HomeMy WebLinkAboutCC - Alternative Compliance Letter RONZE Bow AVIATION SUBDIVISION September 18, 2023 PP& CUP(H-2021-0096) Alternative Compliance Request for Aviation Subdivision: I am writing on behalf of the Aviation Subdivision development team to request alternative compliance for specific landscaping requirements outlined within the City of Meridian Code as well the Condition of Approval for the Aviation Subdivision project. We believe that alternative compliance is necessary in th case due to certain unique circumstances and conditions that make strict adherence to the requirements unfeasible or impractical. The Aviation Subdivision is a 10-acre open land site that is currently under construction in substantial conformance with the approved preliminary plat.The project strives to meet all requirements and conditions set forth in the preliminary plat and is designed in accordance with the Unified Development Code (UDC).The development encompasses a mixture of multifamily sites and aligns closely with the Ten Mile Interchange Specific Area Plan, emphasizing high connectivity and easily accessible open spaces. It comprises a total of 75 proposed units, offering a variety of housing options beneficial to the community. Our request for alternative compliance pertains to two specific areas within the Aviation Subdivision: 1. South Side of W.Aviator Extension: "CITY/AGENCY COMMENTS& CONDITIONS"Condition of Approval #14 C. requires the submission of a revised landscape plan that includes required street buffer trees within the 20-foot buffer on the south side of the W. Aviator extension. Baron Properties, the developer to the south of the Aviator Subdivision project, has expressed their intention to complete their own landscaping improvements along the southern street frontage of W.Aviator Street.They have formally committed to this in writing and have requested that we seek alternative compliance for the landscaping improvements in lieu of an easement. P.O. Box 8525 Boise, Idaho 83707 Specific Requirements Proposed to be Modified: The requirement to show the required street buffer trees within the 20-foot buffer on the south side of the W. Aviator extension, as per Condition of Approval number 14. Reason for Modification: Baron Properties,the developer to the south of the project, has expressed their formal commitment to complete the landscaping improvements along the southern street frontage of W. Aviator Street.They have provided written assurance to fulfill this requirement on their own, eliminating the need for duplication of efforts. Demonstration of Equal or Superior Means: Allowing Baron Properties to complete the landscaping on the southern frontage of W.Aviator Street aligns with the intent and purpose of the regulation, as it promotes efficient and coordinated development efforts without compromising the landscaping requirements.This alternative compliance provides an equal, if not superior, means of achieving the intended goal of the regulation. Supporting Documentation: I have attached a copy of Baron Properties'formal commitment letter, dated September 81h, 2023, stating their intent to complete the landscaping improvements. We request that the City grant alternative compliance for this specific requirement, given that Baron Properties has committed to completing the landscaping improvements as per the condition of approval. Alternative compliance in this case aligns with the intent of encouraging creative solutions to land use problems and avoids duplicative efforts. 2. North Side of West Topeka Street:The area on the north side of West Topeka Street, within an easement granted to the Nampa & Meridian Irrigation District (NMID), historically does not allow trees within their easements. Due to this restriction,we are requesting that this area not be included in the total required tree landscaping calculations and be allowed to be utilized as a grassy area instead. Including trees in this location would be contrary to the NMID's restrictions and impractical given the historical context. Specific Requirements Proposed to be Modified: The landscaping requirements for the area on the north side of West Topeka Street, encompassed by an easement granted to the Nampa & Meridian Irrigation District(NMID). Reason for Modification:The NMID has historically not allowed trees within their easements, making it infeasible to plant trees in this specific location. Demonstration of Equal or Superior Means: Given the NMID's restrictions and historical practices, utilizing this area as a grassy space aligns with the intent of the regulation by avoiding tree planting in an area where it is not feasible.This alternative compliance ensures compliance with the NMID's requirements while still contributing to the overall aesthetics and open space of the community. We kindly request that alternative compliance be granted for the landscape buffer on the north side of West Topeka Street, allowing us to use this area as a grassy space in accordance with the NMID's requirements. In accordance with the City's code on Alternative Compliance (1-513-5), we have submitted this formal application for alternative compliance prior to the final plat submittal, providing the specific requirements proposed for modification, the reasons for the modification, and a demonstration of how the alternative means for compliance meets the intended purpose of the regulation. We firmly believe that these alternative compliance requests are in line with the purpose, intent, and objectives of the City's regulations and will not be materially detrimental to the public welfare or impair the intended uses and character of surrounding properties. Additionally,these requests are specific to the Aviation Subdivision project and should not set any precedent for acceptance in other cases.
