PZ Recommendation to City Council%^ BEFORE THE PLANNING AND ZONING COMMISSION IN THE MATTER OF THE REQUEST FOR CONDITIONAL USE PERMIT FOR A 100 - VEHICLE PARK AND RIDE LOT ADA COUNTY HIGHWAY DISTRICT, Applicant Case No. CUP -00-032 RECOMMENDATION TO CITY COUNCIL 1. The property is located at the northeast corner of State Highway 69 and Meridian Road, Meridian, Idaho. Boise. 2. The owner of record of the subject property is J.L. Boyd Company of 3. Applicant is Ada County Highway District. 4. The subject property is currently zoned C -G. The zoning district of C -G is defined within the City of Meridian Zoning and Development Ordinance, Section 11-7-2IC 5. The proposed application requests a conditional use permit for a 100 vehicle park and ride lot. The C -G zoning designation within the City of Meridian Zoning and Development Ordinance requires a conditional use permit be obtained for most uses including those requested by the Applicant. (Meridian City Zoning and Development Ordinance, Section 11-8-1). RECOMMENDATION TO CITY COUNCIL - 1 CONDITIONAL USE PERMIT — PARK AND RIDE LOT FOR 100 VEHICLES ADA COUNTY HIGHWAY DISTRICT 6. The Meridian Planning and Zoning Commission recognizes that the proposed application is in compliance with the Meridian Comprehensive Plan. 7. The use proposed within the subject application will in fact, constitute a conditional use as determined by City Policy. 8. The Planning and Zoning Commission recognizes the concerns of the following, Sidney Harmon, homeowners representative for the Country Terrace Subdivision, Larry Chetwood, President of Meridian Ford, the manager of the JBs restaurant, Mark Freeman, attorney for Colleen Cope, a homeowner. RECOMMENDATION The Meridian Planning and Zoning Commission hereby recommends to the City Council of the City of Meridian that they approve the conditional use permit as requested by the applicant, subject to the following, with modifications by the Planning and Zoning Commission italicized: Adopt the Recommendations of the Planning and Zoning and Engineering staff as follows: 1.1 Any existing irrigation/drainage ditches crossing the property to be included in this project shall be tiled per City Ordinance 12-4-13. The ditches to be piped should be shown on the site plans. Plans will need to be approved by the appropriate irrigation/drainage district, or lateral users association, with written confirmation of said approval submitted to the Public Works Department. 1.2 Off-street parking shall be in accordance with the design standards set forth in Section 11-13-4 of the City of Meridian Zoning and Development Ordinance and in accordance with the Americans with Disabilities Act (ADA) requirements. All site drainage shall be contained RECOMMENDATION TO CITY COUNCIL - 2 CONDITIONAL USE PERMIT — PARK AND RIDE LOT FOR 100 VEHICLES ADA COUNTY HIGHWAY DISTRICT and disposed of on-site. 1.3 Paving and striping shall be in accordance with the standards set forth in Sections 11-13-4.D. and 11 -13 -4.E. -G. of the City of Meridian Zoning and Development Ordinance and in accordance with Americans with Disabilities Act (ADA) requirements. 1.4 All signage shall be in accordance with the standards set forth in Section 11-14 of the City of Meridian Zoning and Development Ordinance. No temporary signage, flags, banners or flashing signs will be permitted. 1.5 Provide five -foot -wide sidewalks in accordance with City Ordinance Section 12-5-2.IC 1.6 Provide street lights in accordance with City Ordinance Section 12-5- 2.6. The lights on the property will only shine 180°. 1.7 As part of a conditional use permit, the City of Meridian may impose additional restrictions/conditions. 1.8 No new municipal sewer or water service is being requested by ACHD to serve the site (no restroom). The only public amenities proposed are a pay phone, transit shelters and security bicycle lockers, none of which require City services. 1.9 City Ordinance 11-2-2 defines "Subdivision" as the "result of an act of dividing an original lot, tract or parcel of land into two (2) or more parts. The term "subdivision" shall also include the dedication of a public street..." The dedication of new road right-of-way on this parcel, therefore, will require a preliminary and final plat in order to create the two separate legal parcels noted on the Site Plan. Staff has indicated to the property owner (W.I. Moore) that we could support allowing the Park &_ Ride Lot to proceed with the condition that a Preliminary Plat application be submitted prior to any development on the proposed 3.25 -acre parcel east of the subject lot. So, under this scenario, the CUP could be approved and the Park & Ride Lot constructed with this condition attached for the 3.25 -acre parcel. 1.10 The proposed roadway also exceeds the Meridian City Ordinance Section 12-4-2-B., which states that no street which ends in a cul-de-sac RECOMMENDATION TO CITY COUNCIL - 3 CONDITIONAL USE PERMIT — PARK AND RIDE LOT FOR 100 VEHICLES ADA COUNTY HIGHWAY DISTRICT or a dead-end shall be longer than four hundred fifty feet (450'). A variance from this section would be required for the City to approve public road dedication and a plat. 1.11 Staff does not agree with ACHD that the new, 480 -foot access road off Overland be constructed as a rural road with no sidewalk, curb or gutter. Serving a commercially zoned parcel, it should be constructed as a commercial street section. Also, as a Park &_ Ride Lot, pedestrian and bicycle access into the site from Overland Road seems important. We recommend that sidewalk be constructed on at least one side of the new access road until such time as Parcel 2 is developed. 1.12 No trash enclosures or containers are shown on the Site Plan. The Applicant should detail if and/or where they intend to provide trash receptacles, size, exact location, etc. 1.13 Ordinance 12-4-7 requires a minimum of 20 -foot wide planting strip be constructed next to incompatible features. Staff considers this use incompatible with the single family residence adjacent to the south (Cope property). Therefore, the landscape strip shown along the south boundary must be increased from 15 feet (as shown) to 20 feet wide. We recommend the Applicant construct either a 3-4 foot high screening wall in front of the 16 parking spaces that head -in to the south property line OR provide a dense landscape screen that will provide an effective Duffer withir, thr,e (3) years from date of lot completion. In order to accommodate the five -foot -wide increased buffer on the south side, Staff could support reducing the 40 -foot wide buffer along 1-84 to 35 feet. As 1-84 and SH69 are both designated as entryway corridors, a 35 -foot minimum landscape buffer adjacent to the roadways shall be a condition of approval. 1.14 Applicant is to provide a detailed landscape plan for review and approval with submittal for a Certificate of Zoning Compliance. Said Certificate of Zoning Compliance is required prior to breaking ground in accordance with City Ordinance Section 11-19-1. 1.15 The Site Plan shows four (4) trees within the Ten Mile Drain easement. Staff supports these locations, but a License Agreement with Nampa - Meridian Irrigation District granting approval for the trees within their easement must be submitted prior to the City granting final approval for RECOMMENDATION TO CITY COUNCIL - 4 CONDITIONAL USE PERMIT — PARK AND RIDE LOT FOR 100 VEHICLES ADA COUNTY HIGHWAY DISTRICT the site. If such an Agreement cannot be obtained, the trees cannot be omitted and must be relocated to another location within the site. 1.16 The Site Plan does not show any trees within the interior lot planting islands. A minimum of I four (4) shade trees should be added to these planters in order to provide improved aesthetics and cooling to the lot interior. 1.17 No van -accessible parking stall (8 -foot access aisle) is shown on the Site Plan. Staff recommends at least one of the aisles be widened to 8 feet to provide better van accessibility. 1.18 No signage details were submitted with the application other than standard ADA handicap parking signs. Standard highway district signage is anticipated, but this should be clarified by the Applicant. The City P&Z Department would request ACHD's cooperation to be able to review any signs proposed to identify the site beyond the normal street directional signage. 1.19 The Destination 2015 Plan lists the 1-84/Meridian Road Interchange improvement under the future project list. It calls for a cloverleaf design to facilitate 1-84 westbound traffic onto SH69 southbound. The future design of the interchange could possibly significantly impact the subject parcel. The Applicant should address this issue with ITD and clarify to the City how the future interchange design may impact the Park S& Ride Lot. The Ada County Highway District (ACRD) staff has received the above referenced application requesting conditional approval to construct Park & Ride facility for 100 vehicles. The 1.5 -acre site is located on the north side of Overland Road approximately 600 -feet east of Meridian Road. This development is estimated to generate 220 additional vehicle trips per day based on the Institute of Transportation Engineers Trip Generation manual. B. The application and site plan stamped as received by the City of Meridian on April 28, 2000, and submitted to the District on May 12, 2000, have been reviewed by the ACHD Planning and Development staff and conforms to applicable District standards/policy, or can be made to conform with the change(s) to the plan described in the requirements stated below. This is a staff level approval and will not be heard by the ACHD Commission unless the site plan is changed in such a manner as to not conform with District standards/policy or an appeal of the Planning and Development staff decision is submitted as described within the Standard Requirements outlined below. On May 15, 2000, the District Planning and Development staff inspected this site and evaluated the transportation system in the vicinity. On May 19, 2000, the staff met as the District's Technical Review Committee and reviewed the impacts of this proposed development on the District's transportation system. The results of that analysis constitute the following Facts and Findings and recommended Site Specific Requirements. The applicant is proposing to dedicate a 60 -foot strip of right-of-way from Overland Road to the subject park and ride facility. The right-of-way strip is proposed to align with Country Terrace Way to the south. The applicant is proposing to constrict the roadway as a 28 -foot wide roadway from Overland Road to the subject site. Where the site abuts the right-of-way, the applicant is proposing to constrict the roadway as a 40 -foot street section with curbs, gutters, and sidewalks within the 60 -foot strip right-of-way. E. Driveways on the roadway extended should be constructed as 24 to 30 -foot wide curb cuts and located a minimum of 50 -feet north of Overland Road. Coordinate the design and location of driveways on the new roadway extended with District staff. The following requirements are provided as conditions for approval: Site Specific Requirements: Dedicate a 60 -foot wide strip of right-of-way from Overland Road to the subject site. Dedicate the right-of-way by means of recordation of the lot split or execution of a warranty deed prior to issuance of a building permit (or other required permits), whichever occurs first. Allow up to 30 business days to process the right-of-way dedication after receipt of all requested material. The owner will not be compensated for this additional right-of-way because is a local street and is to be brought to adopted standards by the developers of abutting properties. 2. Construct the new roadway as a 28 -foot wide roadway from Overland Road to the subject site and aligned within one lane width of Country Terrace Way on the south side of Overland Road. Where the site abuts the right-of-way, the applicant shall construct the roadway as a 40 -foot street section with curbs, gutters, and sidewalks within the 60 -foot strip right-of-way. Coordinate the design of the new street with the District's Planning and Development staff. 3. Prov ice a V-,rn:around at the terminus of the roadway with a minimum turning radius of 45 -feet. Coordinate the design of the turnaround with the District's planning and development staff. 4. Comply with requirements of ITD for State Highway I-84 frontage. Submit to the District a letter from ITD regarding said requirements prior to District approval of the lot split or issuance of a building permit (or other required permits), whichever occurs first. Driveways on the roadway extended shall be constructed as 24 to 30 -foot wide curb cuts and located a minimum of 50 -feet north of Overland Road. Coordinate the design and location of driveways on the new roadway extended with District staff. 7. As required by District policy, restrictions on the width, number and locations of driveways, shall be placed on future development of this parcel. Page 2 MCUP00-32 Standard Requirements: This decision of the Planning and Development Supervisor may be appealed to the Ada County Highway District Commission by the applicant or by another party within 15 calendar days from the date of this report. The request shall specifically identify each requirement to be reconsidered and include a written explanation of why such a requirement would result in a substantial hardship or inequity. The request will be heard by the District Commission at an evening meeting within 20 calendar days of the District's receipt of the appeal letter. The appellant will be notified of the date and time of the Commission meeting. 2. After ACHD Commission action, any request for reconsideration of the Commission's action shall be made in writing to the Planning and Development Supervisor within two days of the action and shall include a minimum fee of $110.00. The request for reconsideration shall specifically identify each requirement to be reconsidered and include written documentation of data that was not available to the Commission at the time of it's original decision The request for reconsideration will be heard by the District Commission at the next regular meeting of the Commission. If the Commission agrees to reconsider the action, the applicant will be notified of the date and time of the Commission meeting at which the reconsideration will be heard. 3. Payment of applicable road impact fees are required prior to building construction in accordance with Ordinance #193, also known as Ada County Highway District Road Impact Fee Ordinance. 4. All design and construction shall be in accordance with the ITD, Idaho Transportation Department specifications and approved supplements, Construction Services procedures and all applicable ACHD Ordinances unless specifically waived herein. An engineer registered in the State of Idaho shall prepare and certify all improvement plans. 5. The applicant shall submit revised plans for staff approval, prior to issuance of building permit (or other required permits), which incorporates any required design changes. 6. Construction, use and property development shall be in conformance with all applicable requirements of the Ada County Highway District prior to District approval for occupancy. 7. Any change by the applicant in the planned use of the property which is the subject of this application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory and legal restrictions in force at the time the applicant or its successors in interest advises the Highway District of its intent to change the planned use of the subject property unless a waiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is sought. 8. No change in the terms and conditions of this approval shall be valid unless they are in writing and signed by the applicant or the applicant's authorized representative and an authorized representative of the Ada County Highway District. The burden shall be upon the applicant to obtain written confirmation of any change from the Ada County Highway District. The current traffic congestion on our section of Overland would only worsen during the rush hour time frames with Park and Ride in place. Currently, vehicles back up to Bonefish while they are waiting for the Meridian Road stop light at 5:00 p.m. Turning left from Bonefish now can be hazardous as cars are also attempting to enter or exit Overland from Meridian Greens. During the morning rush hour, I can envision Overland east bound park and ride participants unable to make the required left turn into their location because of west bound Overland traffic and vehicles backing up all the way to the Meridian Road/Overland intersection. The result would be to prevent the drivers south bound in Meridian Road from making a left onto Overland Road which is currently stacking up well past JB's Restaurant. Until the intersection of Meridian Road and Overland is widened and improved, with an additional left turn lane, adding more vehicles at rush hour does not seem wise. Additionally, we oppose future development south of Overland, near Locust Grove before those roads are widened and turn lanes added.
