of Section 12, Township 3 North, Range 1 West, Boise Meridian, in Ada County, Idaho; thence South along the West line of said SE)4, 652 feet to a point, the real place of beginning; thence East parallel to the North line of said SF;A, 330 feet to a point; thence South 8 feet to a point; thence West 330 feet to the West line of said SEj; thence North 8 feet to the real place of beginning; and, WHEREAS, the said real estate is not used as a public park, playground or Abuilding site, nor is, the same needed for municipal purposes by the City of Meridian; and WHEREAS, said lot has value and in the opinion of the City Council can be sold at $lis time and should be sold without further delay, because it is idle land no longer used by the City, and WHEREAS, it is for the best interests of the City of Meridian and the inhabi- tants thereof, and the City Council deems it for the good of the City of Meridian that said tract be sold at the best price obtainable; and WHEREAS, THE City of Meridian has legal authority under the above mentioned circumstances and under the provisions of Section 50-1008 Idaho Code, to sell and convey the tract above described, after first publishing notice of intention to sell said property once each week for two successive weeks in a local newspaper of general circulation in the City of Meridian; NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL, OF THE CITY OF MERIDIAN, ADA COUNTY, IDAHO: - 1.. That the above described tract owned by the City of Meridian be offered for sale to the highest bidder for cash, lawful money of the United States, all bids to be in writing and sealed and filed with the City Clerk of the City of Meridian, on or before June 3rd , 1966. 2. All bids made and filed shall be accompanied by the full amount bid. 3. The 4ayor and City Council reserve the right to reject any and all bids. 4. That upon the acceptance by the City Council of any bidder's bid for the purchase of said tract, and upon the full payment of the purchase price thereof, ___the Cit Council of the City.of Meridian, Ada County, Idaho, by tnd through its Mayor , duly authen ica e y ici Clerk ­i6 hereby -au Ehorri-z-ed;-ordered--ax d ---disc+----- ed to convey to any bidder or purchaser, all the right, title and interest of the said City of Meridian, in and to the tract so purchased, by quitclaim deed. 5.. That the City Clerk of the City of Meridian shall cause to be published in the Meridian News -Times, a newspaper published and having general Circulation, in Meridian, Idaho, a Notice of Intention to Sell said Tract, which Notice shall be substantially in the following form: NOTICE OF INTENTION TO SELL REAL PROPERTY OWNED BY THE CITY OF MERIDIAN, ADA COUNTY, IDAHO. NOTICE IS HEREBY' GIVEN: That pursuant to the provisions of Section 50-1008 Idaho Code, and a Resolution of the City Council of the City of Meridian, Ada County, Idaho, adopted at a regular meeting thereof May 2nd , 1966, in accordance 2 with the provisions of said statute, the City Council of the said City of Meridian hereby offers.for sale, upon the terms and conditions hereinafter stated, and sub- ject to acceptance and approval by the said City Council, all the right, title and interest of the City of Meridian, Ada County, Idaho, of, in and to that certain lot, piece or parcel of real property, not used as a public park, playground, or public building site, nor needed for municipal purposes by the said City of Meridian, situate, lying and being in Ada County, Idaho, particularly described as follows, to -wit: Beginning at the Northwest Corner of the SE/4 of Section 12, Township 3 North, Range 1 West, Boise Meridian, in Ada County, Idahp; thence South along the West line of said SEy4 652 feet to a point, the real place of beginning; thence East parallel to the North line of said SEA, 330 feet to a point; thence South 8 feet to a point; thence West 330 feet to the West line of said SE"+: thence North 8 feet to the real place of beginning. TERMS AND CONDITIONS OF SALE:- (1) All bids must be in writing, sealed and filed with the City Clerk of the City of Meridian, on or before June 3rd_, 1966. (2) All bids filed shall be accompanied by the full amount of bid. (3) The City Council reserves the right to reject any and all bids. (4) This Notice is a Notice of Intention to sell or offer of sale, and not a sale of said real property. (5) Upon the acceptance of any bid or bids for the purchase of said tract, and pay- ment of the amount bid, a Deed of conveyance in terms of this Notice will be made, executedand delivered to any purchaser by the proper officers of the City Council of the City of Meridian. The motion for the adoption of said resolution was seconded by Councilman Marvin Bodine UPON.the question of the adoption of the resolution being put to the Council, the Clerk called for the "Yeas" and "Nays" with the result as follows: - John Navarro YEA Keith Ellis YEA Wayne Skiver YEA Marvin Bodine YEA There being four "Yeas" cast in favor of the adoption of the resolution and no "Nays" case against its adoption, the said resolution was declared adopted by the Mayor, Don M.
