TERMINATION OF EASEMENTS
(Instrument Nos.7921717,8422904 and 8806507)
This Termination of Easements(this"Termination")is made this_7 day of
2023,by Piedmont Project LLC,an Idaho limited liability company("Piedmont").
RECITALS
WHEREAS,on or about April 23, 1979,that certain corrected Warranty Deed was recorded in
the records of Ada County,Idaho,as Instrument No. 7921717 ("First Warranty Deed");and
WHEREAS,in addition to conveying the real property described therein,the First Warranty Deed
granted a fifteen-foot(15')wide ingress/egress easement to the grantees therein("First Access
Easement"); and
WHEREAS, on or about May 9, 1984,that certain Warranty Deed was recorded in the records of
Ada County,Idaho,as Instrument No. 8422904("Second Warranty Deed");and
WHEREAS,in addition to conveying the real property described therein,the Second Warranty
Deed again granted a fifteen-foot(15')wide ingress/egress easement to the grantees therein("Second
Access Easement"); and
WHEREAS,on or about February 1, 1988,that certain Easement and Agreement was entered
into by and between Steven M.Bravo and Dee Ann Bravo,husband and wife(collectively"Bravo"),and
David B.Hicks and Debbie J.Hicks,husband and wife(collectively"Hicks"),and recorded in the records
of Ada County,Idaho,as Instrument No.8806507 ("Easement Agreement");and
WHEREAS,pursuant to the terms of the Easement,Bravo again granted to Hicks a fifteen-foot
(15')wide ingress/egress easement("Third Access Easement")to Hicks;and
WHEREAS,the legal descriptions for the First Access Easement, Second Access Easement and
Third Access Easement are identical; and
WHEREAS,Piedmont is the current successor in interest to Hicks and the beneficiary of the First
Access Easement,Second Access Easement and Third Access Easement; and
WHEREAS,Piedmont no longer needs the First Access Easement,Second Access Easement or
Third Access Easement for ingress and egress to its property and wishes to terminate them in their
entireties.
TERMINATION OF EASEMENTS - 1
NOW THEREFORE,Piedmont hereby states as follows:
ARTICLE I:
TERMINATION OF EASEMENTS
The First Access Easement and Second Access Easement are hereby terminated in their entirety
and are of no further force or effect.
The Easement Agreement(including the Third Access Easement)is hereby terminated in its
entirety and is of no further force or effect.
ARTICLE II:
GOVERNING LAW
This Termination shall be construed and interpreted in accordance with the laws of the State of
Idaho.
ARTICLE III:
AUTHORITY
The person signing this Termination on behalf of Piedmont,warrants and represents that he has
full authority to so execute this Termination on behalf of Piedmont.
